Harassment by definition is to irritate or torment
persistently or to wear out and exhaust

What is the difference between sexual
harassment and sexual assault ?
• Sexual harassment is a broad term including
many types of verbal and sexual attention, sexual
assault refers to sexual contact or behavior, often
physical ,that occurs without the consent of
victim .Some forms of sexual assault include.
– Penetration of victim’s body ,also known as rape
– Attempted rape
– Fondling and unwanted sexual touching
– Forcing a victim to perform sexual act ,such as oral sex
or penetration of the perpetrator’s body
Sexual Harassment Facts:
• The victim as well as the harasser may be a
woman or a man
• The harasser can be the victim’s supervisor ,an
agent of the employer ,supervisor in an another
area,co-worker ,or a non-employee
• The victim does not have to be the person
harassed but could be anyone affected by the
offensive conduct
TYPES OF SEXUAL HARASSMENT:
• Sexual harassment broadly of two types ;
– “Quid pro Quo”
– “Hostile environment”
• Quid pro Quo:
– A Latin phrase which means “something for
something” or “that for this” which involves
damanding sexual favours in exchange for a
benefit or to avoid punishment in the work place
– Hiring, promotion,awards,transfers,or disciplinary
action
“Quid pro Quo”
• Typical examples:
– A supervisor coerces as employee into sexual
relationship and then rewards the employee with
a promotion
– A supervisor takes disciplinary action or denies a
promotion to an employee because he or she
rejected sexual advances from the supervisor
– Not only working places but also a place where a
lower authority request for his work to her higher
authority
Hostile Environment :
• Occurs when unwelcome sexual conduct
unreasonably interfers with an individual’s job
performance or creates an intimidating,
hostile or offensive working environment .
• This form of harassment, whether engaged in
by a manager or an employee can constitute
discrimination, even if there are no tangible
economic job consequences.
“Hostile environment”
• Displaying “pinup” calendars or sexually
demanding pictures
• Making sexually oriented jokes or offensive
remarks;
• Subjecting another employee to unwelcome
sexual advances or touching
• Anyone in the work place may create a hostile
environment like
– Supervisor
– Co-worker
– Non-employee

What can I do when I witness sexual
harassment?
• You may heard the term bystander intervention to
describe stepping in to help if you see someone who
might be in danger or at risk for sexual assault Bystander
intervention can also be a helpful strategy if you
witness sexual harassment. You don’t have to be a hero
to make impact in someone’s life , and you can
intervene in a way that fit in your comfort level
and is appropriate for the situation.If you choose
to step in you may able to give the person being
harassed a chance to get to safe place or leave
the situation .
• Below are some of steps you can take in this
situation
– Create a distraction: DO what you can do interrupt the harassment
,or to distract those taking parrt in harassment .But remember to make
sure that you aren’t putting yourself in danger by doing this . if
someone seems like they could become violent, do not draw their
attention .
– Ask directly: Talk directly with the person who is being harassed .If
they are being harassed at work or school ,offer to
accompany them anytime they have to meet with the
harasser .If a friend is worried about walking alone to their
car at night,offer to walk them.
• Refer to an authority: The safest way to intervene for
both you and the person being harassed may be to bring
in an authority figure. You c an talk to another
employee,security gaud, RA in your dorm,bartender, or
bouncer, and they often willing to step in .
• Enlist others: It can be hard to step alone,especially if you
are worried about your own safety or if you don’t think
you will able to help on your own. It may be a good idea
to enlist the help of a friend or any bystander.

Major two steps taken by India Govt
against sexual harassment:
• Vishaka guidelines, 1997
– Physical contact and advances; a demand or request for
sexual favours ; sexually coloured remarks; showing
pornography; and any other unwelcome physical verbal or
non-verbal conduct of sexual nature
– It even detailed the requirements of an institutional
complaints mechanism for workplaces to deal with
these complaints, but without a functioning
legislative framework, employers clearly felt less
compelled to abide by these guidelines.
2nd act by India Govt:
• Sexual Harassment of Women at Workplace
(Prevention, Prohibition, and Redressal) ACT
– The Government has enacted the Sexual Harassment of Women at
Workplace (Prevention, Prohibition and Redressal) Act, 2013 to
provide a safe and secure environment to women at the workplace.
The Ministry of Women and Child Development had issued
advisories to all States/UTs Government on 23rd December, 2013 and
27th October, 2014 to ensure effective implementation of theAct .
