1. A person (Citizen/not) whose country has
reciprocity with the Philippines in the
practice of teaching.
2.18 years of age and in good health and

an offense involving moral turpitude.

recognized by the government and has
minimum educational qualifications.
 The registration of a professional
teacher commences from the date
his name was enrolled in a roster
of professional teacher.
OATH BEFORE PRACTICE:

 Every registrant shall be required


to take his professional oath
before practicing as a professional
teacher
Teachers who pass the merit examination
shall:
1. Be awarded a diploma of merit by the
Board
2. Earn merit points for purposes of
promotion in salary or to a higher
position or grade level.
3. Be placed in the priority list for
government scholarship
4. Enjoy such other benefits
 The teaching profession shall be
integrated into one national
organization which shall be
recognized by the Board and the
Commission as the one and only
integrated and accredited
association of professional
teachers.
1. Conviction for any criminal offense
by a court of competent jurisdiction.

2.Immoral, unprofessional or
dishonorable conduct

3. Declaration by a court of
competent jurisdiction for being
mentally unsound or insane.
4. Malpractice, gross incompetence, gross
negligence or serious ignorance of the
practice of the teaching profession

5. The use of perpetration of any fraud or


deceit in obtaining a certificate of
registration, professional license or
special/ temporary permit.

6. Chronic inebriety or habitual use of


drugs
 No practice or offer to practice the
teaching profession in the Philippines
or be appointed as teacher to any
position calling for a teaching
profession without having previously
obtained a valid certificate of
registration and a valid professional
license from the Commission
 If a person is practicing as a
professional teacher without a valid
certificate of registration or valid
license.
 He shall not be fined with not less
than Php 5,000- Php 20,000.00
 Or imprisonment of not less than 6
months to 5 years.

government units and technical-
vocational institutions in the
skills development of the
country's human resources
 PROVIDING FOR THE
PROFESSIONALIZATION OF
TEACHERS, REGULATING THEIR
PRACTICE IN THE PHILIPPINES
AND FOR OTHER PURPOSES.
 All educational institutions
shall be under the supervision
of; and subject to regulation
by, the State
 Ferdinand E. Marcos
QUALIFICATIONS REQUIREMENTS OF
APPLICANTS:

No applicant shall be admitted to take


the examination unless, on the date of
the filling of the application, he should
have complied on the following
requirements:
A graduate of college, school or
university recognized by the government
and possesses the minimum educational
qualification as follows:

1. For teachers in pre school.


2. For teachers in elementary grades

3. For teachers in the secondary grades

4. For a teachers or a vocational or 2-


year technical courses.
 Section 26 Registration and
Exception:

No person shall engage in teaching and


or as professional teacher, whether in
the preschool, elementary, secondary
level unless a person is duly registered
professional teacher and a holder of
valid special or temporary permit
 Upon approval of the application and
payment of the prescribed fees, the
certificate of registration and professional
license as a professional teacher shall be
issued without examination as required in
this Act to a qualified applicant who is:

a. A holder of a certificate of eligibility as a


teacher issued by the Civil Service
Commission and the DECS
b. A registered professional teacher with the
National Board for Teachers under the
DECS pursuant to P.D. no. 0016.
 Professional teacher who have not practiced
their profession for the past 5 years shall take
at least units of pedagogy and 6 units of
content course or the equivalent training and
number of hours.
 Those who have failed the licensure
examination for the professional teachers,
with a rating of not lower than 5% points from
the passing general average rating shall be
eligible
 The para- teacher shall be assigned to areas
where there is a shortage or absence
 Special permits, with a validity of 3
and 5 years, issued to para- teachers
by the Board for Professional Teachers
before the effectivity of this Act shall
be allowed to expire based on the
period granted therein; Provided, that
only special permit with a validity of 3
years may be renewed upon expiration
for a non- extendible period of 2
years.
 Act shall be known as the “Magna
Carta for Public School Teachers”

 Shall apply to all public school


teachers except those in the
professional staff of state colleges
and universities
 A person who has adequate
training and professional preparation
recognized by the government
 it is necessary to employ as teacher a
person who possesses the minimum
educational qualification
 Except for a cause provided, no teacher
shall be transferred without his consent
from one station to another.

