‘Sec. 7-278. Hearing prior to dismissal of municipal police head. Just cause requirement. Appeal, No
active head of any police department of any town, city or borough shall be dismissed unless there
showing of just cause by the authority having the power of dismissal and such person has been gi
in writing of the specific grounds for such dismissal and an opportunity to be heard in
personally or by counsel, at a public hearing before such authority. Such public heari
specified by charter, shall be held not less than five nor more than ten days after such notice. Any person so
dismissed may appeal within thirty days following such dismissal to the superior court for the judicial district
in which such town, city or borough is located. Service shall be made as in civil process. Said court shall
review the record of such hearing, and, if it appears upon the hearing upon the appeal that testimony is
necessary for an equitable disposition of the appeal, it may take evidence or appoint a referee or a
committee to take such evidence as it directs and report the same to the court with his or its findings of fact,
which report shall constitute a part of the proceedings upon which the determination of the court shall be
made. The court, upon such appeal, and after a hearing thereon, may affirm the action of such authority, or
may set the same aside ifit finds that such authority acted illegally or arbitrarily, or in the abuse of its

CHAPTER 109 POLICE DEPARTMENT.

§ 109-1 Establishment; purpose.
Pursuant to § 7-148(c)(4XA) of the Connecticut General Statutes, as amended, there is hereby established a
Police Department for the Town of East Hampton, which shall have all the powers and duties of a municipal police
department conferred by state statutes and local ordinances for the purpose of police protection and law
enforcement.
§ 109.2 ents.
Pursuant to Town Charter, based upon merit and fitness alone, the Town Manager shall appoint a Chief of Police
and all sworn law enforcement officers for the Department,
§ 109-3 Powers and duties of Chief of Police,
The Chief of Police, subject to such rules and regulations as are adopted by the Town Council, shall have general
management, administrative and supervisory control over all operations of the Department. The Chief of Police
shall be the traffic authority for the Town of East Hampton.
§ 109-4 ‘Transfer of authority.
The ordinance adopted in June 1963 establishing a Board of Police Commissioners is hereby repealed upon the
effective date ofthis chapter. All incumbent police officers, including the Chief of Police, shall continue to hold
rank, and all such equipment assigned to the Commission shall hereby be permanently transferred to the
department established by this chapter.
§ 109-6 Effective date,
This chapter shall take effect upon the election of a Town Counell on November 7, 1989,
