1. VILLAVICENCIO, ET AL. vs. JUSTO LUKBAN, ET AL.

Issue: The writ of Habeas Corpus was filed by the petitioner, with the prayer that the respondent produce around 170 women whom Justo Lukban et, al deported to Davao. Liberty of abode was also raised versus the power of the executive of the Municipality in deporting the women without their knowledge in his capacity as Mayor.

or (2) they could have shown by affidavit that on account of sickness or infirmity those persons could not safely be brought before the court; or (3) they could have presented affidavits to show that the parties in question or their attorney waived the right to be present.

Held:

Facts: Justo Lukban as Manila City's Mayor together with Anton Hohmann, the city's Chief of Police, took custody of about 170 women at the night of October 25 beyond the latters consent and knowledge and thereafter were shipped to Mindanao specifically in Davao where they were signed as laborers. Said women are inmates of the houses of prostitution situated in Gardenia Street, in the district of Sampaloc.

The court concluded the case by granting the parties aggrieved the sum of 400 pesos each, plus 100 pesos for nominal damage due to contempt of court. Reasoning further that if the chief executive of any municipality in the Philippines could forcibly and illegally take a private citizen and place him beyond the boundaries of the municipality, and then, when called upon to defend his official action, could calmly fold his hands and claim that the person was under no restraint and that he, the official, had no jurisdiction over this other municipality. We believe the true principle should be that, if the respondent is within the jurisdiction of the court and has it in his power to obey the order of the court and thus to undo the wrong that he has inflicted, he should be compelled to do so. Even if the party to whom the writ is addressed has illegally parted with the custody of a person before the application for the writ is no reason why the writ should not issue. If the mayor and the chief of police, acting under no authority of law, could deport these women from the city of Manila to Davao, the same officials must necessarily have the same means to return them from Davao to Manila. The respondents, within the reach of process, may not be permitted to restrain a fellow citizen of her liberty by forcing her to change her domicile and to avow the act with impunity in the courts,

That when the petitioner filed for habeas corpus, the respondent moved to dismiss the case saying that those women were already out of their jurisdiction and that , it should be filed in the city of Davao instead.

The court ruled in favor of the petitioner with the instructions;

For the respondents to have fulfilled the court's order, three optional courses were open: (1) They could have produced the bodies of the persons according to the command of the writ;

while the person who has lost her birthright of liberty has no effective recourse. The great writ of liberty may not thus be easily evaded.

2. Tanada vs Angara Facts : This is a petition seeking to nullify the Philippine ratification of the World Trade Organization (WTO) Agreement. Petitioners question the concurrence of herein respondents acting in their capacities as Senators via signing the said agreement. The WTO opens access to foreign markets, especially its major trading partners, through the reduction of tariffs on its exports, particularly agricultural and industrial products. Thus, provides new opportunities for the service sector cost and uncertainty associated with exporting and more investment in the country. These are the predicted benefits as reflected in the agreement and as viewed by the signatory Senators, a free market espoused by WTO. Petitioners on the other hand viewed the WTO agreement as one that limits, restricts and impair Philippine economic sovereignty and legislative power. That the Filipino First policy of the Constitution was taken for granted as it gives foreign trading intervention. Issue : Whether or not there has been a grave abuse of discretion amounting to lack or excess of jurisdiction on the part of the Senate in giving its concurrence of the said WTO agreement. Held: In its Declaration of Principles and state policies, the Constitution adopts the generally

accepted principles of international law as part of the law of the land, and adheres to the policy of peace, equality, justice, freedom, cooperation and amity , with all nations. By the doctrine of incorporation, the country is bound by generally accepted principles of international law, which are considered automatically part of our own laws. Pacta sunt servanda international agreements must be performed in good faith. A treaty is not a mere moral obligation but creates a legally binding obligation on the parties. Through WTO the sovereignty of the state cannot in fact and reality be considered as absolute because it is a regulation of commercial relations among nations. Such as when Philippines joined the United Nations (UN) it consented to restrict its sovereignty right under the concept of sovereignty as autolimitation. What Senate did was a valid exercise of authority. As to determine whether such exercise is wise, beneficial or viable is outside the realm of judicial inquiry and review. The act of signing the said agreement is not a legislative restriction as WTO allows withdrawal of membership should this be the political desire of a member. Also, it should not be viewed as a limitation of economic sovereignty. WTO remains as the only viable structure for multilateral trading and the veritable forum for the development of international trade law. Its alternative is isolation, stagnation if not economic self-destruction. Thus, the people be allowed, through their duly elected officers, make their free choice. Petition is DISMISSED for lack of merit.

