‘On March 18, 2010, the Board of License Commissioners for Montgomery County (Board)
held a hearing on the application by Siu Loong Cheung and Siu Ling Wong, on behalf of Ginger
Asian Bistro, LLC, for a Beer and Light Wine License, Class B, Hotel/Restaurant, On/Off Sale, for
the premises known as Siu’s Asian Bistro, which premises are located at 12271 Tech Road,
Silver Spring, Maryland.
During the hearing, the Board received testimony and documentary evidence from the
applicants and/or witnesses regarding the application.

‘Testimony
‘Applicant Siu Ling Wong is the resident agent for this business, She stated that she has
lived In Montgomery County Maryland, for nine years. Applicant Slu Cheung, who resides
in McLean, Virginia, will be In charge of the day-to-day operations of this business. Her
prior experience includes helping out at her sister's restaurant in Prince Georges County,
Maryland, as a waitress. She stated that she did not receive any violations at the facility
while she worked there.
‘The applicants provided a floor plan of the restaurant at the hearing. There are seats for
a total of 40 patrons. ‘The facility is handicapped-accessible, There is no outdoor café.
‘This restaurant is located between Five Guys Restaurant and Jerry's Sub Shop in a
shopping center with a number of food facilities. There was nothing in this location prior
to the applicants’ business. The applicants are currently doing renovations and plan to
‘open for business in the middle of May 2010.
‘The applicant will have eight employees, including four chefs, two servers, and two
delivery personnel. Applicant Siu Cheung Is alcohol-awareness certified. The applicants
stated that they intend to have all the servers and delivery personnel become alcohol-
awareness certified as well. Both applicants attended the Department of Liquor Control's
Alcohol Law Education and Regulatory Training (ALERT) class. The Board encouraged
the applicants to have their employees attend the ALERT class as well. The applicants
stated that they have put together a notebook on policies for their employees.
‘A menu was submitted at the hearing. This restaurant will be a Chinese/Japanese/Asian
fusion family restaurant, which will include a sushi bar. The applicants stated that the
beer and wine will be an additional service to the community and they wanted the off-
sale privilege as well, for the customers’ convenience so they could have alcoho! withtake-out food. The applicants also stated that they would like to do beer and wine
deliveries as well. Their policy will be that the delivery person will be 21 years of age
and the delivery person will have forms for the customer to complete and the delivery
person will check the patron‘s identification when the delivery is made. The applicants
‘expect their food-to-alcohol sales ratio to be 70-30.
5. Hours of operation of the restaurant are: ‘a.m, to 12:00 midnight Sunday; 11:00
‘a.m, to 11:00 p.m, Monday through Thursday; and 11:00 a.m. to 12:00 midnight Friday
and Saturday.
6. At this hearing, Siu Cheung took the Board's ID test and scored 100%; she, therefore,
passed the test.
Eindings of Fact
Based on this evidence and the law, the Board concludes that the granting of this license
{s necessary for the accommodation of the public as required by Article 2B, Section 10-202 of the
‘Annotated Code of Maryland; that the applicants are fit persons to receive the license applied for;
that the operation of the business will not unduly disturb the peace of the residents of the
‘neighborhood in which the place of business is located; that there are no other reasons why such
license should not be granted. The specific grounds for this conclusion are:
1, The applicants were able to properly answer questions with regard to the Alcoholic
Beverage Laws. The applicants were familiar with I.D, requirements, purchasing
procedures, and the legal age to purchase alcoholic beverages.
2. The applicants have not been convicted of a felony.
3, There was no opposition to the granting of this license.
‘Conclusion of Law
UPON a motion to grant the application, with permission for delivery of alcohol, by Mr.
Gilchrist, and seconded by Mrs. Metz, and unanimously carried by Mr. Thirolf, Mr. Gilchrist, Mrs.
Pefia-Faustino, and Mrs. Metz,
RESOLVED that the license applied for at the designated premises be and it is hereby
‘APPROVED.
