THE PEOPLE OF THE STATE OF COLORADO County/District Court City and County of Denver, Colorado Offense Case No. 2014-43780 AFFIDAVIT AND APPLICATION FOR ARREST WARRANT AND THE ARREST WARRANT FOR THE PERSON(S) OF: Robert Angel PEREZ, DOB 05-21-1974 2 white male, 5°6”, 235 pounds with black hair and brown eyes, DPD 556005, SID 11215792, FBI 744698AB7, SSN QUIN, Colorado DL 97- 036-0912, for one count of Murder in the First Degree, C.R.S, 18-3-102, a Class 1 Felony. 1, Detective Randal Denison, 96007, Your Affiant states under oath that the facts known to the Affiant ‘which establish probable cause to believe that @ criminal offense was committed, and that the offense ‘was committed by the above named person(s), are the following: ‘On August 20, 2014, Your Affiant was assigned to assist with the investigation into the death of Dennielle Perez, who was found deceased in the basement of her residence at 19400 B. 45" Avenue, in the City and County of Denver on thet date, ‘At approximately 2:45 p.m., Your Affiant was advised by Homicide Unit Supervisor, Sergeant James Kukuris of a suspicious death at 19400 East 45" Avenue. Sergeant Kukuris advised that Robert Perez called the Denver Police 911 system and reported that he had arrived home and found his wife, Dennielle Perez, dead in the basement of their home. Mr. Perez advised the 911 call taker that he believed his wife bad suffered a gunshot wound. Denver Police, Firefighters and Paramedics responded to the residence and discovered the female lying deceased on the basement floor with an apparent gunshot wound. The victim was pronounced dead at 2:20 pan. on that date by Doctor McVaney with Denver Health Medical Center. ‘The residence was secured pending further investigation and Robert Perez was transported to Denver Police Department Headquarters to be interviewed. Homicide Unit Detective Michael Martinez prepared a search warrant for the residence at 19400 East 45® Avenue. The search warrant was reviewed and approved by Denver County Court Judge Breese. At approximately 3:25 p.m., Mr, Perez arrived at Denver Police Headquarters and Homicide Unit. Detective Troy Bisgard observed possible blood on Mr. Perez’s clothing and hands. Detective Bisgard requested that members of the Crime Lab obtain photos of Mr, Perez, DNA swabs of his hands and Gunshot Residue Swabs (GSR) of his hands and face. Detective Bisgard then began an interview with Mr, Perez after advising him of his rights under Miranda. Mr. Perez told Detective Bisgard that on the previous Saturday evening, August 16, 2014 he 6-¥/ Page 2 received information via a message on his phone Mr. Perez told Detective Bisgard that he later his wife's cellular telephone and searched through the contents. Bisgard that he did but did not verify if his wife had done so or not. ‘Mr, Perez told Detective Bisgard that he believed his wife was sleeping in the basement when he went to work the moming of August 20, 2014. Mr. Perez said that while he was at work he attempted several times unsuccessfully to contact his wife on her cellular telephone or their home telephone. Mr. Perez said that upon his retum from work, he was there for approximately 10-15 minutes before he found his wife in the basement and immediately called 911. Mr. Perez said thet he did not see his wife's car in the driveway when be left for work. Mr. Perez said that the last several days his wife had ‘been locking her car in the garage. Mr. Perez said that when he returned home from work on this date, he entered the residence through the front door and that the overhead garage door was closed. Mr. Perez said that when paramedics and firefighters arrived at his house, they tumed the handle and used the overhead garage door to enter the residence. ‘During the interview Mr. Perez said that he had wom tennis shoes, blue denim pants and a t-shirt with a “Monte Carlo SS” logo to work on that date. Mr. Perez said he had taken of his shoes, pants and shirt and put them up stairs before finding his wife. Mr. Perez said that when he found his wife, he was wearing the clothing he had on during the interview. Your Affiant personally observed Mr, Perez at Denver Police Department Headquarters on that date and that he was dressed in two (2) white t-shirts in layers, and grey/green plaid boxer style shorts. Your A ffiant observed apparent blood on the outer t- shirt and the hands and arms of Mr. Perez, During the interview, Mr. Perez. denied killing his wife. During the execution of the Search Warrant at 19400 B. 45" Avenue, a pair of blue denim pants and a black t-shirt with, “SS Monte Carlo” logo were recovered from on the bed in the second floor master bedroom. Page 3 On Friday, August 