Defeating the real purpose of punishment


Recidivism Rate
• Recidivism in a simple term is the relapse, of the ex-convict to commit
crime even after the conviction
• Showed that the conviction taught one nothing
• Some developed countries suffered recidivism as high as 30-40%
• Malaysia is one of the countries with low recidivism rate, of 7.8%, up
to 9%.
• Reasons for recidivism:
• Life circumstances after conviction
OR
• Being a more skilled criminal after conviction
High Expenses
• One inmate requires RM35, in daily basis.
• The government paid million for the maintenance of the inmates all
over the countries, with around 35 prisons all together, PER ANNUM.
• Correctional Centre require less
• Similar to community based rehabilitation centre, as a new approach.
Defeating the purpose
• The very purpose of punishment is to keep the offender from further
committing the crime as well as to keep the public safe and secured.
• Prison did nothing to serve the purpose.
• Mental and physical health of the inmates are deteroriated
• Mental health;
• Receive no attention from the public, kept away from family and friends
• Long conviction deter the offender from get along well with the society after serving the
sentence
• Most inmates receive no visits from family
• Kept within the barriers.
• Physical health;
• The spreading of infectious diseases,
• HIV through male-to-male sexual activities and sharing needles.
THE NEED FOR REFORMATION
• Holistic Approach
• THE INDIAN MODEL
• Revising the current system, let the punishment be more reasonable. Punishment shall
not correspond to the crime committed.
• THE UNITED STATES OF AMERICA
• The contribution of the public
• The contract between the criminal and the Reparative Board in serving the sentence, the
offender gets his lesson, being able to give back to the public and to keep the society in
peace and order
• The community services and communal based justice system.
• Counselling sessions, advisory board, and practices closer to the offender himself
• Being able to instill the awareness among the public as well, especially the children
Malaysian’s Reformation
• To keep what’s good, eliminate what’s not
• The activities for the inmates to keep themselves sane and healthy during the
sentencing process.
• Producing their own labeled products to be sold to the markets
• Community bases correctional system
• Putting away abusive punishment (The right of the inmates)
• Religious approach
• Not to isolate these offenders away from their families
• Long conviction is only for those who waited for the punishments
• Punishment itself need to be swift and severe, not long and abusive.
CONCLUSION
• The need to change is apparent
• The need is dire
• Awareness among public must first be prioritize
• The legislator need to open up to the public and take necessary steps
to improve the current system
• Traditions and former practice need to be changed for the better
• The society has yet prepared for massive reformation
• The reformation need to be in stages, to maintain the efficiency