3. IBP v. Zamora, 338 SCRA 81(2000) FACTS: Following an alarming increase in violent crimes in Metro Manila, Pres. Estrada ordered the deployment of the Phil. Marines to join in visibility patrols around the metropolis. The Pres. invoked his Comm.-in-Chief powers under Sec 18, Art VII of the Constitution. The IBP seeks to nullify the order on constitutional grounds. ISSUE: Does it have standing? HELD: Locus standi has been defined as personal & substantial interest in the case such that the party has sustained or will sustain direct injury as result of the challenged act. In this case, IBP primarily anchors its standing on its alleged responsibility to uphold the constitution. The mere invocation by the IBP of its duty to preserve the rule of law & nothing more, while undoubtedly true, is not sufficient to clothed it w/ standing. That is too general, an interests that is shared by other groups & the whole citizenry. IBPs fundamental purpose that is to elevate the standards of the law profession & improve the administration of justice, cannot be affected by the deployment of the Marines.

The petitioners, all minors duly represented and joined by their respective parents, filed a petition to cancel all existing timber license agreements (TLAs) in the country and to cease and desist from receiving, accepting, processing, renewing or approving new timber license agreements. This case is filed not only on the appellants right as taxpayers, but they

HELD: The petitioners have locus standi (legal standing) on the case as a taxpayers (class) suit. The subject matter of complaint is of common and general interest to all the citizens of the Philippines. The court found difficulty in ruling that the appellants can, for themselves, and for others file a class suit. The right of the petitioners to a balanced and healthful ecology has been clearly stated. A denial or violation of that right by the other who has the correlative duty or obligation to respect or protect the same gives rise to a cause of action. The granting of the TLAs, as the petitioners claim to be done with grave abuse of discretion, violated their right to a balanced and healthful ecology hence, the full protection thereof requires that no TLAs should be renewed or granted. The appellants have also submitted a document with the sub-header CAUSE OF ACTION which is adequate enough to show, prima facie, the violation of their rights. On this basis, these actions must therefore be granted, wholly or partially. Despite the Constitutions non-impairment clause, TLAs are not contracts, rather licenses; thus, the said clause cannot be invoked. Even if these are protected by the said clause, these can be revoked if the public interest so required as stated in Section 20 of the Forestry Reform Code (P.D. No. 705). Furthermore, Section 16 of Article II of the 1987 Constitution explicitly provides that: The State shall protect the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature. The right to a balanced and healthful ecology carries with it the correlative duty to refrain from impairing the government. The said right is also clear as the DENRs duty under its mandate and by virtue of its powers

and functions under Executive Order No. 192 and the Administrative Code of 1987 to protect and advance the said right.

7. Basco v. PAGCOR

FACTS: On July 11, 1983, PAGCOR was created under Presidential Decree 1869, pursuant to the policy of the government, to regulate and centralize through an appropriate institution all games of chance authorized by existing franchise or permitted by law. This was subsequently proven to be beneficial not just to the government but also to the society in general. It is a reliable source of much needed revenue for the cash-strapped Government. Petitioners filed an instant petition seeking to annul the PAGCOR because it is allegedly contrary to morals, public policy and public order, among others. ISSUES: Whether PD 1869 is unconstitutional because: 1.) it is contrary to morals, public policy and public order;

2.) it constitutes a waiver of the right of the City of Manila to improve taxes and legal fees; and that the exemption clause in PD 1869 is violative of constitutional principle of Local Autonomy;

3.) it violates the equal protection clause of the Constitution in that it legalizes gambling thru PAGCOR while most other forms are outlawed

together with prostitution, drug trafficking and other vices; and

4.) it is contrary to the avowed trend of the Cory Government, away from monopolistic and crony economy and toward free enterprise and privatization. HELD: 1.) Gambling, in all its forms, is generally prohibited, unless allowed by law. But the prohibition of gambling does not mean that the government can not regulate it in the exercise of its police power, wherein the state has the authority to enact legislation that may interfere with personal liberty or property in order to promote the general welfare.

Every law has in its favor the presumption of constitutionality, thus, to be nullified, it must be shown that there is a clear and unequivocal breach of the Constitution. In this case, the grounds raised by petitioners have failed to overcome the presumption. Therefore, it is hereby dismissed for lack of merit.

