END-USER LICENSE AGREEMENT FOR HALO IMPORTANTREAD CAREFULLY: This Microsoft End-User License Agreement (EULA) is a legal agreement

between you (either an individual or a single entity) and Microsoft Corporation for the Microsoft software product identified above, which includes computer software and may include associated media, printed materials, and online or electronic documentation (SOFTWARE PRODUCT). The SOFTWARE PRODUCT also includes any updates and supplements to the original SOFTWARE PRODUCT provided to you by Microsoft. Any software provided along with the SOFTWARE PRODUCT that is associated with a separate end-user license agreement is licensed to you under the terms of that license agreement. By accessing or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not use the SOFTWARE PRODUCT; you may, however, return it to your place of purchase for a full refund. Software PRODUCT LICENSE The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold. 1. GRANT OF LICENSE. This EULA grants you the following rights: Applications Software. You may only install, access, and run (RUN) one copy of the SOFTWARE PRODUCT, or any prior version of the SOFTWARE PRODUCT for the same operating system, on a single personal computer, (COMPUTER) for your personal, noncommercial use. If not prevented by copy protection technology, the primary user of the COMPUTER on which the SOFTWARE PRODUCT is installed may make a second copy for his or her exclusive and personal noncommercial use on a portable computer. Editors. If the SOFTWARE PRODUCT contains a software Editor, or a software Editor is made available to you by Microsoft for use with the SOFTWARE PRODUCT, you may use the Editor only in conjunction with that content specifically identified in the documentation for use with the Editor. If no content files are identified, you may not use content or other files from the SOFTWARE PRODUCT with the Editor. You may reproduce and share files or scripts created with the Editor with friends or family on a non-commercial basis only. Microsoft does not grant you the right to sell or otherwise distribute files from the SOFTWARE PRODUCT in exchange for value. Storage/Network Use. If not prevented by copy protection technology, you may

also store or install a copy of the SOFTWARE PRODUCT on a storage device, such as a network server, used only to RUN the SOFTWARE PRODUCT on your other COMPUTERS over an internal network; however, you must acquire and dedicate a license for each separate COMPUTER on which the SOFTWARE PRODUCT is RUN from the storage device. A license for the SOFTWARE PRODUCT may not be shared or used concurrently on different COMPUTERS. Reservation of Rights. All rights not expressly granted are reserved by Microsoft. 2. MULTIPLAYER PLAY. This SOFTWARE PRODUCT may contain features that allow you to play the SOFTWARE PRODUCT with other players over a network or the Internet (Multiplayer Play). By using such features or otherwise engaging in Multiplayer Play, you agree that Microsoft or its agents may generate, store and transmit certain information that identifies your COMPUTER to other computers for purposes of Multiplayer Play. You also agree that the SOFTWARE PRODUCT may continue to generate, store and transmit such game information as necessary while engaged in Multiplayer Play. You agree that Multiplayer Play is not supervised or otherwise under the control of Microsoft or its agents. You acknowledge and agree that Microsoft and its agents have no control over or responsibility for your experience while engaged in Multiplayer Play, or any content or other information or data you may create, encounter or receive, including chat, while you are engaged in Multiplayer Play. You acknowledge and agree that Multiplayer Play may not be consistently available or operate error free, and that Multiplayer Play may be discontinued by Microsoft or its agents at any time without notice to you. 3. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS. Not for Resale Software. If the SOFTWARE PRODUCT is labeled Not For Resale or NFR, then, notwithstanding other sections of this EULA, your use of the SOFTWARE PRODUCT is limited to use for demonstration, test, or evaluation purposes and you may not resell, or otherwise transfer for value, the SOFTWARE PRODUCT. Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. Separation of Components. The SOFTWARE PRODUCT is licensed as a single product. Its component parts may not be separated for use on more than one COMPUTER. Trademarks. This EULA does not grant you any rights in connection with any

trademarks or service marks of Microsoft. Rental. You may not rent, lease, or lend the SOFTWARE PRODUCT. Support Services. Microsoft may provide you with support services related to the SOFTWARE PRODUCT (Support Services). Use of Support Services is governed by the Microsoft policies and programs described in the user manual, in online documentation, and/or in other Microsoft-provided materials. Any supplemental software code provided to you as part of the Support Services shall be considered part of the SOFTWARE PRODUCT and subject to the terms and conditions of this EULA. With respect to technical information you provide to Microsoft as part of the Support Services, Microsoft may use such information for its business purposes, including for product support and development. Microsoft will not utilize such technical information in a form that personally identifies you. Software Transfer. The initial licensee of the SOFTWARE PRODUCT may make a one-time permanent transfer of this EULA and SOFTWARE PRODUCT only directly to an end user. This transfer must include all of the SOFTWARE PRODUCT (including all component parts, the media and printed materials, any upgrades, this EULA, and, if applicable, the Certificate of Authenticity). Such transfer may not be by way of consignment or any other indirect transfer. The transferee of such one-time transfer must agree to comply with the terms of this EULA, including the obligation not to further transfer this EULA and SOFTWARE PRODUCT. Termination. Without prejudice to any other rights, Microsoft may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts. 4. UPGRADES. If the SOFTWARE PRODUCT is labeled as an upgrade, you must be properly licensed to use a product identified by Microsoft as being eligible for the upgrade in order to use the SOFTWARE PRODUCT. A SOFTWARE PRODUCT labeled as an upgrade replaces and/or supplements (and may disable) the product that formed the basis for your eligibility for the upgrade. You may use the resulting upgraded product only in accordance with the terms of this EULA. If the SOFTWARE PRODUCT is an upgrade of a component of a package of software programs that you licensed as a single product, the SOFTWARE PRODUCT may be used and transferred only as part of that single product package and may not be separated for use on more than one COMPUTER. 5. COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and applets incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by

