    Understanding Your HOA

    (Why do you need to understand your HOA?)

    Most homeowners who live in a homeowners association do not understand the role of an HOA. Then one day, after a homeowner paints their home, they get a letter from the HOA telling them that they painted their home the wrong color without permission and they must change it back to its original color!

    I have been working in the homeowner association industry for over ten years. During that time I have witnessed hundreds of examples of homeowners who do not understand the role of the community association. That lack of knowledge results in the homeowners doing something that breaks the rules of the association—without them even knowing that it was wrong. Their neighbors then see the wrongdoing and they criticize the homeowner which creates friction between the neighbors. The board of directors then notices the infraction of the rules and send a letter to the homeowner, and possibly a fine, for breaking the rules. Now the homeowner feels under attack and posts complaints on Facebook about the tyrannical board of directors acting like the HOA police and spoiling the joy of living in their neighborhood. And this pattern of not knowing the rules repeats itself over and over again in countless HOAs.

    A Homeowners Association is Good

    Put very simply, the role of a homeowners association is to pull together the resources and ingenuity of a large portion of the owners of the community to maintain the association’s common property, to provide a good quality of community life and to support a good financial investment for all residents. That’s a good thing!

    Probably the most important things that you should understand about living in an HOA are that a well-run HOA can provide wonderful community amenities, a quality neighborhood and programs to maintain the financial investment in your home.

    My definition of a homeowner who understands their HOA, would be a homeowner,

    •    Who has read their governing documents and has a basic understanding of the association’s rules—and that they must abide by these;

    •    Who has learned what common property is owned and maintained by the association and understands where that maintenance money comes from; and,

    •    Who attends some community meetings and activities and knows that he or she shares certain concerns and priorities with his or her neighbors and the leaders of the HOA.