22, 2014 Your Affiant completed and submitted a Request for Examination asking the blue denim pants and black t-shirt with the “SS Monte Carlo” logo be ‘examined for possible blood and gunshot residue (GSR). Your Affiant also requested that the GSR test kits from Robert Perez’s face and hands, as well as GSR test kits obtained from the body of Dennielle Perez be examined. On August 21, 2014 at approximately 8:30 .m., Your Affiant, and fellow Homicide Unit Detectives ‘Mark Crider and Troy Bisgard attended the victim’s postmortem examination supervised by Chief Medical Examiner James Caruso, M.D. Dr. Caruso told the investigators that the victim’s cause of death was @ gunshot wound and the manner of death was pending. On Thursday, August 28, 2014, Detective Bueno and Your Affiant meet with representatives ftom the several units of Denver Police Department Crime Lab, the Denver Office of the Medical Examiner, and the Denver District Attomey’s Office. Using a shotgun measuring the same length from muzzle to trigger as that recovered from19400 East 45° Avenue, the investigators were unable to replicate a position where a person of Dennielle Perez's size could successfully fire the weapon herself and ccausing the injuries she suffered given their location and trajectory of the projectile through her body. On Friday, August 29%, 2014 Detective Eric Bueno and Your Affiant met with Denver Police Department Crime Lab, Forensic Scientists Clark Smith and Robert Burroughs and learned that ‘gunshot residue had been discovered on the on the GSR test kits obtained from Robert Perez’s face and both of his hands, and that none had been located on the GSR test kits obtained from the body of ‘Dennielle Perez. Your Affiant learned that gunshot residue had also been discovered on the "Monte Carlo SS” shirt Perez had worn to work and claimed to have removed prior to finding his wife deceased. On Friday, August 29%, 2014 Detective Eric BUENO viewed security camera recordings from August 20, 2014 from 10 Galapago Street, Mr. Perez's place of employment. Detective Bueno observed that on that date Mr. Perez was wearing a black t-shirt with “SS Monte Carlo” printed on front. On Friday, August 29", 2014 Your Affiant was contacted by Denver Police Department Crime Lab, Forensic Scientist Susan Berdine. Ms. Berdine informed Your Affiant that blood had been located on the "Monte Carlo SS” shirt Perez had worn to work and claimed to have removed prior to finding his wife deceased. During the investigation, a search warrant was obtained to recover information from the victim's cellular telephone. When reviewing information Your Affiant observed a message from Perez to wife dated August 18, 2014 which reads in part, “Jamie was looking at me like I was the one that fucking killed you”. In this message Perez writes, “I had the gauge in my mouth when my son came in the room screaming not to do it”. Your Affiant is aware that “gauge” is a common term for a shotgun, On Thursday, September 4%, 2014 Robert Perez agreed come to Denver Police Department Headquarters for an additional interview. Detective Bueno and Your Affiant conducted a second interview of Robert Perez. During the interview Perez said he had taken off the clothing he had wom to work and had only been wearing boxer shorts and a white t-shirt when he found his wife deceased, 6-¥3 Page 4 Mr. Perez had no explanation why gunshot residue would be found on the clothing he had removed prior to finding his wife. Mr, Perez said he had not handled or seen the shotgun they had in his house for several years and that he had not fired a gun since approximately 2008-2009. When confronted with own message about putting, “the gauge” in his mouth, he admitted being suicidal but claimed it was aftother firearm he put in his mouth. Mr. Perez agreed “gauge” is a term used to describe shotgun, but that he had made a mistake wien he wrote the text. ‘Mr. Perez continued to deny killing his wife. Pursuant to Rule 41 of the Colorado Revised Statutes, Your Affiant is respectfully requesting an Arrest Warrant for Robert Angel PEREZ, for Murder in the First Degree, 18-3-102, a Class 1 Felony; and to seal this Arrest Warrant from public release of the information herein contained due to the media coverage of this ease, to assure that this case is not compromised, and/or so that Jhtnesses mentioned fn this warrant ean be protected from any type of early reprisals, 0 that this investigation can continue. Your Affiant requests that the warrant be available for viewing by the Court determining probable cause and counsel for Robert Angel PEREZ. ‘affiem this information Yo be true and correct ‘Subscribed under oath before me on.
