and 1988, the First and Fourteenth Amendments to the United States Constitution and the
Jaws of the State of New York.
2. This claim arises in connection with a letter to Plaintiff New York City Couneil
Member Ydanis Rodriguez, dated July 22, 2010, from the Counsel Office of the
Committee on Standards and Ethics of the New York City Council, (hereinafter, “the
Committee”) stating that it will hold a “closed-door” hearing (“hereinafier, “the public
censure hearing”), excluding other Council members, the public and the media, on
whether Plaintiff Council Member Ydanis Rodriguez should be publicly censured for anallegation that he “poked” a central City Council staffer between the throat and upper
chest area ducing a budget discussion on June 25, 2010.
3. Plaintiff seeks an injunction requiring the Committee to hold the public censure
hearing ~ a quasi judicial proceeding scheduled for July 27, 2010 at 8:30 a.m. ~in public.
JURISDICTION
4. This action is brought pursuant to 28 USC §1331 and 42 USC §1983, Pendent
party jurisdiction and supplementary jurisdiction over plaintiffs’ state law claims are
asserted,

District of the City of New York.
7. Plaintiff Ana R. Cepin is a resident and registered voter in the Tenth Council
Distriet of the City of New York.
8. Plaintiff Augusto Payano is a resident and registered voter in the Tenth Council
District of the City of New York.
10. Defendant Committee on Standards and Ethics is a Standing Committee of the
New York City Council with subject matter jurisdiction over the Conflicts of Interest
Board and Council Ethies pursuant to City Couneil Rule 7.00.
11. Defendant Council member Inez Dickens is the Chair of the Committee. As such,
