What Just Happened to the Rule of Law?

By Alan Caruba Following the Obamacare decision, The Heartland Institutes Maureen Martin, a Senior Fellow for Legal Affairs, said, Todays decision will go down in infamy. It marks the moment when we all lost our freedom because the Supreme Court drew a road map to guide those dedicated to imposing a totalitarian, statist government on the American people. A Heartland colleague, Peter Ferrara, a member of the bar of the Supreme Court and a Senior Fellow for Entitlement and Budget Policy, said The Supreme Court of the United States just endorsed the most fundamental dishonesty of our politics today. The President intimidated Chief Justice John Roberts like Hugo Chavez intimidates the Venezuelan Supreme Court. The rule of law is now dead. The American people have only one more chance now to save their country. Heartland is a non-profit, free market think tank. A lot of Americans may begin to feel like the Jews who lived in Nazi Germany. On September 15, 1935, the Nazi government passed the Nuremberg laws. They were intended to make life in Germany so unpleasant that it would force them to emigrate. Those who could escaped what would later materialize as the Holocaust, the deliberate extermination of all the Jews of Europe. One of them was Albert Einstein who found sanctuary in the United States. To give you a taste of what it was like, the Reichstags Nuremburg laws prohibited marriage between Jews and Aryan Germans. Intercourse between Jews and subjects of German or kindred blood was forbidden. Jews were forbidden to fly the Reich and national flag. It did not take long for Jewish teachers, lawyers, and physicians to be stripped of their right to work. What does that have to do with Obamacare? Americans who could rely on the political system to moderate and even reduce taxation now know that the December 28, 2012 Supreme Court has ruled that Congress may tax anything, including behavior. Americans no longer are free to determine what they wish to purchase or not. Either they follow the dictate of the federal government or they will be fined. Obamacare has now transformed the United States into a police state. Twenty-seven U.S. States joined together to oppose Obamacare and they and the other twentythree now know that they are no longer separate and sovereign republics, but must yield to the

federal governments demand that they create exchanges where health insurance must be purchased. Arizona has already discovered that the federal government will not permit its law enforcement authorities to participate in protecting its border with Mexico despite the havoc illegal immigration has wreaked on that State. Other States have encountered the same response. Americas older generation, covered by Medicare, will discover that panels of bureaucrats will determine the extent of the health care they can receive. They will discover as those in Englands health system that the wait to be admitted to a hospital can result in death. The younger generation will suffer as well. As Paul T. Conway, the president of Generation Opportunity, a non-profit, non-partisan organization that seeks to mobilize young adults who are dissatisfied with the status quo to create a better future for themselves, has said: President Obamas health care law stands as one of the largest tax increases in American history. It will be paid by young Americans whose dreams and plans for the future have already been derailed by failed policies that have denied their access to full-time, meaningful jobs in their chosen career paths. Young Americans, said Conway, know they will pay the true costs of President Obamas legislationover a trillion dollars more in federal spending, more waste and fraud, increased American debt, and the inability to keep or choose healthcare plans that best suit their needs as individuals.

Young, old, and all other Americans will wake now to an America that they have not known, nor ever conceived could exist; a nation in which the rule of law no longer is a guarantee of the Constitutions limits and separation of powers. (Will they really wake up now? I doubt it Victoria)

By redefining the Obamacare fiasco as a "Tax" that Congress has the power to enact, he has moved it from the normal bills that are subject to philabustering requiring a 2/3 majority to shut down to a fiscal bill that according the Congressional rules cannot be subject to philabustering thus meaning that the Obamacare law now only requires a 51 Senate vote and a simple majority in the House to repeal it, he has opened the door to quick and easy repeal by Congress. At the same time he has

removed SCOTUS from the issue of declaring the health care law totally Constitutional or un-Constitutional. Congress (Republicans now have the ability to repeal this atrocity and leave SCOTUS's ruling a moot point. Congress can always, depending on the party elected to be in power, initiate new taxes or repeal obscene taxes as always. It is therefore the responsibility of the informed voter to support the candidates who will oppose any such monstrous travesty of law. Nothing has changed in this matter. As to the mandated purchase of this "insurance," once it is repealed the issue of mandated purchase or behavior by the imposition of taxes can be argued again and more easily defeated by a simple majority or overturned in the same manner. Roberts "protected the Court" by this apparent betrayal and left open the option of future clarification and reversal. Comment by USARogue 9 hours ago Alan, Thank you again. Your insight is always helpful. Well, I have read over 25 different articles and blogs regarding this atrocity and all it's done is just infuriate me more. This is an affront to our Constitution and strips Federalism

from any further discussion. Dual sovereignty was stripped in the SB 1070 decision and now Roberts has raped it of any fundamental meaning via Obamacare. So, what are we to do? Well we have options. We can just accept it and allow the Federal government to continue its Machiavellian expansion. We can whine and complain about what a liar Obama is and what a traitor Roberts is. We can use the blame game like Obama does repeatedly. Or, we can do something about it. I have to admit I sat in stunned silence as the decision was given today. There were 16 people at my place this morning, mostly family, friends and TEA Party members. We had cautious optimism until we heard the results. The frustration was palpable. After a lengthy session of profanity laced screams and rants we all finally settled down. After verifying what we thought was decided we began our plan of attack. We put together our game plan. We called our Representative and made an appointment to meet with her next week. We reviewed our State and Local election possibilities. Two of us started to plan our groups to canvas neighborhoods. Three of us began vetting assignments for our members for all our candidate possibilities. Everybody else began looking up scheduled town hall meetings for the various candidates. Finally we collected a very sizable contribution to send to Romneys campaign. One of many Im sure. The gauntlet has been laid down my fellow TEA Party members. Regardless of your position on Romney, we have 131 days to strengthen the majority in the House, retake the Senate and most importantly remove the cancer trespassing in our White House. If this insult to our intelligence doesnt motivate us, nothing will. We have been blatantly lied to that this wasnt a tax and the Supreme Court legislated from the bench in the most reprehensible way. Our last and most pwerful weapon, our vote, must be used on November 6, if not we can all watch our great nation gasp its last breath. 2010 MUST be repeated, on steroids!
