Chapter 1
The Next Step
Whether you are just thinking about getting a divorce, or have already committed yourself to actually doing it in the not too distant future, there is one inevitable truth: you will eventually be divorced. How well you get to that point, and how you financially and emotionally fare, depends upon many facts and circumstances; no two cases are exactly alike.
The next step, and perhaps one of the most important, is for you to determine what you really want to get out of the divorce. When asked this question most people say, I don’t know. What am I entitled to?
Imagine getting into a cab and, in response to the driver’s question, Where to?
you respond, I don’t know?
Just as you would not get into a cab without a destination in mind, you should not commence a divorce without knowing what you want and where you want to be when it is completed. Without direction and without goals, you will be lost.
Things to think about are: Do you want to keep the house? Do you want sole or joint parental responsibilities (formerly known as custody) of your children? Or, do you just want to get out of the marriage? These, and many others, are the questions you need to ask yourself because, if you do not know what it is you want—what is really important to you—it significantly impairs our ability to get you where you need to be. In the end, we are confident that we can help you achieve your goals, but only you can set them.
So, to begin, simply get a piece of paper and start creating a list. At the top, put the words: TO MY ATTORNEY.
This is an important step because, in a dissolution of marriage action (divorce case), both parties—the husband and the wife—are able to request free, full, and complete access to all relevant information from one another. This exchange of information is known as Discovery, which is covered more fully in Chapter 4. The one exception to this access is when a document has protection under what is known as the attorney-client privilege.
In other words, e-mails, notes, letters, and all other forms of communication between you and the lawyers at MKFM Law are considered confidential, and therefore non-discoverable by your spouse. If you are asking yourself, why this matters, imagine playing poker and letting your opponent see all of your cards!
