After court ruling, focus turns to state plans for Medicaid

Now that the Supreme Court has upheld the constitutionality of President Obamas health care reform law, advocates are pushing for additional efforts to extend coverage of the law to LGBT people and people with HIV/AIDS to the fullest extent possible. For the most part, the next step in the process involves looking to the states to determine whether they will adopt health policies afforded to them under the law foremost among them is the Medicaid expansion to cover all people with incomes up to 133 percent of the federal poverty level. Although the Supreme Court ruled the majority of the health care law is constitutional, it prevented the federal government from withholding all Medicaid funds from states if they decline to take part in the Medicaid expansion. As a result, states can decide whether or not to enter the expansion without fear of losing money. Patrick Paschall, a policy advocate at the National Gay & Lesbian Task Force, said the Medicaid expansion is particularly important for LGBT people because they disproportionately live below the poverty level. The Medicaid expansions are going to end up being hugely important for LGBT people because it expands coverage to low-income people, and LGBT people are disproportionately low-income, Paschall said. Anderson Cooper, the popular CNN journalist and talk show host, disclosed publicly for the rst time on Monday that hes gay, ending years of speculation by the public and prodding by gay activists that he come out. The fact is, Im gay, always have been, always will be, and I couldnt be any more happy, comfortable with myself, and proud, Cooper wrote in a statement published Monday in The Daily Beast. Gay conservative advocate and commentator Andrew Sullivan posted Coopers statement in his regularly published column The Dish, on the site. Sullivan explained in his column that he invited Cooper to comment on an article published last week in Entertainment Weekly, which reported how the public reaction to gay people in public life who come out has become less of a big deal than in past years. Andrew, as you know, the issue you raise is one that Ive thought about for years, Cooper wrote in an email to Sullivan, which he gave Sullivan permission to publish. DCRCs platform comes roughly two months before the Republican National Convention in Tampa. Presumptive GOP presidential nominee Mitt Romney has repeatedly emphasized on the campaign trail his support for a federal constitutional amendment that would dene marriage as between a man and a woman. LGBT activists have also criticized the former Massachusetts governor for what they describe as inconsistent positions on the repeal of Dont Ask, Dont Tell, the Employment Non-Discrimination Act and other issues. Kabel described marriage rights for same-sex couples as not a huge issue for Republicans in this presidential election cycle. He conceded that some social conservatives will insist that the GOP include opposition to nuptials for gays and lesbians in its 2012 platform. Kabel stressed, however, that the DCRC plank could temper anti-LGBT attitudes within the national Republican Party. It will have a moderating impact, he said.

Calif. man walks across country for LGBT rights

A California man who walked across the country to raise awareness of LGBT rights stressed on June 29 that more needs to be done to protect Americans on the basis of sexual orientation and gender identity and expression. The opposition to our equality I think to a large part is dying off, Richard Noble told the Blade while he was in D.C. He visited the U.S. Supreme Court on the day the justices narrowly upheld President Obamas health care reform law and attended a screening of Bully at the Department of Education and a Dupont Circle vigil for a lesbian couple who were shot in a Texas park last month while he was in the nations capital. Those who do oppose [our equality] and ght it need to be given a little more strong arm consequences and pay for suffering. It must be very clear we must not tolerate attacks or discrimination in America. Were over it. I think were all over it. Noble began his 2,700-mile trek in San Francisco in March 2011, and ended last month in Jacksonville, Fla., with his dog Trinity, which he adopted in Texas. Noble, who made a point to carry the rainbow ag from coast to coast, stressed that the spate of LGBT teenage suicides in the fall of 2010 prompted him to walk across the country. It just came to me after all the suicides last year on bullying since I lived that, he said, further stressing that he still has what he described as emotional scars. Were at a much different place where we can begin to sort of strengthen our demand for full equality with much more immediacy as weve seen with marriage equality in New York and the repeal of Dont Ask, Dont Tell and the passage of [the] Matthew Shepard hate crime bill. Noble also used the walk to highlight his support of the American Equality Bill,
which would add sexual orientation and gender identity and expression to articles of the Civil Rights Act of 1964. Full equality is what all Americans are born with in this country and are entitled to and those rights have been taken away, said Noble. We will always understand that we are all free and equal and the march will go on until that dream is realized.

Local groups launch trans survey

A coalition of transgender advocacy groups has launched a survey designed to better assess the needs of trans Washingtonians. The D.C. Trans Coalition, Transgender Health Empowerment, Helping Individual Prostitutes Survive and American University are among the organizations participating in the survey that went live slightly more than a month ago. The poll asks participants about a variety of topics that include access to health care, employment, housing and education, interactions with the criminal justice system and their immigration status. Dr. Elijah Edelman of American Universitys Department of Anthropology told the Blade that roughly 200 people have already participated in the survey. He said he hopes up to 1,000 will take part by the fall.

D.C. GOP adds pro-gay language to platform

The D.C. Republican Committee last week became the rst GOP state party to add pro-gay language to its platform. We, the Republicans of the District
of Columbia, support the belief that all individuals, without regard to sexual orientation, are entitled to full and equal protection under the laws and the Constitution and that everyone has the right to be treated with dignity and respect, reads the plank. The proposal was among the recommendations that the DCRCs Platform Committee considered. Robert Kabel, chair of the D.C. Republican Committee, told the Blade that the plank received widespread support. I was delighted that the Platform Committee included this inclusive language on equality, he said. Robert Turner, II, president of the D.C. chapter of the Log Cabin Republicans, earlier proposed a similar plank that specically spelled out lesbian, gay, bisexual and transgender when he testied before the Platform Committee. While it ultimately did not include this specic language to the platform, Turner applauded the committee and Kabel for supporting the inclusion of gay rights in the platform. We are excited to be a part of a state party who understands that inclusion wins, he said. Marriage equality is settled law here in the District. All citizens, including LGBT citizens should be treated equally. Christian Berle, deputy executive director of Log Cabin Republicans, also applauded the DCRC for approving the platform plank. The D.C. Republican Committee has long been on the leading edge of inclusion within the Republican Party, and now the state party platform reects that commitment to treating everyone with dignity and respect, he told the Blade. The Log Cabin Republicans D.C. chapter has done tremendous work in getting this language passed, and Chairman Bob Kabel deserves credit for putting together a platform we can all be proud of. Council holds hearing on hate crimes

D.C. Police Chief Cathy Lanier was among those who testied during a D.C. Council hearing on hate crimes and the Metropolitan Police Departments response to them on June 29. As you know, my philosophy is that every member of the department is responsible for stopping crimes and fully addressing all members of the community in any matters relating to hate crimes, she said. With this in mind, I continue to emphasize ... training and an understanding of the issues relating to hate crimes in the communities in the District that are most frequently affected by them. The Judiciary Committee hearing took place less than three days after Ali Jackson, Alvonica Jackson and Desmond Campbell allegedly stabbed a 16-year-old boy in what police have described as an anti-gay hate crime. MPD statistics indicate that there were 43 reported bias-related crimes based on sexual orientation in 2011, compared to 35 in 2010. D.C. police reported that there were 11 bias-motivated crimes based on gender identity and expression in Washington in 2011, compared to 10 in 2010. MPD statistics further report that the number of reported anti-gay attacks in D.C. between January and May increased 60 percent over the same period last year. Washington remains the city with the highest rate of anti-LGBT violence in the nation, and the problem is only becoming worse, noted Gays and Lesbians Opposing Violence Chair A.J. Singletary during his testimony.

