Section 113 was modified to provide that any ageney adoption petition, shall be filed in the same court of the county in which parental rights were terminated, a surrender had been approved or the most recent proceeding had been heard pursuant to Article 10 or Article 10-A of the Family Court Act, or Section 358-2 of the Social Services Law. The Court in which any of the aforementioned occurred fast would he designated as the originating Court. If an adoption petition is filed in another court (ie. Surrogate’s Court or another county’s Family Court) then the adoption matter shall be stayed and the Court with the filing shall communicate with the originating Court. The originating Court shall then determine whether to keep the case and have the Court where the petition was filed transfer the adoption proceeding or to cede jurisdiction over the adoption to the other Court ‘As a practical matter, all agency adoption petitions which arise from a child being freed for adoption as a result of a TPR or surrender in Family Court should be filed in the Family Court which heard the TPR of surrender in order to expedite the proceeding. Several portraits of distinguished judges and attomeys will be displayed in the halls of the Courthouse, however, they are in need of repair and refurbishment. Each portrait ean be adopted in the amount it would cost to repair and refurbish said portrait (pricing and list of portraits can be obtained from Ricardo J. Mauro, Esq. at (315) 793-8807). Once adopted and thereafter refurbished, the portraits will be displayed on the walls of the Oneida County Courthouse, recognizing thereunder the name of the individual or law firm that adopted the portrait. Due to the limited number of portraits, the selection will be offered on a first come, first serve basis, in the order by which facsimiles are received from those who are interested in adopting.
