AFFIDAVIT
The undersigned affiant, being sworn, deposes and says:

13.0n 10-22-09 | conducted a neighborhood canvass in the area of Passanisi's residence. | spoke to
residents that live in the area and who may have heard a collision late on 9-22-09 or early 9-23-09. All of
the residents that | spoke to all stated that they did not hear any type of crash or noise that would have
resulted as a result of a "side swipe". One neighbor stated that she has four adults living in her house
and her male partners a light sleeper. She thought it was odd when she found out that Passanisi's
vehicle was hit in front of their residence because she thought for sure that someone would have heard it.
Many of the residents also were suprised to hear that Passanisis vehicle was hit while it was parked on
‘he roadway. They stated that Passanisi always parks his vehicle in his driveway and never in the road.
‘4s I was conducting the canvass, | saw that Passanisi was outside of his residence. | walked over to him
and explained that I was assigned to investigate the accident and that | would be in the area. He said that
1e understood and heard that | was assigned to investigate the incident. | asked where his vehicle was
sarked when it was hit and he pointed to the north west corner of the driveway and told me it was parked
on the roadway, just west of the driveway. He advised me that he has a lawyer and gave me his name
and number and | then told him that | will be in touch with him at a later date. | then walked to the area of
he road, where he pointed out. | looked for any physical evidence that would have been left behind if the
sollision had happened there. There were no signs of any physical damage in the area in which he
sointed to. | looked on the roadway, on the grassy area near the corner of the driveway and on the
sriveway itself and | did not see any sort of debris. There was a telephone pole near the comer of the
iriveway and | looked to see if it had any damage to the area that either vehicle could have made contact
vith it and | did not see any damage to the pole. No evidence was located and | then left the area.
|4.On 10-27-09, | had two search and seizure warrants signed by Judge Vitale at Middlesex Superior
Sour. One warrant was for {AMP cell phone record, and the other was for Angelo Passanisi’s cell
»hone record. | tien faxed the warrant to the associated cell phone companies. On this date | again
‘anvassed the potential travel routes that Passapisi could have taken home from (§lPresidence. |
anvassed these areas for approx. three hours with negative results fora point of impact for an accident.
5.On 10-28-09, | processed the vehicle and its parts. Sgt. Elkin and Officer Godwin (both of whom are
ssigned to the Middletown Police Traffic Bureau) assisted. Numerous pictures were taken by Det.
"tokop. During the search of the vehicle, there were several pieces of grass and leaves observed
‘edged into parts of the undercarriage of the Jetta. It appeared that the grass and leaves were wedged