10 pharmacies named to new AIDS network

Ofcials say no disruption in prescriptions expected

The D.C. Department of Health on Monday released the names of the rst 10 pharmacies to join a new city-run network of pharmacies certied to dispense prescriptions for patients enrolled in the citys AIDS Drug Assistance Program or ADAP. Dr. Gregory Pappas, director of the departments HIV/AIDS, Hepatitis, Sexually Transmitted Disease, and Tuberculosis Administration (HAHSTA), said a DOH overhaul of the pharmacy network would require some patients to switch pharmacies to rell their prescriptions over the next month or two. But he said the changes being put in place would provide an enhanced quality of services to patients while saving money for the city. During the transition period from July 1 through August 31, 2012 all eligible and enrolled clients will continue to have access to life-saving medications, a statement released on Monday by DOH says. The transition aims to enhance and expand the services currently provided by initiating a new network of selected pharmacy providers throughout the District, the statement says. The DOH announcement came at a time when some AIDS activists and an ofcial with Care Pharmacies, a local private pharmacy network that has operated the citys ADAP prescription program for more than a decade, predicted that too few pharmacies would join the new network in time to rell prescriptions for patients in the month of July. DOH announced earlier this year that it decided not to renew Care Pharmacies contract to administer the ADAP pharmacy network, saying it would be more efcient and cost effective for the DOH to run its own pharmacy network. DOH ofcials initially said they would release the names of the pharmacies participating in the new city-run network on June 15. But the DOH did not meet that deadline, raising concern among some that the new system would not be ready in time for patients to renew their prescriptions beginning July 1, when the Care Pharmacies contract ended. The salient factor for patients and this is very, very important is no one is going to be denied anti-retroviral [AIDS drugs], Pappas told the Blade in an interview Monday. No ones ADAP status is going to change. No ones medication status is going to change, he said. The new 10-member pharmacy network replaces a Care Pharmacies network that was said to have had at least 24 participating pharmacies. Pappas said the DOH expects the new network to expand

over the next month or two. A DOH spokesperson said eight of the 10 pharmacies that joined the new network were among the 24 pharmacies participating in the Care Pharmacies network. Every pharmacy in good standing in the District of Columbia thats got a license, thats up on their taxes and has a Medicaid certication, can participate, he said. This is a very open, equitable system. The DOH procurement team is in the process of inviting all registered pharmacies in the District of Columbia to participate in the new network, the DOH statement released on Monday says. The new DOH pharmacy network will be fully operational by Sept. 1, 2012. Pappas said that over the past year the city has transferred as many as 1,000 ADAP patients into the citys Medicaid program under the Affordable Care Act, the new health insurance reform law initiated by the Obama administration and upheld last week by the Supreme Court. He said the transfers left about 800 D.C. HIV/AIDS clients remaining in the ADAP program. One pharmacy missing from the list of participating ADAP pharmacies released this week by the DOH is the one operated by Whitman-Walker Health, a development that surprised AIDS activists. Last month, Whitman-Walker Executive Director Don Blanchon told the Blade that Whitman-Walker was serving as many as 400 ADAP patients in its pharmacy under the existing network. He said Whitman-Walker planned to join the new city-run network. DOH spokesperson Najma Roberts said on Tuesday that as of June WhitmanWalker had actually been serving about 200 ADAP beneciaries each month. Pappas told the Blade he hoped Whitman-Walker would become part of the network soon during the DOHs next enrollment period. He declined to comment on why Whitman-Walker wasnt admitted in the rst round. Whitman-Walker spokesperson Chip Lewis said Whitman-Walker expects to apply for admission to the network in the next round of enrollments, which he expected to
take place in the next few days. Were going to apply for that and we fully expect to be added to the list of pharmacies, he said. Asked why Whitman-Walker didnt enroll in the rst group of 10 pharmacies, he said, I think its just been the challenges of the transition process. Lewis said that during the short period in which Whitman-Walker is not a member of the new pharmacy network it will likely have to refer its current ADAP pharmacy patients to one or more of the other pharmacies in the network. Lewis said Whitman-Walker ordered extra drug supplies in anticipation of issues that might surface in the transition period but said he wasnt sure if the clinics pharmacy could use those drugs to ll prescriptions if the pharmacy wasnt yet admitted to the new network. Asked if the new network could accommodate as many as 200 patients from Whitman-Walker along with patients from other pharmacies that chose not to join the new network, DOHs Roberts said, The existing network of 10 pharmacies has the capacity to serve clients during the months of July and August. Pappas and Gunther Freehill, a DOH ofcial involved in the ADAP program, each said they expect a smooth transition for patients who learn this month that their current pharmacy will no longer ll their ADAP prescription. There is a central database repository that has ADAP eligibility information on it and it tells each pharmacy who is eligible for each program, Freehill told the Blade. If the client has a current prescription and/ or a pill bottle that has rells left on it they can simply go to one of those [pharmacies on the list] and get the bottle lled. Added Pappas: They should take their pill bottle to one of the pharmacies on the list and they will be able to get their medication without delay. Trans woman sues D.C. police, U.S. marshals

Claims authorities placed her with male detainees after 2009 arrest

A transgender D.C. woman alleges in a lawsuit against the Metropolitan Police Department and the U.S. Marshals Service that she was improperly placed with male prisoners after a 2009 arrest. Patti Hammond Shaw of Southeast Washington said she turned herself in to ofcers at the Sixth District station on June 18, 2009, after she received a letter that stated there was a warrant for her arrest for ling a false police report. Shaw claims that she showed ofcers her identication that proved she was legally female, but they placed her in a cell in the mens section. She further alleges that male prisoners asked to see her vagina, breasts and buttocks. D.C. police subsequently remanded Shaw, who underwent sex reassignment surgery in 1999, to the custody of U.S. marshals. She said she insisted that she is a woman, but Shaw claims that they insisted she was a man and referred to her by her birth name Melvin. The lawsuit states that the male marshal who searched Shaw groped her breasts, buttocks and between her legs repeatedly and excessively. She further alleges that other marshals made crude comments about her breasts and gender. The lawsuit claims that marshals placed Shaw in a holding cell with approximately 30 men who were going to trafc court. Several of the men in the holding cell touched Ms. Shaw inappropriately, verbally harassed and propositioned her, threatened to punch her if she did not show her breasts to them, and shook their penises at her, it reads. Shaw also claims that she was forced to urinate in a cup in full view of the men in the holding cell. She further states that a male detainee to whom she was chained touched her inappropriately several times as they went into D.C. Superior Court. Shaw said that the marshals told the man to stop harassing her and instructed her to ignore him. She alleges that the male detainee continued to harass her and the marshals did not take any further action. Going through something like this was very, very, very hard for me being a transsexual woman, Shaw told the Blade. I kept telling them I was a woman and they said, thats what they all say. They didnt believe that I had sex reassignment surgery. They didnt believe me at all. Arrestees receive a Police Department Identication Number that is linked to their name and gender when they are taken into custody for the rst time. D.C. police in 2007 adopted a policy that states trans arrestees must remain in a holding cell by themselves. Personnel are required to remain cognizant of a detainees gender identity and expression, and immediately notify their commanding ofcer if their record indicates a different gender than the one that they present at the time of their arrest. The policy further states that MPD staff should pass this information along to the U.S. Marshals Service or other law enforcement agencies that may transport a prisoner. Neither the MPD nor the U.S. Marshals Service responded to the Blades request for comment, but the lawsuit alleges that D.C. police failed to adhere to their own policy. It further accuses Steve Conboy, former U.S. marshal for the D.C. Superior Court, of intentionally disregarding gender information about transgender detainees that MPD employees relayed to members of the U.S. Marshals Service. The lawsuit also names Benjamin Kates, former acting U.S. marshal for the D.C. Superior Court, as a co-defendant. U.S. District Judge Ellen S. Huvelle last November dismissed Shaws lawsuit on procedural grounds, but she said she could pursue them in U.S. District Court in spite of her belief that they would ultimately not proceed. Shaws attorney, Jeffrey Light, told the Blade that his clients incarceration with male inmates was based on where her genitals used to be.

More than 100 people gathered in Dupont Circle on Friday for a vigil in honor of a lesbian couple that was shot last week in a Texas park. Last Friday night, a week ago tonight, as many prepared for LGBT Pride celebrations around the country, 19-yearold Mollie Olgin was taking her girlfriend of ve months, 18-year-old Kristene Chapa, to a movie, said Jamie McGonnigal, who co-organized the gathering with Jay Carmona. Meanwhile, police in Portland, Texas this week said that an eyewitness has come forward in the shooting, according to ABC news. Police contend there is not yet enough evidence to classify the shooting as a hate crime, but thanks to the eyewitness account, they say they are now seeking a white male with dark hair around 58 and about 140 pounds, in his 20s.

