Policy Foundations of the Cebu City Ordinance No. 1764 DENR Department Administrative Order No. 30, Section 1 The Guidelines for the Transfer & Implementation of DENR Functions as Devolved to the Local Government Units

DENR Department Administrative Order No. 30, Section Management, protection, rehabilitation and maintenance of small watershed areas which are sources of legal water supply as identified or to be identified by the DENR and the enforcement of forest laws in community-based forestry project areas, small watershed areas and communal forests, have been devolved to the Local Government Units.

Policy Foundations of the Cebu City Ordinance No. 1764 Presidential Decree No.1067, Article 5. Otherwise, known as, The Water Code of the Philippines. Provides for the retention in urban areas of at least three (3) meters from the banks of rivers, streams and shores of the seas, and throughout their entire length, along their margins, are subject to the easement for public use in the interest of recreation, aesthetics, water sourcing, navigation, floatage, fishing and salvage have been blatantly violated.

Activities Conducted During This Period: Year 2000 Pulong-pulong sa Barangay especially for residents living near the river banks to inform, communicate and educate regarding the 3-meters easement law stipulated in the Cebu City Ordinance No. 1764. Rivers in focus were: Guadalupe and Buhisan Rivers Meetings Deputization of barangay volunteers as community organizers. Environmental Concert Dagayday sa Sapa, as an advocacy initiative to launch river awareness in Cebu City. ~ Held in Langub, Brgy. Guadalupe, Cebu City

Organizations Actively Involved are the following:


~ University of Cebu ~ Metropolitan Cebu Water District ~ Cebu City Barangay LGUs ~ Cebu City Government with Engr. Ubanan.

The Cebu River Eco-Park Commission, however, did not live long. The Cebu City Ordinance # 1764 was archived when the election season of 2001 was on its height. April 28, 2004 9th Sangguniang Panlungsod held its regular Council session and passed Resolution No. 04-3993 amending Cebu City Ordinance # 1764 to Cebu City Ordinance # 1997 and was carried on unanimously. May 12, 2004 Cebu City Ordinance # 1997 was signed by Hon. Mayor Tomas R. Osmea. Cebu City Ordinance No. 1997 authored by Hon. Nestor Archival.

Cebu City River Eco Park Management Commission CCREPMC The purposes enacting this ordinance are, as follows: Rehabilitation of the rivers & streams; restoration of biotic and aquatic resources; upliftment of living conditions of barangay residents living in the vicinity of these rivers and lakes. Development and implementation of a program to restore the indigenous biotic habitat;promotion of conservation programs. Cooperation and partnership between and among governmental agencies and NGOs and POs. To implement all laws, regulations and ordinances on environment. Sourcing and allocation of funds. Institutionalization of the CC-REPMC

Cebu City Rivers Management Council CCRMC Objectives for the enactment of the ordinance are, as follows: Organize a CCRMC composed of multisectoral reps of identified stakeholders.

Restoration of the riverbed gradient by building gabions and impounding dams. Implement erosion control measures.

No sand & gravel extraction in any part of the river except for supervised harvesting of silt and sand trapped in gabions. Strict implementation of garbage & solid waste dumping in the river. Strict control on point source pollution and waste water treatment.

The purposes enacting this ordinance are, as follows:

Objectives for the enactment of the ordinance are, as follows: Implementation of easement regulations all along river banks

Institution of barangay level management and monitoring groups for their respective sections of the river.
Initiate a complementary sanitation project of household water conservation and rainwater harvesting.

Created the CC-REPMC: Code named Bantay Sapa Commission of Cebu City under the office of the Mayor.
Composed of a chairman and 6 members representing governmental and non-governmental organizations.

The Commission in City Ordinance 1764 amended to Council and its Composition. Created CCRMC under the Office of the Mayor.

