‘On March 4, 2010, the Board of License Commissioners for Montgomery County (Board)
held a hearing on the application by Xavier Ramirez, on behalf of Ramirez Family, LLC, for a Beer
and Light Wine License, Class H, Hotel/Restaurant, On Sale Only, for the premises known as
Manhattan Dell, which premises are located at 7250 Muncaster Mill Road, Derwood, Maryland.
During the hearing, the Board received testimony and documentary evidence from the
applicants and/or witnesses regarding the application.

‘The applicants were represented by counsel, Murray A. Kivitz.

Applicant Xavier Ramirez, who resides in Silver Spring, Maryland, owns 50% of the
Ramirez Family LLC, and his brother, Herman Ramirez, owns the other 50%. The
applicant stated that he will be in charge of the day-to-day operations of this business.
His prior experience includes work at a Mexican grill as a waiter in the Georgetown area
of Washington, D.C., and he had ownership in Sligo Deli in Silver Spring, Maryiand, a
grocery store that also sold beer. The applicant stated that he had no violations while he
was in charge of that business. The applicant stated he has no criminal convictions.
At the hearing, the answer to Question #18 was amended to "Yes” due to the fact that
the applicant's brother, Herman Ramirez has interest in Ramirez Family, LLC. Also, the
‘answer to Question #6(b) was amended to include the address of Ramirez Family, LLC to
be 806 Malibu Drive, Silver Spring, Maryland 20901.
‘The applicant provided a floor plan of the restaurant at the hearing. There are seats for
a total of 35 patrons. There is a counter with six seats. The applicant stated that the
alcohol will be brought to the table for the patron by the wait staff. There is no outdoor
café. There is a total of 1,800 square feet in the restaurant. The applicant took over
the business on June 7, 2009 and is currently open for business.
‘The applicant will have two employees. Applicant Xavier Ramirez and his brother
Herman Ramirez are alcohol-awareness certified. The applicant stated that he will have
any new hires become alcohol-awareness certified as well. Applicant Xavier Ramirez
stated that he took his alcohol-awareness training from John Murray. The applicant also
attended the Department of Liquor Control's Alcohol Law Education and Regulatory
Training (ALERT) class.
‘A menu was submitted at the hearing. The restaurant will serve Latin American food.a.m. to 5:00 p.m. Sunday; 6:30 a.m. to

‘a.m, to 8:00 p.m. Saturday.
10:00 p.m. Monday through Friday; and
7. At this hearing, Xavier Ramirez took the Board's ID test and missed two out of ten; he,
therefore, passed the test,
Findings of Fact
Based on this evidence and the law, the Board concludes that the granting of this license
is necessary for the accommodation of the public as required by Article 28, Section 10-202 of the
‘Annotated Code of Maryland; that the applicant is a fit person to receive the license applied for;
that the operation of the business will not unduly disturb the peace of the residents of the
neighborhood in which the place of business is located; that there are no other reasons why such
license should not be granted. The specific grounds for this conclusion are:
1. The applicant was able to property answer questions with regard to the Alcoholic
Beverage Laws. The applicants were familiar with I.D. requirements, purchasing
procedures, and the legal age to purchase alcoholic beverages.
2. The applicant has not been convicted of a felony.
3. There was no opposition to the granting of this license,
4, The on-sale only service of alcoholic beverages compliments the food to be offered to
patrons.
‘Conclusion of Law
UPON a motion to grant the application, by Mr. Um, and seconded by Mr. Gilchrist, and
unanimously carried by Mr. Um, Mr. Thirolf, Mr. Gilchrist, Mrs. Pefia-Faustino, and Mrs. Metz,
RESOLVED that the license applied for at the designated premises be and it is hereby