SLDN, OutServe announce merger

WASHINGTON Two of the nations most visible organizations that battled the militarys Dont Ask, Dont Tell policy announced this week their boards had unanimously approved a merger. The two organizations will complete their merger by Oct. 2012, and will combine the 20-year-old legal defense organization with the two-year-old gay and lesbian active duty association to better represent gay service members and veterans, according to a video released by the leaders of both organizations, Aubrey Sarvis and Josh Seefried. The leadership of OutServe and SLDN have come together in an unprecedented way to move the ball forward on the mission of full LGBT military equality, and we couldnt be more proud of this combined effort to serve the brave LGBT men and women in our armed forces, OutServe co-founder and co-director Ty Walrod said in a statement.
Boehner appeals DOMA cases to Supreme Court

Took up defense of law after Obama deemed it unconstitutional
House Speaker John Boehners (R-Ohio) attorneys last week formally appealed to the U.S. Supreme Court an appeals court decision determining the Defense of Marriage Act was unconstitutional. Drew Hammill, spokesperson for House Minority Leader Nancy Pelosi (D-Calif.), told the Washington Blade on June 29 afternoon Republicans had notied Democratic leadership that House counsel led an appeal to the Supreme Court. The court ruling that was appealed was the First Circuit Court of Appeals decision in the cases of Gill v. Ofce of Personnel Management, which was led by Gay & Lesbian Advocates & Defenders, and Commonwealth of Massachusetts v. Department of Health & Human Services. On May 31, the appellate court issued a decision that Section 3 of DOMA, which prohibits federal recognition of same-sex marriage, was unconstitutional as a result of both cases. In a statement, Pelosi slammed Boehner for continuing to assert the constitutionality of DOMA, saying the appeal is a decision that will waste more taxpayer funds to advance a position rejected by four different courts and to defend discrimination and inequality before the highest court in the land. Democrats have rejected the Republican assault on equal rights, in the courts and in Congress, Pelosi said. We believe there is no federal interest in denying LGBT couples the same rights and responsibilities afforded to all couples married under state law. And we are condent that the Supreme Court, if it considers the case, will declare DOMA unconstitutional and relegate it to the dustbin of history once and for all. Boehners ofce didnt respond to a request for comment on the appeal. In the ling, Boehners attorneys present two questions to the Supreme Court: (1) Whether Section 3 of the Defense of Marriage Act violates the equal protection component of the Due Process Clause of the Fifth Amendment; and (2) Whether the court below erred by inventing and applying to Section 3 of the Defense of Marriage Act a previously unknown standard of equal protection review. As the First Circuit recognized, this case calls out for this Courts review, the ling states. The court of appeals has invalidated a duly-enacted Act of Congress and done so even though it acknowledged both that DOMA satises ordinary rational basis review and does not implicate heightened scrutiny. In the established world of equal protection law that result should have been impossible. The ling also cites a separation of powers issue as the result of the Obama administration no longer defending DOMA in court as it continues to enforce it and leaves the House to defend the law. Only this Court can settle this matter denitively, the ling states. Unless and until this Court decides the question, the executive branch will continue to attack DOMA in the courts, while continuing to enforce it, thus creating more potential litigation for the House to defend. This Court and this Court alone has the power to settle this question and redirect controversy over this important national question to the democratic process. Additionally, the ling argues the First Circuit ruling conicts with Baker v. Nelson, a case related to samesex marriage that the Supreme Court declined to hear in 1972. Now that Boehners attorneys have led an appeal, there will be 30 days for plaintiffs to le an opposition to the motion. It would then be left to the court to decide whether to grant cert, or hear the case. There isnt a timeline for that, but it wont happen while the court is in summer recess. LGBT advocates also had harsh words for Boehner over his continued defense of DOMA. Evan Wolfson, president of Freedom to Marry, called Boehners appeal shameful and said its time for him to respect basic American values of equal protection under the law. Same-sex couples have waited long enough for the federal government to treat their lawful marriages with the respect and fairness every American wants and deserves, especially in tough economic times, Wolfson said. Judges appointed by Presidents Nixon, Reagan, Clinton, Bush 1, and Bush 2, among others, have all agreed that there should be no gay exception to the normal practice of the federal government honoring the marriages celebrated in the states, and providing the 1138-plus federal protections and responsibilities accorded all other married couples.
Gay Facebook co-founder weds

NEW YORK Chris Hughes one of the co-founders of Facebook, now the publisher and editor of magazine The New Republic married his partner, Sean Eldridge, at their home near Peekskill, according to the New York Times. Coincidentally, this weekend Facebook also expanded the life events icon for marriage to incorporate two grooms and two brides along with the traditional bride and groom to be more inclusive of same-sex nuptials, according to GLAAD. Eldridge had previously been the political director of Freedom to Marry and played a visible role in the effort to extend marriage rights to same-sex couples in the state where he and Hughes reside. According to the Times, the couple met in 2005 when Hughes was still a senior at Harvard. He was very intelligent and charismatic, Hughes said of Eldridge. He was very kind and politically engaged, and he cared about the world around us. All of that was very attractive to me.
State Dept. launches LGBT donation campaign

WASHINGTON On the heels of Secretary of State Hillary Clintons call for LGBT rights worldwide, the State Department has set up a text messaging number that will allow Americans to donate to a global fund that supports programs that advance the human rights of LGBT people around the world. According to the mGive International Response Equality Funds website, the $10 donations will be used to help to further programs and initiatives aimed at advancing human rights, fostering equality, advocacy, protection and dialogue to ensure human rights for lesbian, gay, bisexual and transgendered (LGBT) persons around the world.
Roanoke couple sues gym over revoked membership

ROANOKE Will Trinkle and his partner Juan Granados are suing their former gym after their family membership was revoked when the management discovered the couple was gay, according to WDBJ-7 TV. The couple had signed up for a family membership to include their 2-year-old son on the recommendation of a Roanoke Athletic Club employee. However, several weeks later, the gym called to say it was revoking the membership and changing policies to ensure other same-sex couples do not get memberships in the future. It was, and continues to be, a punch to our gut, Trinkle said in a news conference announcing a lawsuit against the gym and its parent company, Carilion Clinic.
Latin American group backs marriage equality

WASHINGTON Fresh off the unanimous endorsement by the board of directors of the National Council of La Raza, the League of United Latin American Citizens announced this week the organizations adoption of a resolution in support of the right to marry for same-sex couples. Will Obama speak at Intl AIDS conference?

President hasnt yet responded to invitation
Advocates are calling on President Obama to deliver remarks on combatting the HIV/AIDS epidemic at the upcoming International AIDS Conference in Washington, noting the White House hasnt yet to responded to an invitation for him to speak at the event. Those calling on Obama to speak at the 19th International AIDS Conference for 2012 which will take place in D.C. starting the week of July 22 say the president should take the opportunity to highlight his administrations work to combat the disease. Whether the president will make an appearance remains in question. Adina Ellis, a spokesperson for the conference, said Obama has been ofcially invited to speak at and said the White House has acknowledged the invitation, but as of Monday conference ofcials still have not received conrmation on whether hell attend. Carl Schmid, deputy executive director of the AIDS Institute, said he wants the president to take the opportunity to speak and announce to the world that we are going to begin to end AIDS and the ways in which that will happen. I think it would be very important for the president of the United States ... to make a strong announcement that it is the policy of the United States that were going to end AIDS in the United States, and this is what Im going to do to do it, Schmid said. We are looking for his strong afrmation. This is the place to do it; the eyes of the world are looking at this International AIDS conference. Schmid acknowledged the president has a lot of competing interests for his time. I dont see why there should be any reluctance for them to attend, Schmid said. I think most people are expecting him and wanting him to attend, and I think it would be not a good sign if he did not come. The conference is taking place within the United States for the rst time since 1990 thanks in part to the work of the Obama administration. The lifting of the HIV travel ban, which previously had prevented foreign nationals with HIV from coming into the United States, enabled international participants who may have HIV to come into the United States for the conference. Brian Hudjich, executive director of the AIDS research organization HealthHIV, said he wants Obama to speak at the conference to discuss ways in which health care reform will help HIV/AIDS prevention and treatment now that the Supreme Court has upheld the laws constitutionality. I think the president could speak very meaningfully to what access to health insurance really means to people with HIV, including preventing HIV by having prevention programs and testing efforts in primary care settings, so that we can be both helping prevent HIV as well as ensuring the best quality care for all those with HIV, Hudjich said. Hudjich said he doesnt know why Obama has yet to accept the invitation, but would be shocked if the president didnt attend and speculated the administration was waiting for the Supreme Court ruling on health care so the messaging and communication on [health care reform] implementation would be enhanced before conrming attendance. Last week, White House Press Secretary Jay Carney said under questioning from the Washington Blade that he has no updates on Obamas schedule when asked if the president would speak at the conference in D.C. I appreciate the question, but I do not have a scheduling update for you, Carney said. High-ranking members of the Obama administration are slated to address the conference, including Secretary of Health & Human Services Kathleen Sebelius and Eric Goosby, U.S. Global AIDS Coordinator. Other high-prole speakers include former President Bill Clinton, Microsoft co-founder Bill Gates and singer Elton John, who founded the Elton John AIDS Foundation.
Anti-bullying caucus debuts in Congress

