Republic Act No. 7659
An Act to impose the death penalty on certain
heinous crimes, amending for that purose the
Revised Penal Laws, as amended, other Special
Penal Laws, and for other purposes
SECTION 3 Piracy and Mutiny on the high
seas or in the Philippine waters.

Art. 122 . Piracy in general and mutiny on

the high seas or in the Philippine waters.The penalty of reclusion perpetua shall be
inflcted upon any person who, on the high
seas, or in Philippine waters , shall attack or
seize a vessel or, not being a member of its
complement nor a passenger, shall seize the
whole or part of the cargo of said vessel, its
equipment or passengers.

The same penalty shall be inflicted in case of


mutiny on the high seas or in the Philippine
water.
Art. 123. Qualified Piracy. The penalty of

reclusion perpetua to death shall be imposed


upon those who commit any of the crimes
referred to in the preceding article, under any
of the following circumstances:

1. Whenever they have seized a

vessel by boarding or firing upon the


same;
2.

Whenever the pirates have


abandoned their victims without
means of saving themselves or;

3.

Whenever
the
crime
is
accompanied by murder, homicide,
physical injuries or rape.

Practice for the investigation
of the Crimes of Piracy and
Armed
Robbery
against
Ships, determines that armed
robbery against ships consists of
any of the following acts:

Any

illegal act of violence or


detention or any act of depredation,
or threat thereof, other than an act
of piracy, committed for private ends
and directed against a ship or
against persons or property on board
such a ship, within a States internal
waters, archipelagic waters and
territorial sea;

Any act of inciting or of intentionally

facilitating an act described above.

Sea Jacking
Manila, Philippines At least three people were

killed, one missing and another one wounded


after robbers sea jacked a passenger boat off the
coast of Quezon province early Monday morning
(March 17, 2008), coast guard official said.
Lieutenant Joel Ogorida, station commander at
the Real, Quezon Coast Guard, identified the
fatalities as Angel Zenarosa, Daniel de Leon and
Linda Broza, who were sailing back to their
hometown after selling copra in neighbiring
Mauban town.

A fourth victim, Jeniel Bantilan, was wounded in

the incident and remained missing after jumping


off the boat, Ogorida told in a phone interview.
Also on board were Eric Ambas, Renato Nieva,
Ace Laurin Nieva and Azelita Nieva.
Coast guard officials could not immediately tell if
the assailants were able to cart away money and
valuables from the victims.
Initial investigation showed that prior to setting
sail at about 1 a.m. , the victims were approached
at the Mauban shore by the two robbers, who
posed as visitors wanting to attend a feast in
Polillo.

Around 2:30 a.m. , the robbers declared a

holdup while off Infanta and Real. The two


assaulted the victims before escaping in
another boat being operated by a third
accomplice.
While Coast Guard officials are still searching

for the missing victim, a follow-up


investigation by the local police is also
underway to identify and capture the three
suspects.
