Colorado, in the name and by the authority of the People of the State of Colorado, informs the
court of the following offenses committed, or triable, in the county of Denver:
COUNT 1: INVASION OF PRIVACY FOR SEXUAL GRATIFICATION - SECOND
OFFENSE (F6)
On or about October 30, 2016, JACOB MAGEE unlawfully, feloniously, and knowingly
observed or took a photograph of the intimate parts of SINIINNES, without the victim's
consent, in a situation where the victim had a reasonable expectation of privacy, for the purpose
of the defendant’s own sexual gratification.
Further, the defendant was previously convicted of a crime involving unlawful sexual behavior
on OCTOBER 19, 2012, in the DISTRICT COURT, BOULDER, COLORADO, in case number
12CR00672; in violation of section 18-3-405.6(1),(2)(b)(D), C.R.S.

AND THE ARREST WARRANT FOR THE PERSON(S) OF:

‘On October 30, 2016 at approximately 1420 hours Officer Craig Moen #91027 was working in an off-
duty capacity at Sports Authority Field at Mile High Stadium, 1701 N Bryant St., on the fifth floor,
west side. Officer Moen responded to a call of a man taking pictures of a woman, Officer Moen met
the victim, QIN (03/1979), and her husband, Ci (0749/1976),
reported she was standing outside the men’s room in section 101 around 1400 hours waiting on het
husband. @@NNBB felt her skirt move and looked down to see the suspect pulling his camera phone from
under her skirt. GINNEIIIIME told the male to give her his phone and he refused. SNM said he
emerged from the bathroom, saw the suspect arguing with his wife and holding a phone. Samm
said he tried to get the phone from the man and they hed a physical confrontation. During this time the
suspect was attempting to delete photos from his phone. The suspect, a White male, 5°10", 180 Ibs.,
wearing a white hat, an orange #58 Von Miller jersey and sunglasses on cap ran south through the
stadium on the first level. (END gave chase but the suspect was able to get away,
On November 4, 2016 Detective Daniel Tregembo #05041 was assigned the case for follow-up
investigation. Det. Tregembo made phone contact with Jared Devine, Senior Security Manager for
Sports Authority Field at Mile High Stadium. Mr. Devine reported he was able to locate video
surveillance footage of the incident. Det. Tregembo responded to the stadium and reviewed the
footage. The suspect is observed placing his phone under the victim's skirt. The victim and her
husband are seen confronting the suspect until he flees. The suspect is observed to have a “blade” type
prosthetic right leg. Mr. Devine was able to research more video footage and determine the suspect
attempted to re-enter the stadium. By checking on scanned and re-scanned tickets Mr. Devine was able
to identify a potential ticket number and provide Det. Tregembo with contact information for the
assigned user of the ticket, identified 15 a
On November 7, 2016 Det. Tregembo made phone contact with (JINN who reported she
teceived several tickets to the Broncos game through work. She attended the game with her boyfriend
and his friend, identified as Jacob Magee. QED stated Magec has a prosthetic leg, II also
provided a contact phone number for Magee. Det. Tregembo conducted a public records search and
was able to identify a Jacob Magee (11/24/83) listed as a registered sex offender in Lafayette, CO. Det.
Tregembo requested a DMV photo for Jacob Magee. Det. Tregembo created a six picture photo array,
including the DMV photo of Jacob Magee.
On November 9, 2016 (TT and GEEMBresponded to Denver Police Headquarters. Det.
Steve Bishop' met with [NED and GENEEEENB individually; and showed them photo arrays.