Clarion call to combat an epidemic
A bipartisan group of House lawmakers led by Rep. Mike Honda (D-Calif.) last week launched an anti-bullying caucus that aims to draw attention to LGBT youth and others who experience harassment. During a news conference on Capitol Hill, Honda said lawmakers formed the Congressional Anti-Bullying Caucus, which he chairs, to carry the message against the bullying epidemic in schools, the workplace and assisted living facilities. Honda said stories about bullying are common among constituents of all lawmakers. This is going to be from a national point of view right down to the local a clarion call to make sure that all of us understand what this thing called bullying is, Honda said. Members of the caucus who spoke during the conference didnt focus per se on the bullying of LGBT students in school an issue that has received signicant attention in recent years because of gay youths who have committed suicide after being harassed although a few members of the caucus talked about incidents of antiLGBT bullying in their districts. Rep. Barbara Lee (D-Calif.) said LGBT students is the Student NonDiscrimination Act, which would make LGBT status a protected class among students, and the Safe Schools Improvement Act, which would require schools to set up anti-bullying policies. In April, President Obama endorsed both pieces of legislation. Rep. Lois Capps (D-Calif.), a former school nurse, talked about the story of Lawrence King, a gay student from California in her district, who died after being shot in 2008 by a classmate whom he asked to be his Valentine. His death and other similar tragedies remind us that bullying particularly bullying directed at LGBT youth must be stopped, Capps said. Capps said starting the anti-bullying caucus is an important step, but passage of the Safe Schools Improvement Act would be the rst thing we can do to stop bullying. Rep. Judy Chu (D-Calif.) said she has personal interest in stopping bullying because she has a nephew, Harry Lew, who killed himself about a year ago while serving in Afghanistan as a result of hazing. Two of his peers punched and kicked him, forced him to do push ups and crunches wearing his heavy full-body armor and poured the entire contents of a sandbag into his face and mouth, Chu said. This went on for three-and-ahalf hours. Harry was serving his country and was the victim of harassment, and 20 minutes after the torment stopped, he climbed into a foxhole and killed himself. He was only 21 years old. As of Friday, 46 U.S. House members were among its members, including Reps. Pete Stark (D-Calif.), Rep. Keith Ellison (D-Minn.) and Del. Eleanor Holmes Norton (D-D.C.). Four Republicans are members: Reps. Ileana Ros-Lehtinen (R-Fla.), Charles Bass (R-N.H.), Robert Dold (R-Ill.) and Frank LoBiondo (R-N.J.). Following the news conference, Honda told the Washington Blade he expects more members to sign on, but didnt disclose any names. Ros-Lehtinen, who has a transgender son and is a co-sponsor of many pro-LGBT bills, was among the speakers at the news conference. We may be from different sides of the aisle, but we all believe that it is time to stand up and stop bullying both ofine and online, Ros-Lehtinen said. Every American deserves to live a life that is free from persecution and harassment. No one has the right to victimize others because of their gender, or their age, or their race, or creed, ethnicity or sexual orientation. Also present at the news conference was Lee Hirsh, director of the 2011 documentary lm Bully, and David and Tina Long, the parents of a child, Tyler Long, who hung himself after being bullied and whose story was told during the movie.

Advocates still pushing for LGBT inclusion in health reform

employment discrimination and housing discrimination. A report on transgender people published earlier this year by the Task Force and the National Center for Transgender Equality, titled Injustice at Every Turn: A Report of the National Transgender Discrimination Survey, found that transgender people experience unemployment at rates twice that of the national population, and black transgender people experience it at a rate of four times as much. Carl Schmid, deputy executive director of the AIDS Institute, said the Medicaid expansion is particularly important for people with HIV/AIDS because of 50 percent of those in care rely on that program for support and those numbers will grow substantially if states decide to participate. Those who are really poor, theyre going to be covered under Medicaid, Schmid said. The question is what are we expecting from the states. But a number of states may not take part. According to a report in The Hill newspaper, at least 15 governors have signaled they wont participate in the Medicaid expansion now that the Supreme Court has enabled them to wiggle out of participation. Florida Gov. Rick Scott, a Republican elected to ofce during the Tea Party wave in 2010, was among those saying his state wouldnt take part in the Medicaid expansion or other parts of the health care law that are optional to the states. Were not going to implement Obamacare in Florida, Scott said last week on Fox News. Were not going to expand Medicaid because were going to do the right thing. Were not going to do the exchange. Under the health care reform law, the federal government will pay for the Medicaid expansion for the rst few years. Expenses for states come up in 2017, when the federal government will pay 95 percent; Thats reduced to 94 percent in 2018 and in 2019 it goes down to 93 percent. Starting in 2010 and then on out, the federal government will pay 90 percent of the total amount. Schmid said the bargain that was set up for states under the health care law makes the governors decision not to participate in the law questionable. Here their taxpayers are going to be paying their taxes to pay for this; this is federal funds, Schmid said. Their state is not going to take responsibility for covering. The hospitals? Dont they want people to be covered? Theyre going to have unconstituted care if they dont. For the states that dont participate in the Medicaid expansion, Schmid said people living there with HIV/AIDS will have to continue relying on the Ryan White Care Program, which provides funds for

AIDS medications for low-income people with HIV. The program will be up for reauthorization in 2013. As advocates push for states to adopt the Medicaid expansion, the law has several key components that already offer protections and benets for LGBT people and people with HIV/AIDS. State and federal health insurance will be set up in the law starting in 2014. For the rst time, the law extends federal non-discrimination protection in the health care system on the basis of gender. Paschall noted that provision is key as courts and agencies have determined that discrimination against transgender people amounts to gender discrimination. We know that federal agencies like the Equal Employment Opportunity Commission, the Department of Housing & Urban Development as well as federal courts have interpreted sex-based discrimination to include protections on the basis of gender identity and sex stereotypes, Paschall said. What this means is that in the context of health care, LGBT people, especially transgender
people have now for the rst time protections in that setting, which is hugely important. Earlier this year, the Department of Health & Human Services issued rules saying that no program activity in an exchange, nor a health plan, can discriminate on the basis of sexual orientation and gender identity. The rule takes effect when exchanges open in 2014. The administration has taken additional efforts to help the LGBT community when it comes to accessing health care. Samesex couples can now search for health plans that cover domestic partners through the health care nder tool at healthnder.gov. HHS has also undertaken data collection efforts to include questions about sexual orientation and gender identity in surveys like the National Health Interview Survey. Still, advocates are looking for additional efforts from the administration in addition to the adoption of the Medicaid expansion by the states to ensure LGBT people are included in health care reform to the greatest extent possible. Paschall said the Task Force wants to see data collection efforts expanded beyond
the federal surveys already designated by the administration. Generally speaking, we would like to see sexual orientation and gender identity questions added to all federal surveys where demographic data is collected, he said. Our priorities include a number of federal surveys, maybe most notably the American Community Survey, which is an annual survey that collects demographic data and is considered one of the largest annual data sources on the American population. Paschall continued, Were also working with them to ensure that those questions are developed and included in other federal health surveys across the board so that we can have more data in more areas identify where those disparities are. For people living with HIV/AIDS, Schmid said he is awaiting from the administration regulatory guidance in the next couple months on essential health benets to cover people in the Medicaid program and federal exchanges. Well see if the coverage will be strong enough for medications and for all different other services, Schmid said.