8. Rev. Ely Velez Pamatong Vs. Commission on Elections FACTS: Petitioner Pamatong filed his Certificate of Candidacy (COC) for President. Respondent COMELEC declared petitioner and 35 others as nuisance candidates who could not wage a nationwide campaign and/or are not nominated by a political party or are not supported by a registered political party with a national constituency. Pamatong filed a Petition For Writ of Certiorari with the Supreme Court claiming that the COMELEC violated his right to "equal access to opportunities for public service" under Section 26, Article II of the 1987 Constitution, by limiting the number of qualified candidates only to those who can afford to wage a nationwide campaign and/or are nominated by political parties. The COMELEC supposedly erred in disqualifying him since he is the most qualified among all the presidential candidates, i.e., he possesses all the constitutional and legal qualifications for the office of the president, he is capable of waging a national campaign since he has numerous national organizations under his leadership, he also has the capacity to wage an international campaign since he has

3.) Equal protection clause of the Constitution does not preclude classification of individuals who may be accorded different treatment under the law, provided it is not unreasonable or arbitrary. The clause does not prohibit the legislature from establishing classes of individuals or objects upon which different rules shall operate.

practiced law in other countries, and he has a platform of government. ISSUE: Is there a constitutional right to run for or hold public office? RULING: No. What is recognized in Section 26, Article II of the Constitution is merely a privilege subject to limitations imposed by law. It neither bestows such a right nor elevates the privilege to the level of an enforceable right. There is nothing in the plain language of the provision which suggests such a thrust or justifies an interpretation of the sort. The "equal access" provision is a subsumed part of Article II of the Constitution, entitled "Declaration of Principles and State Policies." The provisions under the Article are generally considered not self-executing, and there is no plausible reason for according a different treatment to the "equal access" provision. Like the rest of the policies enumerated in Article II, the provision does not contain any judicially enforceable constitutional right but merely specifies a guideline for legislative or executive action. The disregard of the provision does not give rise to any cause of action before the courts. Obviously, the provision is not intended to compel the State to enact positive measures that would accommodate as many people as possible into public office. Moreover, the provision as written leaves much to be desired if it is to be regarded as the source of positive rights. It is difficult to interpret the clause as operative in the absence of legislation since its

effective means and reach are not properly defined. Broadly written, the myriad of claims that can be subsumed under this rubric appear to be entirely open-ended. Words and phrases such as "equal access," "opportunities," and "public service" are susceptible to countless interpretations owing to their inherent impreciseness. Certainly, it was not the intention of the framers to inflict on the people an operative but amorphous foundation from which innately unenforceable rights may be sourced. The privilege of equal access to opportunities to public office may be subjected to limitations. Some valid limitations specifically on the privilege to seek elective office are found in the provisions of the Omnibus Election Code on "Nuisance Candidates. As long as the limitations apply to everybody equally without discrimination, however, the equal access clause is not violated. Equality is not sacrificed as long as the burdens engendered by the limitations are meant to be borne by any one who is minded to file a certificate of candidacy. In the case at bar, there is no showing that any person is exempt from the limitations or the burdens which they create. The rationale behind the prohibition against nuisance candidates and the disqualification of candidates who have not evinced a bona fide intention to run for office is easy to divine. The State has a compelling interest to ensure that its electoral exercises are rational, objective, and orderly. Towards this end, the State takes into account the practical considerations in conducting elections. Inevitably, the greater the number of candidates, the greater the opportunities for logistical confusion, not to mention the increased allocation of time and resources in preparation for the election. The

organization of an election with bona fide candidates standing is onerous enough. To add into the mix candidates with no serious intentions or capabilities to run a viable campaign would actually impair the electoral process. This is not to mention the candidacies which are palpably ridiculous so as to constitute a one-note joke. The poll body would be bogged by irrelevant minutiae covering every step of the electoral process, most probably posed at the instance of these nuisance candidates. It would be a senseless sacrifice on the part of the State. The question of whether a candidate is a nuisance candidate or not is both legal and factual. The basis of the factual determination is not before this Court. Thus, the remand of this case for the reception of further evidence is in order. The SC remanded to the COMELEC for the reception of further evidence, to determine the question on whether petitioner Elly Velez Lao Pamatong is a nuisance candidate as contemplated in Section 69 of the Omnibus Election Code.

Obiter Dictum: One of Pamatong's contentions was that he was an international lawyer and is thus more qualified compared to the likes of Erap, who was only a high school dropout. Under the Constitution (Article VII, Section 2), the only requirements are the following: (1) natural-born citizen of the Philippines; (2) registered voter; (3) able to read and write; (4) at least forty years of age on the day of the election; and (5) resident of the Philippines for at least ten years immediately preceding such election. At any rate, Pamatong was eventually declared a nuisance candidate and was disqualified.