Secretariat which is under the Special Operation Officer III; with a full-time support staff. At least once a week or as often as the Chairman desires to convene the same, serving notice to the members at least one (1) day before the scheduled meeting. Presence of five (5) members including the presiding officer shall constitute a quorum for the transaction of business for the Commission. The Chairman and Members of the Commission, except the Program Director who serves as full time appointee of the City Mayor shall be entitled to a per diem of P250.00 each for every meeting actually attended but not to exceed P1,000.00 a month

Cebu City Ordinance No. 1997


Secretariat headed by an Executive Director to be assisted by a complement staff. Meeting:Shall meet regularly once a month. A special meeting may be called for by the Chairperson when necessary, serving notice to the members one (1) week before the scheduled meeting. The presence of 50% of Council members plus 1including the Presiding Officer shall constitute a quorum for the transaction of business for the Council. Chairperson and Members of the Council except for the Executive Director who serves as full time appointee of the City mayor shall be entitled an honorarium of P500.00 each for every meeting actually attended but not to exceed P1,000.00 a month.

Whereas, Cebu City has prided itself as a boom city, however the lack of water has loomed as a creeping crisis;
Whereas, in an integrated national and local development plan,

the importance of a viable water resource is essential for continuous economic growth, more so with a growing population;

Whereas, the persistent abuse and degradation of the watersheds, over-pumping from groundwater sources, organic and metal pollution in the rivers show a crisis already in progress; Whereas, the condition of the Guadalupe River and other rivers in the City of Cebu reflect the true picture of the economic and social health and, if not counteracted, will result in severe ecological and devastating consequences;

Whereas, an effective water resource and river rehabilitation as part of a political agenda is a key element to poverty eradication, health improvement, nutrition, protection of indispensable ecology, economic and social development; Whereas, there is an imperative need to amend City ordinance No 1764 in order to ensure that the technical studies for the rehabilitation of rivers in the City of Cebu as proposed by CUSW and other nongovernmental organizations (NGOs) can be properly implemented in stages;

Whereas, the principles of the Integrated Water Resources Management (IWRM) which is defined as a process of coordinated development and management of water, land and related resources within hydrological boundaries in order to optimize economic and social welfare, without compromising the sustainability of vital ecosystems shall likewise be adopted as a policy.

2001-2002 : Coordinative efforts with the Office of Councilor Nestor Archival and CUSW

2003 - 2004
: Conduct of the Guadalupe River Clean-up during the International Year of Freshwater, with CUSW taking the lead together with the Academe and other private sector, NGAs and other NGOs.

:The conduct of Solid Waste Management activities led by Lihok Pilipina Fdn., Inc. to minimize the disposal of garbage into the rivers; most especially into the Guadalupe River. The Buhisan river clean-up conducted by CUSW.

Initiatives undertaken while Cebu City Ordinance No. 1997 was in its amending stage

University of Cebu led by Sr. Sandra Clemente, RSCJ and the Metro Cebu

Environmental Initiatives Council conducted a Rapid Rural Appraisal of the Guadalupe River together with the barangay residents traversing along the river. University of Cebu & MCEIC conducted the Strategic Planning Workshop for the Guadalupe River. The Kitakyushu City and Cebu City governments with MCEIC conducted initial plans for the construction of a jokaso, which is a sewage treatment plan project. The jokaso project has to start off with a workshop on sewage treatment plant prior to the construction of said STP. The pilot area for the jokaso is located in Sambag II, the Balan Kapuna POs. The Dawn of the Activation of the Cebu City Ordinance No. 1997
November 2004 After a series of meetings for the Guadalupe River Strategic Planning, it was timely that UN-ESCAP had funds for a jokaso workshop. In a meeting held in the office of Hon. Nestor Archival, CUSW suggested that it might as well be an integrated workshop for the Guadalupe River which also includes the City Governments initiative on solid waste management and was carried on.

February 2- 4, 2005
: Kitakyushu Initiative Workshop on Wastewater and Solid Waste Management of Guadalupe River in Cebu City was conducted in Waterfront Cebu City Hotel. : Lead Agencies: UN-ESCAP; Cebu City Government City Planning Office; Kitakyushu City Government; IGES, MCEIC. PCAPI-7, CUSW; DENR-7; EMB7; IBP-7; WRC : A multi-sectoral future search conference to come up with a holistic and integrated management of Cebu Citys water resources with the river basin as a planning unit-the Guadalupe River. : Output was the formation of the Guadalupe River AdHoc Committee. : Another Output of the workshop is the action program of the Guadalupe River Rehabilitation and Revitalization Project.

Eventually the Ad Hoc will evolve into a Technical Working Group
