Engineering ethics is a set of ethical standards for engineers


to follow which can apply to most circumstances that arisen
on the job. These standards may vary depending on the
jurisdiction or discipline at hand. These ethical standards
are engineer’s obligations towards the public, employers
and the profession.

GUIDING PRINCIPLES

• In the absence of prescribed norm of behavior for an


engineer, he should be guided by the highest principle of
honor, justice and courtesy. As members of this
profession, engineers are expected to exhibit the highest
standards of honesty and integrity. Engineering has a
direct and vital impact on the quality of life for all people.

An engineer should assist the public to arrive at a

2. Avoidance of rendering opinions in public on


unverified engineering matters
An engineer should refrain from rendering opinions
in public on technical engineering matters if not positively
certain of its veracity since this may create complications or

3. Guard against public health and safety


Engineering work includes accidents costing the
lives and limbs not only by the workers but also strangers
who may or may not have connections thereto due to the
deleterious operations and the prevailing conditions therein.
Engineers must be an advocate of preventive and curative
measure for the safety of everybody.

Loyalty to the profession is a must and should

3. Merits not due


Recognition in the field of engineering is feat that
costs the engineer’s time effort and money. It is unethical
for an engineer to claim credit which is not due him.

4. Review of colleague's work


The engineer should not make or issue publicly
undesirable comments or opinion regarding the work of a
colleague except to save the public and the profession from
harm or injury, but the comments must be done through an
informal arrangement before an open review of his work.

5. Controversies with colleague


In the struggle to attain a worthy professional
reputation an engineer may innocently step on the toe or
run across the path of another trying also to carve a name
for his career. As much as possible care must be observed

6. Solicitation of undertakings or client
Solicitation takes place when an engineer
resorts to undesirable practices like underbidding
for particular work, or reduce the normal charges
or fees after becoming aware of the charges
proffered by the other in order to assure himself of
the job or capture the client of another.

7. Signing plans and specifications


The preparation of plans and specifications for an
engineering work is a delicate task which should be done
solely by a registered engineer or one who has been
previously authorized by law. The engineer should not
allow his signature to be used in such documents that was
not prepared by him or under his control or direction.

GENERAL CONSIDERATION

Clients engaged engineers for his domestic and


industrial needs because he believed that engineers’
technical expertise creates in their mind a belief that they
can buy their health and safety from him. Thus, government
imposed a certain liability for the consequences of his
engineering works during and after the conclusion of his
task.

CIVIL LIABILITY FOR DAMAGES

The Civil Code of the Philippines (Republic Act 386)


Article 1723 stated that:
The engineers of architect who draws up the plan
and specifications for a building is liable for damages if
within fifteen years from the completion of the structure. If
the structures collapse by reason of defect in those plans
and specifications or due to the defects of the ground.

The Civil Code of the Philippines (Republic Act 386)


Article 1723 stated that:
The contractor is likewise responsible for the
damages if the edifice falls within the same period on
account of defects in construction or the use of materials of
inferior quality or due to any violation of the terms of the
contract.

The Civil Code of the Philippines (Republic Act 386)

construction, he shall be solidarily liable with the
contractor.

REQUIREMENTS FOR ACTION TO PROSPER

For an action against the engineer or architect to prosper, it


must be proven that:
a) The collapse of the building took place within fifteen years
from its completion
b) The plan and specifications was drawn by the
engineer/architect
c) The cause is defects of the plan and specification or defect of
the ground

WARRANTY AND PRESCRIPTION

The law further provides that acceptance of the building


after completion does not imply a waiver of any of the
