 This is the only way to encourage the
researchers.

 This is the only way to save the valuable results


of research from being wasted.

 This is the only way to enable human society to


uniformly enjoy the benefits of research
activities.

 This is the only way to create a research friendly


atmosphere in the world.
PATENT DRAFTING,
A MAJOR STEP:
 Disclosure of outcome of the research is a good news
for the humanity.

 The researcher validly expects a reward of his/her


hard work.

 To come forward for a legal protection proper disclosure


is required.

 Here comes the art of Patent Drafting.

 The disclosure has to meet the requirements of relevant


law en force in the country where the protection is required.
BETTER THE DRAFTING
STRONGER IS THE RIGHT:
 A Patent Specification has to systematically and clearly
disclose the invention or the improvement.

 It is the proper drafting which enables one to understand


where the inventive step lies.

 It is the statement of claims which establishes the legal


boundaries of the rights of the inventor.

 The drafting of a Patent Specification requires a pure


professional approach.

 Researchers / Scientists not being experts in such a


drafting, will learn from this Workshop.
 Researchers / Scientists must convert the outcome of
their activities in a write up and look for its legal
protection.
STATUS OF PATENT SYSTEM IN
PAKISTAN:
 Protection of invention through a patent right is
available in Pakistan since 1948.

 The law in force at present is Patent Ordinance


2000 (as amended in 2006)

 The law is elaborated by Patent Rules 2003.

 Pakistan is a member of WTO, the laws have


been amended accordingly
 Pakistan has also signed the TRIPS Agreement
and the relevant laws comply the requirement of
the agreement.

PAKISTAN COUNCIL OF

RESEARCH (PCSIR):
Brief History:

 PCSIR is the largest and premier R&D


organization of Pakistan under the
administrative control of Federal Ministry
of Science & Technology. It was
established in 1949, registered in 1953
under Societies Act and reconstituted
under Parliament Act XXX of 1973. PCSIR
has well equipped nation-wide network of
12 R&D Laboratories & 07 Technical
Training Institutes / Centres.
OBJECTIVES:
 Optimum utilization of indigenous raw material &
resource for the development of industrial processes.
 Development of technologies around local resources from
bench to pilot plant scale and technology transfer, for
industrial exploitation leading to import substitution and
export enhancement.
 To conduct R&D on the problems faced by the industrial
sector and extend test / analysis / calibration services to
users.

R&D organizations and industries on the projects of

ACCREDITATION TO ISO-17025 :

 PCSIR Laboratories Complex, Karachi has


the honour to be the first ISO-17025
accredited laboratory for testing and
analysis in Pakistan.

 The laboratory has been assessed and


accredited to ISO-17025 by the experts
from Norwegian Accreditation supported
by UNIDO and certificates have already
been awarded.

PATENT ADVISORY CELL :
 I am pleased to inform about
the Establishment of a Cell by
the Pakistan Council of
Scientific & Industrial
Research, with following
specific aims and objective:
 This is major step taken by
the council to share the
national responsibilities, to
take an active part to face
the fresh international
changes due to the decisions
of WTO and TRIPS Agreement
 This cell is providing every
possible facility to the
researchers / inventors
coming from any part of the
country to get a patent right.
OBJECTIVE :
 To establish Patent Advisory Cell for scientists, Engineers of
S&T / R&D Organizations and Institutions to acquire
national and foreign Patents for their
Processes/Technologies/Inventions.
 To encourage the Scientists/Technologists to carry out
scientific and technical research for filing patents of new
technologies and processes.
 To create awareness for socio-economic benefits to local
industries and technical dissemination of expertise to
Scientists/Engineers for filing and obtaining patent for their
processes/technologies/inventions under one window
operation.
 To promote national intrests in international efforts to
harmonize and simplify Patent law and it’s supporting rules
and procedure and stimulating innovation.
 To enhance the international competitiveness of industry
and commerce through promotions and awareness about
Patent Rights.

 Quality work to client’s satisfaction.
 Legal advisory services to ensure the best protection of inventions and
innovations.
 To provide services for maintenance of rights granted of register patents,
including Patents granted by foreign Patent Office under the joint patent
agencies like that PIPRO, WIPO etc.
 Help clients to obtain maximum value from their Intellectual property.
 IT personnel for searching and compilation of data base of Patents.
 Local and foreign attorneys to cover its operational function and legal
aspects.
 After grant of Patent, PAC provides consultancy for the commercialization
of Patent through PCSIR Laboratories Complex, Karachi.
EXPECTATIONS FROM THE
TRAINING:
 Being a scientist and researcher in the
field of
Pharmacology, I myself and my team has
made a number of valuable achievements.
 To draft a patent is certainly an art. I hope
that whatever I have learnt through
different sources will be polished.
 This will be an opportunity to share ideas
on various points with representatives of
different countries.
 Anything new and beneficial will be noted
to be adopted In Pakistan to improve the
