Kristin Bain v Metropolitan Mortgage Group, Inc, Indymac Bank, Mortgage Electronics Registration Systems, et al 8-16-2012 The Supreme Court of the state of Washington is saying that anybody other than the note holder cannot foreclose. And that applies, too, to so-called "servicers" usually (bailed out and insolvent, zombie) banks that collect mortgage payments on behalf of the note holders, and often handle foreclosures too.
