 The act of inquiring or of seeking
information by questioning.

 An official process to discover the facts


about something.

 Domestic investigation convened for the


purpose of collecting and recording
evidence to assist the authority in arriving
at a correct conclusion regarding any
subject on which it is necessary for him to
be informed.

 Inquiries are not opened to the public,
including members of the press unless
their presence has been expressly
sanctioned by the Nigerian Army Council.

 Civilians will not be admitted except

WHEN IS BOARD OF INQUIRY CONVENED?

 A Board of Inquiry will only be held on


matters of considerable importance.

 It can also be convened on a matter


already investigated by a regimental
inquiry.

The absence of over 21 days of a person
subject to military law.

Suspected Arson.

Loss of arms.

Loss or damage to public or service

 Loss of classified documents.

 The escape of an enemy prisoner of war.

 In peace time, when a personnel is
reported missing, for instance, a case
of kidnap.

 Casualty to an officer or soldier other


than by enemy action where:
o Injuries result in death.
o Injuries are likely to cause permanent
disability.
o Injuries may have been self-inflicted.

 There is loss or damage to public or
service property which could be
attributed to neglect or carelessness.

 There is the possibility of a substantial


claim against the military.

 There is conflict of evidence.

 Traffic accidents not dealt with by a


board of inquiry especially when the
driver was driving without authority or
off his authorized route.

 Injuries, other than by enemy action of
minor nature where there is doubt as to:
o The cause.

o Whether the injury arose through the

CONVENING OF INQUIRIES
 Section 172(1) of the Armed Forces Act.
“Subject to and in accordance with the
provisions of rules made under this part of
this Act (in this Act referred to as Board of
Inquiry Rules), the Forces Council or an
officer of a service of the Armed Forces
commanding a body of service personnel may
convene a board of inquiry of the Forces
Council or of that officer.”

 A Board of Inquiry would normally be


convened at Bde level and above by the
Comd.

 Regimental Inquiry would normally be


convened at Bn level and below by the
CO of the unit or detachment.

 Details of subjects for investigation.

 Appointment of board by name, that is,


president and members.

 Instructions for disposal of copies of

CONSTITUTION OF BOARD OF INQUIRY

 Section 172 (3) of the Armed Forces Act.

“A board of inquiry shall consist of a president


and such number of other persons as may be
provided for by the Board of Inquiry Rules, who
shall be persons subject to service law under
this Act, and the President of the board of
inquiry shall be an officer not below the rank of
Lieutenant or corresponding rank”

PROGRESS REPORT OF AN INQUIRY

 Progress reports will be rendered on all


cases, being investigated by a Board of
Inquiry (but not regimental inquiries).

 Six weeks after the occurrence has been


reported and at monthly intervals
thereafter.

PURPOSE:

 Bring to the notice of superior


commanders and administrative staff
officers an occurrence into which a board
of inquiry is being held.

 Ensure early consideration of any possible


disciplinary aspect.

PROGRESS REPORT OF AN INQUIRY

PURPOSE:

 Ensure that the AHQ DOA is informed early


of cases in which his advice may be
necessary.

 Ensure that the AHQ is notified of the


existence of any such case which cannot
be settled within a reasonable period of
which must in any case be referred
eventually to the AHQ.

FINDINGS OF AN INQUIRY

 An inquiry will set out facts which were


found to be proved. The findings should be
so framed as to include a clear and
concise précis of the case in easily
readable form.

RECOMMENDATIONS OF INQUIRY
 An inquiry is not expected by law to
recommend disciplinary action in its
report.

 It will, if required to do so by the


authority, record steps taken since the
occurrence of an incident to prevent a
recurrence, and make any
recommendation it thinks fit in order to
prevent such recurrence, but it will not
recommend disciplinary action.
