Cyberspace
• Cyberspace can be defined as an intricate environment that involves
interactions between people, software, and services. It is maintained
by the worldwide distribution of information and communication
technology devices and networks.
• The cyberspace is anticipated to become even more complex in the
upcoming years, with the increase in networks and devices connected
to it.
Cyber security
• Cybersecurity denotes the technologies and procedures intended to
safeguard computers, networks, and data from unlawful admittance,
weaknesses, and attacks transported through the Internet by cyber
delinquents.
• Various Standards and laws are proposed with the aim to protect the
public and private infrastructure from cyber-attacks.
• The Ministry of Communication and Information Technology under
the government of India provides a strategy outline called the
National Cybersecurity Policy.
Cyber Crime
• Crime committed using compute and internet is cyber crime.
• 2 types of evidences in Cyber Crimes:
• A) Victim Computer/Network
• B) Attacker Computer/Network
• Traditional Theft − A thief breaks into Ram’s house and steals an
object kept in the house.
• Hacking − A Cyber Criminal/Hacker sitting in his own house, through
his computer, hacks the computer of Ram and steals the data saved in
Ram’s computer without physically touching the computer or
entering in Ram’s house.
Need for Cyber Law
• In today’s techno-savvy environment, the world is becoming more
and more digitally sophisticated and so are the crimes.
• Internet was initially developed as a research and information
sharing tool and was in an unregulated manner.
• As the time passed by it became more transactional with e-business,
e-commerce, e-governance and e-procurement etc.
• All legal issues related to internet crime are dealt with through cyber
laws. As the number of internet users is on the rise, the need for
cyber laws and their application has also gathered great momentum.
Cyber laws Objective
• To safeguard information and information infrastructure in
cyberspace.
• To build capabilities to prevent and respond to cyber threats.
• To reduce vulnerabilities and minimize damage from cyber incidents
through a combination of institutional structures, people, processes,
technology, and cooperation.
Cyber Laws in India
• In India, cyber laws are contained in the Information Technology Act,
2000 (“IT Act”) which came into force on October 17, 2000.
• The main purpose of the Act is to provide legal recognition to
electronic commerce and to facilitate filing of electronic records with
the Government.
• Jurisdiction is the important challenge in Cyber Laws. IT Act 2000 is
applicable for cyber crimes commited within the country. It doess not
applied to the attacker outside INDIA.