 Where exigencies of the service require the


transfer of a teacher from one station to
another, such transfer may be affected by
the school superintendent who shall
previously notify the teacher.
 If the teacher believes there is no
justification for the transfer.
 There is no transfer whatever shall be
made three months before any local or
national election.
 Necessary transfer expenses of the teacher
and his family shall be paid for by the
Government if his transfer is finally
approved.
The right to:
 be informed, in writing, of the charges
 full access to the evidence in the case
 defend himself and to be defended by a
representative of his choice and/or by his
organization, adequate time being given to
the teacher for the preparation of his
defense
 appeal to clearly designated authorities
 Administrative charges against a teacher
shall be heard initially by a committee.
 The committee shall submit its findings
and recommendations to the Director of
Public Schools within 30 days .
 School superintendent is the complainant
or an interested party, all members of the
committee shall be appointed by the
Secretary of Education.
 No Discrimination
 Married Teachers
 Academic Freedom
 Co- curricula and out of school
activities and any other activities outside
of what is defined as normal duties of
any teacher shall be paid an additional
compensation of at least 25% of his
regular remuneration after the teacher
has completed at least 6 hours of actual
classroom teaching a day.
 In the case of other teachers or school
officials not engaged in actual classroom
instruction.
Any teacher engaged in actual
classroom instruction shall not be
required to render more than 6 hours
of actual classroom teaching a day

In areas where teachers are


exposed to, they shall be
compensated to this equivalent to
25% of their monthly salary.
No person shall make any deduction
whatsoever from the salaries of teachers
except under specific authority of law
authorizing such deductions.
MEDICAL EXAMINATION AND TREATMENT
COMPULSORY:

Medical examination shall be provided free of


charge for all teachers before they take ups
teaching and shall be repeated not less than once
a year during the teacher’s professional life.
 Teachers shall be protected against
the consequences of employment
injuries.
 The effects of their physical and
nervous strain on teacher’s health
shall be recognized

 Refusal to grant sexual favor results in
limiting, segregating or classifying employees
which in a way discriminate, deprive or
diminish employment opportunities or
otherwise adversely affect.
 Against one who is under the care,
custody or supervision of the offender

 Against one whose education,


training, apprenticeship or tutorship is
entrusted to the offender
 in the premise of the workplace or
office or of the school or training
institution.
 In any place where the parties were
found as a result of work or training
responsibilities or relations
 at work or education or training-
related social functions
PHYSICAL:

 gestures with lewd insinuation

 requests or demand for sexual favors

 use of objects, pictures or graphics, letters

GRAVE OFFENSES:
o unwanted touching of private parts of the
body ( genetallia, buttocks and breast)

LESS GRAVE OFFENSES


o unwanted touching or brushing against a
victim’s body

LIGHT OFFENSES
o surreptitiously looking or staring of a
persons private part or worn
undergarments
 Any persons who violates the provisions upon
conviction be penalized by imprisonment or
not less than 1 month nor more than 6
months or a fine of not less than Php
10,000.00 nor more than Php 20,000.00 or
both such fine and imprisonment at the
discretion of the court
 Any action from the violation of the provision
of this Act shall prescribe in 3 years

Who are deemed to be children
exploited in prostitution and other
sexual abuse?
 children whether male or female
 who for money, profit or other
consideration or due to coercion or
influence of adult, syndicate or group
 indulge in sexual intercourse or
lascivious conduct
 Intentional touching either directly or tru
clothing of the genetallia, anus, groin, breast,
inner thighs or buttocks or any act of
lewdness

 done with force or intimidation, fraudulent


machination or grave abuse of the authority
or where the offended party is deprived of
reason or otherwise unconscious
WHO ARE LIABLE:

1. Acting as a procurer of a child prostitute


2. inducing a person to be a client of a child
to be prostitute
3. taking advantage of influence or
relationship to procure a child as
prostitute
4. threatening or using violence towards a
child to engage him as a prostitute
 Any person not being relative to a child is
found alone with the said child inside the
room or cubicle of a house, an inn, hotel,
motel, pension house, apartelle or other
similar establishment, vessel, vehicle or any
other hidden or secluded area which would
lead a reasonable person to believe that the
child is about to be exploited in prostitution
and other sexual abuse
PENALTY:

 those who commit the act of sexual
intercourse or lascivious conduct with a child
exploited in a prostitution or subjected to
other abuse
 those who derived profit or advantage as
manager or owner where the prostitution

1. Hire, employ, perform, pose as model:
obscene exhibitions, live or indecent shows
in video, obscene publications pornographic
materials
2. person persuade child, induce, sell coerce,
distribute pornographic materials
3. any ascendant, guardian or person
entrusted in any capacity with care of a child
who shall cause and/or allow such child to
be employed or participate in obscene play,
scene, act, movie or show
 any person who shall keep or have his
company a minor, 12 years or under or who
is 10 years more or his junior in any public or
private place, hotel, motel, beach, bar other
tourist resort and others.
 any person, manager, owner or one trusted
with the operation of any public or private
place of accommodation who allows any
person to take along with him or places any
minor
 When the victim is under 12 years
old, the penalties for murder,
homicide, other intentional mutilation,
serious physical injuries: Reclusion

lasciviousness with consent,
corruption of minors, white slave
trade: One Degree higher than that of