Gay U.S. ofcial speaks at Chilean LGBT march
Hopes for progress in conservative country
A gay foreign service ofcer was among the estimated 80,000 people who took part in an LGBT rights march in the Chilean capital last Saturday. Jason Jeffreys of the U.S. embassy in Santiago spoke at the Gay Liberation and Integration Movements annual Equality and Human Rights for Sexual Diversity March. Jacqueline Vera, whose son Daniel Zamudio was brutally beaten to death in a downtown Santiago park in March, Education Minister Harold Beyer, a number of presidential candidates and lawmakers and Jon Benjamin, the United Kingdoms ambassador to Chile, were among those who also participated. As the Human Rights Ofcer at the U.S. Embassy in Santiago, one of a number of policy objectives that Secretary [of State Hillary] Clinton has determined is the concept of equal protections for all, including the international LGBT community, Jeffreys told the Blade. I wanted to participate because I wanted to share with Chile the fact that the [U.S. government] stands with them in this regard. Jeffreys, whose boyfriend is Chilean, added that Zamudios death affected him personally. He attended candlelight vigils and marches and spoke with Chilean politicians about what he described as the importance of anti-discrimination laws. Jeffreys also delivered a letter on behalf of the U.S. ambassador to Chile, Alejandro Wolff, to Zamudios family at his funeral. I jumped at the chance to be able to speak at this event to continue with this support, he noted. Chilean lawmakers in April passed an LGBT-inclusive hate crimes and anti-discrimination bill that had languished for seven years. President Sebastin Piera and other leading politicians backed the measure in the wake of Zamudios death. The Inter-American Court of Human Rights in March ruled in favor of lesbian Judge Karen Atala who lost custody of her three daughters because of her sexual orientation. maintain some level of privacy in my life, Cooper wrote. Part of that has been for purely personal reasons. I think most people want some privacy for themselves and the people theyre close to. Cooper said that from a professional standpoint, he believed keeping his personal life private would better enable him to report on difcult-to-cover stories such as wars that have taken him to places that have placed him and the CNN staff in danger. Ive always believed that who a reporter votes for, what religion they are, who they love, should not be something they have to discuss publicly, Cooper wrote in his email. As long as a journalist shows fairness and honesty in his or her work their private life shouldnt matter. Ive stuck to those principles for my entire professional career, even when Ive been directly asked the gay question, which happens occasionally, he said. Recently, however, Ive begun to consider whether the unintended outcomes of maintaining my privacy outweigh personal and profession principle, he continued. Its become clear to me that by remaining silent on certain aspects of my personal life for so long, I have given some the mistaken impression that I am trying to hide something something that makes me uncomfortable, ashamed or even afraid. This is distressing because it is simply not true. Cooper said he has always been very open and honest about his sexual orientation with his friends, family and professional colleagues. He said that since his early days as a reporter I have worked hard to accurately and fairly portray gay and lesbian people in the media and to fairly and accurately portray those who for whatever reason disapprove of them. Herndon Graddick, president of Gay
and Lesbian Alliance Against Defamation, an LGBT media watchdog group, called Coopers ofcial coming out an important development. Even prior to coming out publicly, Andersons terric work has raised awareness of inequalities facing LGBT people, Graddick said in a statement. Im proud to call him my friend. Hes a role model to millions and now will inspire countless others. Fred Sainz, spokesperson for the Human Rights Campaign, called Coopers statement a big deal. The fact that it will receive scant negative attention and his career will more than likely be enhanced and his relationship with his viewers strengthened is the real victory, Sainz said. Its proof that our culture has changed for the better, that one of our countrys most prominent journalists can share an important aspect of his life without retribution. Cooper for years has been among CNNs most prominent reporters covering stories ranging from foreign wars to Hurricane Katrinas devastation of New Orleans. Earlier this year GLAAD named Anderson Cooper 360, Coopers nightly news program on CNN, as the recipient of its annual GLAAD Media Award for the category of Outstanding TV Journalism Newsmagazine. A spokesperson for CNN didnt respond to a request by the Blade for comment. The Associated Press reported that CNN said it would not be issuing a statement on Coopers decision to come out publicly. AP also reported that CNN said Cooper did not appear on the air for his evening news program 360 on Monday night because he was on assignment. In a brief message to his followers on Twitter, Cooper said, I appreciate all the nice tweets. I am in Botswana working but want to wish everyone a great 4th of July!

We want these transformations to become more profound and we demand total and full equality for every human being. President Obama last December issued a memorandum calling upon all government agencies involved with American foreign aid to promote LGBT rights. The White House released the directive on the same day that Clinton delivered her landmark speech on gay rights in Geneva. Jeffreys said the embassy continues to support Movilh and other Chilean LGBT advocacy organizations. He further stressed that he feels progress on LGBT rights remains possible in the traditionally conservative South American country. I want to see Chile in a different place when it comes to the social acceptance of gays, lesbians and transgendered people, said Jeffreys. I am tired of hearing Chilean friends say that they will never be like Argentina or Brazil when it comes to the gay community, and, therefore, they dont want to even try. This is not acceptable to me, and therefore, I am willing to speak and attend Pride events if for nothing more than to encourage Chile and to demonstrate that this is not an impossible, unobtainable goal.

One of the early initiatives was the establishment of a Facebook page called Marriage Equality Information Exchange-Maryland. Currently there are about 700 members. Fisher and Mike Bernard are administrators of the page. On this page, like-minded individuals can discuss a variety of grassroots techniques to gain support for the movement. It is a closed group, meaning that other Facebook users can see the existence of the group and members but not the contents. The page is intended to build community, share strategies for marriage-equality signature gathering and other events, post documents and pictures, and to inspire one another. Members post related articles and announce events including signature-gathering activities at farmers markets, rallies, festivals, such as Hon Fest, Orioles games and other venues around the state where crowds typically form. The signatures are part of the strategy by MfME to obtain as many pledges as they can for compiling a database, which will be used as a means of communicating with voters, fundraising, recruitment of volunteers and get-out-the-vote drives. It was our goal to set up an online

presence similar to the ones we saw in the Gov. Deval Patrick (D-MA) campaign and with MassEquality. Something that connected local activists so that they could organize locally more efciently, explains Fisher. We also hoped that some areas of the state could share ideas and information with other areas of the state, so thered be a cross-pollination of ideas, across geography and across subgroups. Shortly after the creation of the Facebook page, Fisher and Bernard were contacted by MfME. We quickly agreed on a few concepts: the Facebook page does not speak for the campaign and that wed emphasize positive messaging about love, commitment, and family. Based on that agreement, we began a partnership with the campaign. Fisher adds, Mike and I are team leaders for MfME; were in every-other-day contact with the MfME director for Baltimore. We collect signatures for the campaign, and we encourage our membership to participate in MfME volunteer efforts and events. However, Gerry Fisher and husband David Kimble are going beyond social media to attract activists. They are working to hand out stickers, amass signatures and chat with supporters at the Waverly Farmers Market every Saturday from 8 a.m. until noon. They are seeking leaders to work the downtown and Canton farmers markets as well. In addition, until the election, the couple will be hosting an open house in their Charles Village residence at 2721 Guilford Ave., Baltimore every Friday night. The purpose of the ongoing open house is to provide a space for people to meet, get support, have a laugh and vent some steam, get information, talk informally, brainstorm ideas, strategize, announce events, pick up supplies (pledge sheets, stickers), connect across a diverse set of subgroups within the community, and begin the process of having conversations that well take with us back out into our daily lives, explains Fisher. For those who cannot make it to Baltimore, the couple can be contacted through Skype. Refreshments, such as soda, lemonade and light snacks will be available. BYOB. Saturday is the last chance to see the exhibition, Honoring 1812, at the Crystal Moll Gallery (1030 South Charles St., Baltimore). The exhibition showcases paintings, prints and photographs that commemorate the War of 1812. This includes aerial views of Baltimores Inner Harbor, ships of that era and scenes from Fort McHenry. The exhibit has been shown both at the Crystal Moll Gallery and the World Trade Center during the celebrations. No mention of trans community in citys annual report

The Districts annual report on HIV/ AIDS data, released June 20, claims to herald a new era in treating HIV and yet there is not a single mention of the impact of the epidemic on the citys transgender communities. Without a doubt, the governments response to the AIDS crisis has improved by leaps and bounds in the past decade. Spurred by community organizing and advocacy, the Department of Health has transformed its performance across an array of categories. From auditing city funds to condom distribution to routine testing, the District has made tremendous progress as noted by the HIV/AIDS, Hepatitis, STD and TB Administrations Annual Report. Overall new infections are down, AIDS-related deaths are down and the city is spending its own money on evidencebased needle exchange programs after an end to years of congressional meddling. How ironic, then, that while ofcials recognized one major area of weakness increased rates of HIV infection among black women in poor neighborhoods a swath of D.C.s women went unrecognized, ignored and excluded from the data and the discussion. Transgender women already combating disturbing levels of violence and discrimination in our city have some of the highest HIV prevalence rates. The federal Centers for Disease Control (CDC) recognize that although information is lacking, transgender communities in the U.S. are among the populations at greatest risk for HIV infection. According to the CDC, one meta-analysis of 29 published studies showed that 27.7 percent of transgender women tested positive for HIV infection. A needs assessment from 2000 found that one in three D.C. transgender women self-reported as HIV positive. Part of the problem is that transgender women are routinely categorized as men who have sex with men while actual transgender men (some of whom do have sex with other men) are also routinely neglected in AIDS data and reports. According to the Center of Excellence for Transgender Health, the same meta-analysis mentioned earlier reported a rate of 2-3 percent (about 1 in 50) among trans men. This is signicantly higher than the overall rate in the US. Some grassroots organizations in D.C. collect extensive information on transgender clients. However, such data cannot make it up the chain neither the D.C. Health Department nor the CDC currently have in place mechanisms for properly documenting transgender people living with HIV. Considering that just a few years ago the District had basically no useful epidemiology numbers, some might say that it is an important rst step to get any sort of solid statistics. But, since data collection and analysis was being overhauled anyway, it would have made sense to build in mechanisms for capturing transgender information as well as that of other marginalized groups. Without good numbers, you cant do good planning identifying the communities most affected by AIDS, allocating resources accordingly, etc. Now that there is reliable data, anyone wanting more funding in D.C. explicitly for programs for the transgender community might be told that they dont have the numbers to back up their request, which is true but not because HIV is not seriously affecting the transgender community. Fortunately, the District and CDC are moving in the right direction, thanks to the tireless efforts of advocates locally and nationally. The CDC is taking cues from the Center of Excellence in Transgender Health. D.C. ofcials dont need to wait on the federal agency, however. The Department of Health should act proactively to put into place its own systems (modeled on best practices) so that when the next Annual Report is released, D.C.s transgender residents nally will be part of the picture. Of course, numbers are no magic wand. Every AIDS program in the city must be open and welcoming to transgender people. Police in D.C. must stop conscating condoms and treating them as evidence of prostitution. And the mayors ofce and the Ofce of Human Rights initiatives to address discrimination and stigma against transgender people must continue. It is the year 2012 and we know that stopping AIDS isnt just about statistics and antibodies social inequality plays an equally important role. But we need all three human rights, solid data and the latest medicine and technologies to turn the tide on HIV in DC.

