RESIGNATION WITH
RELEASE WAIVER AND QUITCLAIM/UNDERTAKING

I, _______________ of legal age, hereby acknowledge my lawful cessation from

employment as employee of _______________. (collectively referred to as the
“Company”) on the basis of my resignation. Thus, I am hereby voluntarily and freely
tendering my irrevocable resignation from the Company. I further manifest and declare
that:
1. For the work I have done for the Company, I hereby receive and accept to my
full satisfaction the full payment of my separation pay, backpay, and thirteenth month pay
consisting of the following amounts:
a. FINANCIAL ASSISTANCE amounting to _______________;
b. THIRTEENTH MONTH PAY worth _______________ ; and,
c. FINAL SALARY for the period of _______________ worth
_______________.

2. I hereby acknowledge that the amounts of money stated above cover and
constitute the full and complete settlement of any and all amounts due me by reason of my
employment with and separation from the Company and/or any of its affiliates. I also
acknowledge that the Company’s act of providing me the aforesaid amount is neither an
admission nor acknowledgement by the Company of my and any of the Company’s project
employees or other employees’ entitlement to separation pay or retirement pay.

3. I hereby certify that I have no more claims against the Company and should
there be any that may arise now and in the future, I hereby waive and quitclaim any and
all possible claims and possible grievances that I have against the Company and its
directors.

4. I hereby state and confirm that I have already been paid all amounts
representing my salaries, backwages, 13th month pay, premium pay for holidays, rest days,
overtime pay, holiday pay, service incentive leave pay, allowances, and all other benefits
monetary or otherwise due me from the Company, its affiliates, stockholders, officers,
directors, agents and/or its employees, arising out of or in connection with my employment
with the Company..

5. In consideration of the foregoing payments, I hereby release, remise, waive,

and forever discharge the Company, its affiliates, stockholders, officers, directors, agents
and/or its employees from any and all action, whether civil, criminal, administrative or
otherwise, or from any claim of any kind or character on account of the termination or
cessation of my employment, or in connection with or arising out of my employment with
the Company

6. I likewise hereby remise, release, and forever discharge the Company, its
affiliates, the partners, stockholders, officers, directors, agents and/or employees of the
said entities from any and all manner of action, cause of action, sum of money, damages,
claims, and demands whatsoever in law or in equity which I had or now have against said
entities, their officers, or assigns, including the present case entitled as
_______________ docketed as _______________ pending before the
_______________.

7. In addition, I certify hereafter that none of my relatives and descendants

have no more claim, now and forever, against the Company and against any of their
directors, officers, employees, and their relatives and descendants.

 8. I likewise hereby undertake to keep the details of the aforementioned case,
the herein release waiver and quitclaim and final pay and my receipt of the herein financial
assistance from the Company confidential from any and all third parties, and undertake that
I will NOT do or perform any act or make any statement that may be prejudicial to the
Company.

9. Finally, I have read this document entitled Release Waiver and Quitclaim, and
fully understood every word of it and its meaning and have affixed my signature hereunder
voluntarily and freely with the full and complete knowledge of the meaning and intent of
this document and of my rights under existing laws.
