A statement of the Ministry Privacy refers to the observations during a meeting with your Board Data on 13 January. and letter from Home Ofce dated. 13th January 2012 regarding the draft specic arrangement of Iceland and the United States in connection with the passport of freedom between the two countries. The draft includes Iceland and the United States grant each other access to information on individuals considered to be related to terrorism, cf. First Article. II. chapter. Given the bear draft entitled "Arrangement [...] for the Exchange of Terrorism Screening Information". It is specically requested in a letter to the ministry Privacy takes a position on the provision of the draft statement on the limitation of the right to information of individuals. Dened in the rst Article. It lays down the prohibition on transfer of personal data to countries that do not provide adequate protection of such information, but the United States is among them. In 30th Article. is allowed for exemptions from the prohibition question. In this respect, is rstly noted that the draft is not a contract but "regime" (a "Arrangement") that do not have any legal force, cf. these provisions are second Article. IX. section of the draft. Would, however, the contract would still look to the abovementioned Framework Decision no. 2008/977/JHA. In 13th Article. it shows that either you legal authority to stand for such transfer of personal data or available to the recipient to provide adequate protection of personal data (the third State or receiving international body Provider Safe Guards-which are deemed adequate by the Concerned Member State according to its national law). The above implies that before the transfer could occur, would have been satised that the recipient provide information sufcient protection.