Scalia is scourge of the high court

Vote wisely in November or risk more extreme Supreme Court justices
zona immigration case make it clear that we need to ensure we dont populate the court with other justices who apparently would rather be politicians than judges. While most of the other justices seemed to make an attempt at being fair and impartial during the questioning, there was absolutely no question where Scalia stood. The state has no power to close its borders to people who have no right to be there? he asked incredulously. His questions also included: What does sovereignty mean if it does not include the ability to defend your borders? Are you objecting to harassing the people who have no business being here? Surely youre not concerned about harassing them. And then he asked: We have to enforce our laws in a manner that will please Mexico? During the reading of his dissent he ranted inappropriately about an issue that was totally irrelevant to the case saying, After this case was argued and while it was under consideration, the secretary of homeland security announced a program exempting from immigration enforcement some 1.4 million illegal immigrants and continued, The president has said that the new program is the right thing to do in light of Congresss failure to pass the administrations proposed revision of the immigration laws. Perhaps it is, though Arizona may not think so. But to say, as the court does, that Arizona contradicts federal law by enforcing applications of federal immigration law that the president declines to enforce boggles the mind. This is typical Scalia. In a 60 Minutes interview, Scalia said, Im a law-and-order guy. I mean, I confess Im a social conservative, but it does not affect my views on cases. How can that be when you travel the world dispensing your opinions on law and order freely to anyone that may ask? Scalia has attacked colleagues, once calling a Justice Breyer-penned decision sheer applesauce. Justice Ginsburg has also been the target of some of Scalias zingers; he called one of her opinions absurd, another implausible speculation, and another selfrighteous. He once said of Justice OConnor, This opinion is not to be taken seriously. Scalia himself has said, When I rst came on the court I thought I would for sure get off as soon as I could, which would have been when I turned 65. Because you know, justices retire at full salary. So theres no reason not to leave and go off and do something else. So you know, essentially Ive been working for free, which probably means Im too stupid to be on the Supreme Court. You should get somebody with more sense. But I cannot what happened is, simply I cannot think of what I would do for an encore. I cant think of any other job that I would nd as interesting and as satisfying. The time for the American public to allow a Supreme Court justice to serve because he nds his own rants interesting and satisfying should be over. Scalia calls himself an originalist. He believes in interpreting the Constitution by trying to decipher what the original writers were thinking when they wrote it. He seems to forget that women and African Americans, among others, werent represented among the writers. Scalia sells those men short. I believe they did understand that society would change and they wrote a brilliant document that can be interpreted by modern society. Retirement with full pay may seem even too much to grant Scalia, but I suggest he take the money and leave the rest of us in peace. The next president will get the opportunity to appoint at least two justices and we need to ensure they will be men and women of substance who recognize that the Constitution is a living document. Independents Day arrives in November

Afnity for both parties at 75-year low, plurality now unafliated
demographic segments and extending into the ranks of LGBT voters. Those living in the Washington area are perhaps more accustomed to the dull background sound of the two political parties endlessly bickering at high volumes while accomplishing little. We are also more prone to sit through the harsh high-octane talking head dichotomy between party surrogates on TV and consider that normal. Outside our unique cultural environment, however, the opposite reaction is more pervasive than ever. The sharp ideological divides between diminishing numbers of true political party adherents have become decidedly off-putting for many. In a country with a bitterly hardening discourse and evenly split political brand loyalty, independent voters are the ones candidates hope most to inuence and woo. The percentage actually registered as independent is greatest in the 22 states that do not require voters to register by party. In some of those jurisdictions, they constitute an outright majority. As more states eliminate or loosen party registration requirements coupled with open primary voting, expect signicant increases in the number of unaligned voters. If current trends continue, it will not be long before a national electorate measuring complex issues and often conicting political priorities while simultaneously disassociated from both parties will comprise a majority of the voting-age populace. With little realistic possibility of viable alternate national political parties developing, or having much hope of success, voters will increasingly be left to balance their positions on a range of issues with declining afnity for party labels. Of course, disdain for that process or dismay with the choices will lead more to simply opt out. Projected turnout this year anticipates a return to percentages lower than the last presidential election, perhaps the two before that, with little more than half of eligible voters exercising their franchise. LGBT voters, while strongly supportive of Democratic candidates, have demonstrated successively increasing diversity when voting in recent elections especially as our assimilation becomes more the norm and civil equality expands. Exit polls in the 2010 congressional mid-term election indicated that one-third of us, a record number, voted for the Republican candidate. While its true that some independent voters are more independent than others, with only about 15 percent of the total electorate not leaning toward one party or the other, there is a genuine uidity greater than ever before. As in the LGBT community, a growing group struggle balancing positions on social and economic issues, other concerns, and personal and professional considerations, often reluctantly committing to a political party when voting. Conventional wisdom posits that President Obamas recently announced support for state approval of marriage equality laws, as well as signicant legislative and administrative initiatives beneting gays and lesbians, will stall growth in non-traditional voting patterns in our community. However, with economic and other issues expected to dominate the election for all voters with social issues secondary the progression may continue this year. Voters are also cognizant that there are only a small number of locales where the outcome is not largely predetermined. Geographic majority alignment and intensive statistical gerrymandering have made non-competitive single party dominance the federal election norm in most of the country. Analysts predict that the Electoral College outcome in the current presidential race will be determined by fewer than a quarter-of-a-million voters spread out over specic areas in fewer than 10 states. Given the level of dissatisfaction with the hyper-partisan constructs promoted by the two parties, general intolerance for a diversity of views within each party and largely predictive regional outcomes, its amazing that cynicism isnt greater and voter participation isnt lower.

America celebrates Independence Day this week with reworks, vacations and celebrations of all types. The nations Independents Day is scheduled for later this year when we go to the polls. Or at least thats how we should begin referencing our national elections. The number of voters identifying as afliated with either the Democratic or Republican parties has reached a historic 75-year low. Self-described independents, hovering at 40 percent in recent polls, are now a plurality of all voters. A broadening tally has become alienated from both political parties. This trend is particularly evident among voters under 30, now half of all Hispanics, other

New TV show Push Girls an eye-opener for able-bodied viewers
Angeles. Three are straight; one, having broken up with a man, is dating a woman. And they all use wheelchairs. Think Sex and the City on wheels. For my able-bodied friends (straight and queer), Push Girls has been an eye-opener. Like many, their only images of people in wheelchairs (and of disabled folk in general) have been of patients in nursing homes, sick children or lonely people who dont get out much. I never thought there were lesbians or bisexuals in wheelchairs, a pal told me. Id never thought of it before [watching Push Girls], another buddy said to me, but now I think I could be broadminded enough to date someone in a wheelchair. For me, as someone whos legally blind and lesbian, watching Push Girls has been like manna from heaven. People like myself (who have visible disabilities) are rarely featured on TV, and when we are, its too often as helpless, sexless creatures. Images of people who have disabilities and are LGBT in mainstream and gay media are few and far between. Im a news and pop culture junkie, so I dont mean to knock the media. Its understandable that the media often reect the culture at large and the queer community, where folks with disabilities are rarely on the radar screen. With the exception of actress Geri Jewell, who has cerebral palsy and is lesbian, there are few well-known LGBT people with disabilities. Theres a sense of exclusion from the larger queer movement, Bethany Stevens, a faculty member and policy analyst with the Center for Leadership in Disability at Georgia State University, said in an 2011 interview with the Blade. Theres the pervasive notion of the body beautiful, and we dont live up to those standards, added Stevens, who is a queer sexologist and wheelchair user. The Push Girls, Angela Rockwood, Auti Angel, Tiphany Adams and Mia Schaikewitz, give the lie to hoary stereotypes around disability and sexuality. When most people think of someone in a wheelchair, they imagine someone wearing dirty, gross sweat pants, who doesnt have sex, Adams, who is lmed dancing with and kissing a woman, said on the show. How satisfying it was to hear her add, rolling her eyes, I can have sex! Lots of sex! Its not that Push Girls is all about sex or that the show sugarcoats what living with paralysis is like. The Girls grapple with difcult issues ranging from relationship and family drama to health insurance to employment discrimination. Yet hanging out with the Girls never feels educational; watching the show is like sipping a milk shake or Bloody Mary with your BFFs. Rockwood, a former model, calls a modeling agency to see if its wheelchair accessible. No problem, says the receptionist on the phone, theres a staircase. I have 26-inch rims on the side of my ass, jokes Adams whose charisma and beauty light up the screen, its hard not to get attention. Paying for medical supplies is a big issue, Adams told me in a phone interview, its expensive, but a necessity. Adams, who has done modeling and acting, doesnt like labels. If I date a woman, society feels compelled to put me into a category, she said. But if you take off the masks, its about human connection , Adams added, separating the supercial the exterior from whats inside. Get connected. Watch Push Girls.

