The
Comprehensive
Dangerous
Drugs Act of
2002
Declaration of Policy
It is the policy of the State to safeguard the integrity of its territory and the well-
being of its citizenry particularly the youth, from the harmful effects of dangerous
drugs on their physical and mental well-being, and to defend the same against acts
or omissions detrimental to their development and preservation. In view of the
foregoing, the State needs to enhance further the efficacy of the law against
dangerous drugs, it being one of today's more serious social ills.
Toward this end, the government shall pursue an intensive and unrelenting campaign
against the trafficking and use of dangerous drugs and other similar substances
through an integrated system of planning, implementation and enforcement of anti-
drug abuse policies, programs, and projects. The government shall however aim to
achieve a balance in the national drug control program so that people with legitimate
medical needs are not prevented from being treated with adequate amounts of
appropriate medications, which include the use of dangerous drugs.
It is further declared the policy of the State to provide effective mechanisms or
measures to re-integrate into society individuals who have fallen victims to drug
abuse or dangerous drug dependence through sustainable programs of treatment
and rehabilitation.

ON PENALTIES
• The penalties for violation of SPLs such as life imprisonment are
revived, and the nomenclatures of the RPC were deleted from the
law.
• The penalty is no loner based on quantity involved, except in the
case of possession, but even here the quantity involved is much
lower than in the old law, hence harsher.
• Use of dangerous drugs under Section 15 now has graduated
penalty.
• A person charged under any provision of the law regardless of the
imposable penalty cannot avail of the provision on plea
bargaining. On the other hand, the provision to avail of the

• Accessory penalties are imposed in the form of disqualification to
exercise civil and political rights and the same are suspended
during pendency of appeal from conviction.

• When a crime is committed by the offender under the influence of


drugs, a positive finding thereof shall be qualifying and the rules
under the RPC shall be followed. Thus, homicide becomes murder.

patent laxity, inexcusable negligence
USE AND POSSESSION OF DRUGS
SIMULTANEOUSLY

Section 15, Article II on use of dangerous drugs does not apply


when a person charged with its violation is also found to have
possession of such quantity of drugs, provided under Section 11 of
the same law. This means that the appellant may not be charged
separately of violation of Section 11 on illegal possession of
dangerous drugs and of Sex. 15 on use since it is clear from the said
provisions that Section 11 shall apply.

PROCEDURE UPON ARREST/APPREHENSION

PROCEDURE AFTER PROMULGATION OF JUDGEMENT


• STEP 1:Prosecutor shall inform PDEA of Termination of the Case;
• STEP 2:Prosecutor shall ask leave of Court turn over the said
representative sample/s to the PDEA for proper disposition and
destruction

Participation of Local Government Units
• Any place or premises which have been used on two or more
occasions as the site of the unlawful sale or delivery of
dangerous drugs may be declared to be a public nuisance, and
such nuisance may be abated, pursuant to the following
procedure
(1) Any city or municipality may, by ordinance, create and
administrative board to hear complaints regarding nuisances;
(2) Any employee, officer, or resident of the city or
municipality may bring a complaint before the Board after giving
not less than [3] days written notice of such complaint to the
owner of the place or premises at his last known address; and
• (3) After hearing in which the Board may consider any evidence,
including evidence of the general reputation of the place or
premises, and at which the owner of the premises shall have an
opportunity to present evidence in [his] defense, the Board may
declare the place or premises to be a public nuisance. (Sec. 52)
• If the Board declares a place or premises to be a public
nuisance, it may declare an order immediately prohibiting the
conduct, operation, or maintenance of any business or activity
on the premises which is conducive to such nuisance.
An order entered under this section shall expire after [1] year or
at such earlier time as stated in the order. The Board may bring a
complaint seeking a permanent injunction against any nuisance
described under this section. (Sec. 53)
Program for treatment and rehabilitation of
drug dependents
• A drug dependent or any person who violates section 15 of this
act may, by himself or through [his] parent, spouse, guardian or
relative within the fourth degree of consanguinity or affinity,
apply to the Board or its duly recognized representative, for
treatment and rehabilitation of the drug dependency.

(VSP) for treatment and rehabilitation of the drug dependency.
Upon such application, the Board shall bring forth the matter to
the court which shall order that the applicant be examined for
drug dependency. If the examination shows that he is a drug
dependent, he shall undergo treatment and rehabilitation for a
period of not less than [6] months. (Sec. 54) and be

Program (CSP). The confinement may either be through petition by
the Board with the RTC or by the prosecutor/court where the drug
dependent is charged with an offense punishable with a penalty less
than 6 years and 1 day. In such case, the court or the prosecutor
shall be suspend all further proceedings at any stage and transmit
copies of the record of the case to the Board. (Sec. 62)
• Occasional “use” of dangerous drug, is not the same as
