BOARD OF LICENSE COMMISSIONERS FOR MONTGOMERY COUNTY Beer, Wine & Liquor lass B, Hotel/Restaurant ‘On Sale Only Daniel Arana Bravo Daniela Jaramillo Dent ‘The Applicants RESOLUTION 10-39 Proceedings (On March 18, 2010, the Board of License Commissioners for Montgomery County (Board) held a hearing on the application by Daniel Arana Bravo and Daniela Jaramillo Dent, on behalf of QuarCaterers, LLC, for the transfer of a Beer, Wine, and Liquor License, Class B, Hotel/Restaurant, On Sale Only, for the premises known as Sal de Espana, located at 838-C Rockville Pike, Rockville, Maryland. During the hearing, the Board received testimony and documentary evidence from the applicant and/or witnesses regarding the application. ‘Testimony 1. Atax letter from the Comptroller of the State of Maryland's office was read into the record, and a copy was given to the applicants. 2. Applicant Daniel Arana will be in charge of the day-to-day operations of this business. He stated that his second last name is Bravo. His prior experience includes being a chef before buying this restaurant. He stated that there have been no alcohol violations during the time he has worked at this restaurant. Daniela Jaramillo stated that her second last name is Dent; she stated that in her country, they use two last names. She stated that she has six years of experience in the sale and service of alcohol; in her last ‘two jobs she was a catering manager in Washington, DC, and she worked at the lounge Of the Park Hyatt hotel, also in Washington, DC. She stated there were no violations at tthe places she was employed. 3. Afloor plan was submitted at the hearing. The floor plan for the interior of the restaurant has been unchanged since these applicants took over the business. The faclity has a total of 15 tables with 60 seats for patrons, including 4 seats at the bar. There is no outdoor café. This facility is currently open and operating; the applicants took over the business January 1, 2010, 4. Amenu was submitted at the hearing. The applicants stated that this will be a Spanish restaurant, The applicant's predicted food-to-alcohol ratio at this facility will be 75-25, ‘The chef at this restaurant will remain the same as with the previous owner. 5. 6 ‘The hours of operation of the facility are 5:00 p.m. to 9:00 p.m, Sunday; Closed Monday; 11:00 a.m, to 2:00 p.m. and 5:00 p.m. to 9:00 p.m. Tuesday through Thursday; and 11:00 a.m, to 2:00 p.m. and 5:00 p.m. to 10:00 p.m. Friday and Saturday. There are 6 employees at this facility. Both applicants are alcohol-awareness certified Both applicants Daniel Arana Bravo and Daniela Jaramillo Dent took the Montgomery County Department of Liquor Control Alcohol Law Education and Regulatory Training (ALERT) class. The applicants stated that will try to have all front-of-the-house staff alcohol awareness certified. ‘At this hearing, Daniela Jaramillo Dent took the Board's I.D. test and scored 100%; she, therefore, passed the test. The applicants were given a renewal packet at the hearing. Findings of Fact Based on this evidence and the law, the Board concludes that the granting of this license |s nécessary for the accommodation of the public as required by Article 2B, Section 10-202 of the ‘Annotated Code of Maryland; that the applicant is a fit person to receive the license applied for; that the operation of the business will not unduly disturb the peace of the residents of the neighborhood in which the place of business is located; that there are no other reasons why such license should not be granted. The specific grounds for this conclusion are: 1 4, The applicants were able to properly answer questions with regard to the Alcoholic Beverage Laws. The applicants were familiar with I.D. requirements, purchasing Procedures, and the legal age to purchase alcoholic beverages. ‘The applicants have not been convicted of a felony. ‘There was no opposition to the granting of this license. ‘The on-sale service of alcoholic beverages compliments the food to be offered to patrons. ‘Conclusion of Law UPON a motion to grant the application by Mrs. Pefia-Faustino, and seconded by Mr. Gilchrist, and unanimously carried by Mrs. Metz, Mr. Thirolf, Mr. Gilchrist, and Mrs, Pefia- Faustino, RESOLVED that the license applied for at the designated premises be and it is hereby APPROVED.