Clear Space provides theater x for Rehoboth visitors all summer

For many theaters, summer is the slowest time of year as families escape the city heat for the cooler shore. But for Clear Space Theatre in Rehoboth Beach, the inux of tourists keeps the theater teeming with people nding alternative ways to spend a summer night at the beach. The theater gets so busy that this year its management is running three different shows at once in rotation. This years shows, which each cost between $8,000 and $25,000 to produce, include, Cabaret, Broadway at the Beach and Annie. Our seasons tend to appeal to a variety
of tastes, says Doug Yetter, founder and musical director. For the summer season, we offer a family musical (Annie), a more adult-themed show (Cabaret) and a revue show that bridges the gap. Annie, opened June 30 and is the famous musical about a little orphan girl who goes on adventures in her orphanage and eventually around New York City, ingratiating herself with the president and nding a home in the Warbucks mansion. Cabaret opened June 28 and is the more mature show being performed at Clear Space. Taking place in the Kit Kat Klub in Nazi Germany, American writer Cliff falls for a Klub performer named Sally Bowles. The play observes how they try to make their love survive in a changing world. Broadway at the Beach opened this week and brings several Broadway hit songs to the shores of Delaware. All shows run until September with Broadway at the Beach closing the
season on Sept. 2. Despite the schedule each show is performed at least once a week changing sets hasnt been a problem. When my former partner and I were thinking to move down here, we thought we need to clear some space, Yetter says. We dont need great sets for this; we let the audience bring their imagination. Yetter and his former partner cofounded Clear Space Theatre when they moved to Rehoboth Beach from New York City in 2004. Yetter says they thought the community would benet both culturally and economically from having a yearround theater. Yetter had about 40 years of musical theater experience, putting on productions all over the country. At Clear Space he works largely as artistic and musical director, overseeing all productions. Since theres not a strong emphasis on
the sets for these shows, the costumes and characters have to carry the productions. Bill Clark, the full-time costume designer, immerses himself in the various stories to dress the cast appropriately. When we choose the shows were going to do three months out from our rst creative meeting, I read the scripts three times, he says. Then I create a costume plot, detailed scenes that serve as a map, and from there I sketch individual costumes. For Clarks favorite costumes in Cabaret, he began studying the culture in Berlin from 1925 onward. He also studied the works by Christopher Isherwood, a gay novelist from the 1930s, who wrote the original story upon which Cabaret is based, trying to reect its dark tones in the clothes the Kit Kat Klub girls don. HOW LONG HAVE YOU BEEN OUT AND WHO WAS THE HARDEST PERSON TO TELL? My rst boyfriend outed me to my family and outed me to the Marine Corps. That was in 2005. The hardest thing was admitting it to my mother. Once she knew, I didnt care who else did. WHOS YOUR LGBT HERO? I met a lot of people who have done great things for the community, but I dont actually have anyone in particular. WHATS WASHINGTONS BEST NIGHTSPOT, PAST OR PRESENT? Bear Happy Hour has always been home since I came out. And Im proud to have been able to manage that event for the past three years. DESCRIBE YOUR DREAM WEDDING. When I think about Scott and I getting married, its not the wedding itself I think about. I think about the people who would be there. I would love for my very conservative Baptist family to be there to support me. Not because they think being gay is OK (because they will never believe that), but just to support me in the fact that Ive found someone I want to be with for the rest of my life. Unfortunately, though Im closest to my mother more than any other family member, I doubt she will even be there for it. WHAT NON-LGBT ISSUE ARE YOU MOST PASSIONATE ABOUT? I think we as a community spend so much time focusing on our rights or the attitude that we are owed something, that we forget the simple things like just treating each other with respect. WHAT HISTORICAL OUTCOME WOULD YOU CHANGE? In 2005 when my first boyfriend outed me to the Marine Corps I had no idea what to do. I had a few months left on an eight-year contract and they told me to not reenlist or they would kick me out under Dont Ask, Dont Tell. If I knew then what I know now about the support structure for the LGBT community in the armed forces, I would have stayed in. But I was scared, alone, and had no one to go to for help. I didnt know anything about the community back then. The flip side to that is that if I would have stayed in I wouldnt be where Im at now and I wouldnt have met my fianc, or owned two small business, or be running the Bear Happy Hour. So I guess maybe I should be thanking him? WHATS BEEN THE MOST MEMORABLE POP CULTURE MOMENT OF YOUR LIFETIME? Oh god, pop culture most memorable? I would have to say no clue. Love the music, ignore the people. ON WHAT DO YOU INSIST? I insist that people stay in between their own white dotted lines on the road and use their blinkers when changing lanes. I have no problems getting out of the car and explaining to you why I think you shouldnt have a drivers license at the next red light. WHAT WAS YOUR LAST FACEBOOK POST OR TWEET? Facebook: Apparently (so I overheard) real men drive Miatas. IF YOUR LIFE WERE A BOOK, WHAT WOULD THE TITLE BE? I grew up in a Baptist church and was heavily involved in the church until I was 24. I guess you could say I am a questioning Christian. I believed all my life that being gay was wrong, and here I am. So what else is wrong? WHATS YOUR ADVICE FOR LGBT MOVEMENT LEADERS? Be better at it than the opposition. WHAT WOULD YOU WALK ACROSS HOT COALS FOR? Id do it for a couple million. WHAT LGBT STEREOTYPE ANNOYS YOU MOST? That for some reason being gay equals I am a big black woman stuck in a twinks body. GUUUUURRRRRL!!! Of course we perpetuate the stereotype so we should be blaming ourselves for it. WHATS YOUR FAVORITE LGBT MOVIE? A Dirty Shame WHATS THE MOST OVERRATED SOCIAL CUSTOM? joeyd@washblade.com When Nicholas Baatz was told not to re-enlist in the Marines as hed planned after being outed in 2005 his tour was up in ve months and he claims it would have taken military brass longer to have him kicked out under Dont Ask, Dont Tell it was a crush that forced him to rethink his career path but he sees it now as a roundabout blessing. I thought about re-enlisting once they got rid of Dont Ask, Dont Tell but I really love what Im doing now and where life has taken me, so I dont want to give that up, he says. Baatz, known as Charger Stone in D.C. bear circles, runs D.C. Bear Crue which has several events but is mostly known for its 6-11 p.m. weekly Friday evening happy hour at Town (dcbearcrue.com). He also manages Unleashed Massage Studio in Northeast Washington. Baatz came out after a two-year marriage to a woman failed. He and partner Scott Gunn, a cop in Anne Arundel County he met in 2011, plan to get married next May. Baatz proposed at Bear Happy Hour. The 32-year-old Groton, Conn., native lives in Hyattsville, Md., with Gunn and their three Great Danes and one German Shepherd Angel, Lucky, Misty and Tommy. Baatz spent time in Japan and Iraq during his military years. He enjoys his motorcycle and cleaning in his free time (Im a little OCD, so I cant relax unless everything is in its place). He plans to graduate in the fall from DeVry University with a degree in technical management.

