COURSE OBJECTIVES

To promote consultation and cooperation between


management and workers in upgrading safety and
health at work

To provide a two-way communication channel for


dissemination of information on safety and health
issues

To enhance interest and motivation of all groups of


management and workers at place of work in safety
and health

SECTION 30 (1)1
Every employer shall establish a safety and
health committee at the place of work in
accordance with this section if :
there are forty or more persons employed at
the place of work
or.
the Director General directs the establishment
of such a committee at the place of work,

CONDUCT OF MEETING
Committee needs to formulate own meeting
procedures and terms of reference

Frequency of meetings
Depends on nature of risks at workplace
At least once a month for high risk workplace
Once in three month for other workplaces
More frequent meetings during initial period of formation

Half of total number of members

Agenda and minutes


Early circulation of agenda and discussion papers
Minutes circulated soon, not later than two weeks after

CONDUCT OF MEETING
Immediate meeting shall be held for :
loss of life
serious bodily injury
a near miss accident
a dangerous occurrence or any other situation
which calls for immediate attention

Permit every member to attend meeting


during working hours

INAUGURAL MEETING
Employer to hold an inaugural meeting to declare his OSH
policies, plans and proposal to establish a safe and healthy
working condition
Employer may appoint his authorised manager to chair
meeting in his absence except the above

Perform immediate investigation of accidents and
recommend corrective measures

officer, enforcement officers, etc

INVESTIGATION OF
COMPLAINT
Employer to provide and maintain a system of communication to
enable any of his employees to make a complaint on safety and health

Employer upon receipt of such complaint shall take immediate


measure to rectify

If no action, employee can make similar complaint or the employer


may refer to SH Committee

SHC investigate and prepare a report and make recommendation to


the employer

RESOLUTION OF
COMPLAINT
Employer to implement above recommendations

If unable, convey his reason to SHC

If SHC disagree, can request D.G DOSH to undertake an


inspection to resolve the matter

D.G needs in duplicate :


inspection/investigation report
recommendations of SHC
any other documentary or material evidence pertaining
to the complaint

PROVISION OF TRAINING AND
INFORMATION
(REG. 28 & 29)

REG.28 - An employer of a place of work shall take such


steps as are necessary to ensure that members of the
safety and health committees have a basic
understanding and knowledge of the functions of the
committee under the Act.

REG.29 - An employer shall take such steps as are


reasonably practicable to provide the members of a safety
and health committee adequate TRAINING in
Occupational Safety and Health so as to enable them to
perform the functions of the committee effectively.

Joint management -worker committee at each
workplace
Company may form other committee to
supplement work of joint committee, such as :
management committee to oversee work of joint
committee
sub-committees (permanent or adhoc)
Must have clear communication channel between
joint committee and other committees
Penalty RM 5,000 or 6 months imprisonment or both

QUESTIONER FOR ENSURING AN
EFFECTIVE COMMITTEE

The committee needs to develop some way of determining


how effective it is being. It can set aside time once or twice a
year to answer these questions:

Are committee meetings adequately chaired?


Are agendas prepared and distributed well in advance of
each meeting?
Do all committee members regularly contribute agenda
items for discussion at meetings? Do these reflect members
consultation with their constituents?
Are meetings held regularly?
Are meetings often postponed?

GROUP EXERCISE
Break into 4 or 5 group.

Your Company has the following OSH problems:

- No written Safety and Health Policy


- Safety Committee was formed ten months ago but no meeting, no functions etc
- Number of accidents involving machines, poor housekeeping, mishandling of forklift,
horseplay, not wearing PPE and one incident of fire in the warehouse.
- No Safety and Health Manual
- No Safety and Health Handbook

N.O.P (Notice of Prohibition) was issued by DOSH during their last visit and your factory now stop
operation.

Your Committee is required to make recommendations to your employer to resolve the above critical
situations. Your may appeal to DOSH.