Lutheran LGBT group holding D.C. conference this weekend

A contingent of LGBT Lutherans will be in Washington this weekend for its biennial conference and while the denomination is still celebrating a 2009 decision that allows partnered gay and lesbian clergy to live openly, the group says it still has much work to do. ReconcilingWorks Lutherans for Full Participation was founded in 1974 by six believers when it was known as Lutherans Concerned for Gay and Lesbian People. This years gathering, which runs today through Tuesday based at Luther Place Memorial Lutheran Church (1226 Vermont Ave., N.W.), will nd a few hundred LGBT believers and allies here to fellowship, lobby, hear a keynote address from Presiding Bishop Mark Hanson and more. Our primary purpose is always movement building, says Emily Eastwood, executive director of ReconcilingWorks, a life-long Lutheran and lesbian. We gather for personal transformation and support as well as skills building, education and action planning. Despite the 2009 decision, she says the groups work is not done. As we know from the years of history with the Civil Rights Movement, when policies change, when laws change, that doesnt mean the practice of it is immediately implemented or that the cultural shifts have occurred, she says. Only about 500 of the 10,000 or so individual churches within the Evangelical Lutheran Church in America (ELCA) are reconciling in Christ, the groups term for LGBT welcoming. The D.C. area has more percentage wise about 20 of the 70-odd ELCA churches that are part of the Metro D.C. Synod are reconciling, according to Philip Moeller, convener of the D.C. ReconcilingWorks chapter since 1991. What were basically saying is that it is possible to reconcile differences on these issues and move ahead in a way thats commensurate with the gospel, Moeller says. Members say its a huge step for the entire denomination to have Hanson address their group. Moeller says Hanson was always sensitive to their issues but measured in his public stance prior to the 2009 vote. Hes been more unequivocal in his support since then, members say, and his appearance is unprecedented for the 4.2 million-member ELCA. This is the rst time weve ever had a presiding bishop address us and it really says something about the change thats happening within the church, Moeller says. On Tuesday, members will visit Capitol Hill for a lobbying effort. Phil Soucy, the organizations director of communications, says its part of the groups belief that its work matters in the context of society at large. Were going to be going to our representatives to tell them our thoughts to make sure theyre aware of the things we consider important in our lives as Lutherans and as citizens, Soucy, whos gay, says. So how has ReconcilingWorks managed to make further strides within its denomination compared to other gay Christian groups? Youve got a real tough issue with the Roman Catholic Church in that its very hard to change the Vatican, Moeller, whos also gay, says. In terms of the Protestant denominations, I think the reason weve been so successful is that we really understood early on that confrontation gets you nowhere. If youre in somebodys face, youre not going to change their mind about anything. ... What works is hearing the stories of people who have faith and who are LGBT.

Jewish Community Center (1529 16 th St., N.W.) is hosting Meghan McCain and Michael Ian Black on Thursday from 7:30-9 p.m. McCain, a Republican, and Black, a Democrat, traveled across America to see if two people with radically opposing views could find common ground. They chronicled their discoveries in their new book, America, You Sexy Bitch: A Love Letter to Freedom. Michael Ian Black is a stand-up comedian who has starred in numerous television series and movies. Gay duo to premier parody musical at the Fringe

By day, Patrick English and Jeff Vonch are patent examiners at the U.S. Patent ofce in Alexandria, but by night and on weekends theyre busy producing, writing and (in Vonchs case) choreographing musical theater. When their new musical Where in the World? The Untold Story of Camilla Sanfrancisco premiers Thursday as part of the Capital Fringe Festival, everyone can see the result of the gay duos arduous efforts. For English and Vonch, making fun of cultural touchstones from their youth is a favorite pastime. One of their preferred targets is Carmen Sandiego, the animated villainess of educational video games and TV programs popular in the 80s and 90s. Last year following one of their nostalgic confabs, Vonch received an uncharacteristically serious email from English suggesting that they collaborate on a musical about the red fedorawearing Sandiego and her mysterious transformation from good to bad. Whats more, he wanted them to produce the show themselves. At rst I thought he was crazy, says Vonch, 26. Neither of us had ever done anything like that before. How were we going to write a musical and produce? Then I got scared. I have aspirations to direct and do standup, but I also have big fears about putting my work out there before the public. Still, something told me to go for it. Soon after, collaboration began in earnest. As lyricists, the nervy twosome teamed up with established local composer Adrian Verkouteren to write an eight-song score. Prior to penning the musicals libretto, English and Vonch researched Carmens backstory. She was a child genius who grew up to be an ace detective at ACME Detective Agency. Later she defected to a nasty villain league (V.I.L.E.) simply because she was bored. The novice librettists werent sold on Carmens motivation, so they decided to go a different way. We named our character Camilla Sanfrancisco. Its a parody; its our story, says English, 30. Our Camilla [played by Vanessa Kinzey] is the victim of a frameup orchestrated by a far-ung coterie of evildoers. Camilla travels the world working her way through henchman [and women] until she confronts the evil boss. Its like a video game. Her stopping in India and Buenos Aires helps to make the show musically interesting. Weve inserted both Bollywood and Tango numbers. With more than 130 shows performed in venues throughout town, the Capital Fringe Festival is D.C.s foremost annual performing arts event. Offerings run the gamut from dance, drama and music to spoken word and puppetry. The work is often touted as edgy, offbeat and refreshing. Sometimes thats the case, but not always. Though both are patrons of the D.C. theater scene, Vonch and English havent been so involved in a theatrical production since high play days in Minooka, Ill., and Northern California, respectively. One of the great benets of Fringe is that the relatively inexperienced can wear many hats. On this show, were coproducers, co-lyricists, co-librettists and Jeff is choreographer, English says. Weve learned a lot. As co-producers weve put out a lot of res and signed a lot of checks, but ultimately to see our work brought to life by such talented people is a really moving experience. Its hard to put into the words. While a lot of Fringe productions cover adult terrain. English describes Camilla as PG-13. Most single people have a mental list of desired qualities for their future partner. This is completely normal, however weve noticed that some are rather particular. We tell clients to be prepared before meeting us that we will need to know their must haves and never wants mature daters should be certain in knowing what characteristics and qualities will mesh well with their lifestyles before deciding to be proactive in dating. Clear Space brings varied theater to beachgoers

pattern, he says. Compared to other renditions of Cabaret, director Dorothy Neuman says her version may appear darker. Its very topical, she says. A force in the government, the Nazis who are coming to power, have certain prejudices in society. They consider that they have the right answer. I feel this is a very parallel situation in America, a very strong conservative right in which they think they know what is morally right and if you dont agree with them then you are not American. Neuman, who identies as a woman who happens to be gay, has been directing theater since 1978, starting in various places in Arlington, Va., and Washington. Michael Matthias, who is acting in all three productions, says that hes looking forward to Cabaret mostly because of its darker overtones. He also says staging three shows is made easier because they are working with mostly the same company all year round. We are considered a professional theater because we have a year-round theater company, he says. The theater holds auditions for roles not lled by the
company. As part of the company, hes expected to continue his growth as an actor by attending classes. This season, he plays Rooster Hannigan in Annie, hes part of the ensemble in Broadway at the Beach and also Cliff in Cabaret. Chris Poeschl, an actor brought in for the summer, says Clear Space Theatre is different from most venues where hes performed. Its such an intimate experience, when we are out on the stage we are in the audience, he says. Poeschl is in the ensemble for Broadway at the Beach, but is excited for all three productions. None of the plays are LGBT-specic, though Cabaret, of course, has long been a gay favorite. Cabaret in our theater is handled very maturely, very real, he says. Its a reliable description. Because of the large LGBT population in Rehoboth, Yetter says he makes it a point to include shows with gay appeal. We really serve the community, he says. Its important that we have pieces that are inclusive. Bob Hoffer and Max Dick, who have been attending performances at Clear Space for the past ve years, say the small,

tight-knit community of the theater draws in many Rehoboth gay residents and visitors. There are a lot of gay and lesbian people involved in the theater, Hoffer says. Often you will run into a lot of cast members in the restaurants and bars around the theater. Going to the theater gives you a kind of perk in your day.

Summer is a popular time to buy in D.C.

Whether its the heat index or the housing market, the numbers dont lie: this July has been one of the hottest on record and it doesnt appear to be cooling down anytime soon. Most people think the summer means tank tops, flip-flops and the summer doldrums in real estate. In fact, Dwight and I have had some of our busiest weeks ever in the height of summer. Last July we had an amazing nine ratified contracts in just seven days between the two of us. This summer may be just as active, and the numbers are there to prove it. The included graph of the 20009 ZIP code shows that sales are near their four-year highs, while the inventory of active listings is at a five-year low. Pending sales are up sharply over this time last year, as well. The District and the region show similar numbers. Its simple supply and demand economics that indicates that low supply and steady demand will result in higher prices and quicker sales. And speaking of quicker sales, Washington now sees its average Days on Market at 48 by far the lowest in five years. With that in mind, there is no surprise that we have received multiple offers on almost all our recent listings, and that our buyers are having to once again negotiate with pre-inspections, escalation clauses and shorter contin-
gency periods. If you are currently in the market, do not wander in casually and expect to buy a well-priced, attractive home without a fight; instead, prepare for battle with an agent who is armed with knowledge and experience to help you emerge victorious. Find a lender who can fully approve you prior to making an offer, and use one that is known to be reliable locally. Better yet, use a lender that can close quickly by using local, in-house underwriters
and a vetted bank of appraisers on call (national banks and online lenders may just use any appraiser who is licensed in the area, even if they have never been in your neighborhood). Finally, if you plan to purchase with an FHA loan (which may eliminate you from a competitive situation), at least use a lender who can perform the FHA evaluation in-house, which reduces the approval time from about two months to about two weeks. If these concerns sound like a for-
eign language, it makes it all the more incumbent upon you to work with a professional who can walk you through the process patiently, yet confidently. Stay cool this summer, enjoy some time off and dont miss out on that dream house by letting the heat slow you down. Happy hunting!