Microsoft or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the SOFTWARE PRODUCT is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. If this SOFTWARE PRODUCT contains documentation which is provided only in electronic form, you may print one copy of such electronic documentation. You may not copy the printed materials accompanying the SOFTWARE PRODUCT. 6. DUAL-MEDIA SOFTWARE. You may receive the SOFTWARE PRODUCT in more than one medium. Regardless of the type or size of medium you receive, you may use only one medium that is appropriate for your single COMPUTER. You may not RUN the other medium on another COMPUTER. You may not loan, rent, lease, or otherwise transfer the other medium to another user, except as part of the permanent transfer (as provided above) of the SOFTWARE PRODUCT. 7. COPY PROTECTION. The SOFTWARE PRODUCT may require the original media for use of the SOFTWARE PRODUCT on the COMPUTER and/or employ copy protection technology to prevent the unauthorized copying of the SOFTWARE PRODUCT. It is illegal to make unauthorized copies of the SOFTWARE PRODUCT or circumvent any copy protection technology employed in the SOFTWARE PRODUCT. 8. U.S. GOVERNMENT RESTRICTED RIGHTS. All SOFTWARE PRODUCT provided to the U.S. Government pursuant to solicitations issued on or after December 1, 1995 is provided with the commercial rights and restrictions described elsewhere herein. All SOFTWARE PRODUCT provided to the U.S. Government pursuant to solicitations issued prior to December 1, 1995 is provided with RESTRICTED RIGHTS as provided for in FAR, 48 CFR 52.227-14 (JUNE 1987) or FAR, 48 CFR 252.227-7013 (OCT 1988), as applicable. 9. EXPORT RESTRICTIONS. You acknowledge that the SOFTWARE PRODUCT is subject to U.S. export jurisdiction. You agree to comply with all applicable international and national laws that apply to the SOFTWARE PRODUCT, including the U.S. Export Administration Regulations, as well as end-user, end-use and destination restrictions issued by U.S. and other governments. MISCELLANEOUS If you acquired this SOFTWARE PRODUCT in the United States, this EULA is governed by the laws of the State of Washington. This Limited Warranty is void if failure of the SOFTWARE PRODUCT has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE PRODUCT will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. Detta licensavtal ger dig inga rttigheter till ngot varumrke som tillhr Microsoft. Uthyrning. Du har inte rtt att hyra ut, leasa eller lna ut PROGRAMVARUPRODUKTEN. Supporttjnster. Microsoft kan tillhandahlla supporttjnster fr PROGRAMVARUPRODUKTEN ("Supporttjnster"). om tillmpligt, kthetsbeviset). Sdan verltelse fr inte gras som en konsignation eller annan indirekt verltelse. Mottagaren av en sdan engngsverltelse mste acceptera villkoren i detta licensavtal, inklusive skyldigheten att inte verlta detta licensavtal och denna PROGRAMVARUPRODUKT vidare. Uppsgning. Du har ikke rett til leie ut, lease eller lne bort PROGRAMVAREPRODUKTET. Kundesttte. Microsoft kan tilby stttetjenester relatert til PROGRAMVAREPRODUKTET ("Kundesttte"). Bruk av Kundesttte er underlagt Microsofts regler og retningslinjer som er beskrevet i brukerhndboken, den elektroniske dokumentasjonen og/eller annet materiale levert av Microsoft. Frstegangsbrukeren av PROGRAMVAREPRODUKTET kan foreta n permanent overfring av denne LISENSAVTALEN og dette PROGRAMVAREPRODUKTET direkte til en sluttbruker. Denne overfringen m omfatte alle deler av PROGRAMVAREPRODUKTET (inkludert alle komponenter, medier og trykt materiale, eventuelle oppgraderinger, gjeldende LISENSAVTALE og, hvis det er aktuelt, Ekthetsgarantien). Slike overfringer skal ikke skje ved kommisjon eller annen indirekte overfring. Riippumatta vastaanotetun tietovlineen koosta tai tyypist asiakas saa kytt ainoastaan yht omaan TIETOKONEESEENSA soveltuvaa vlinett. Toista tietovlinett ei saa KYTT toisessa TIETOKONEESSA. Le prsent CLUF ne vous concde aucun droit relatif des marques de fabrique ou de service appartenant Microsoft. Location. Vous ntes pas autoris prter ou louer le produit logiciel. Services dassistance. Microsoft peut tre amen vous fournir des services dassistance relatifs au produit logiciel (les Services dAssistance ). Lutilisation desdits Services dAssistance est rgie par les rgles et programmes de Microsoft dcrits dans le manuel de lutilisateur, dans la documentation en ligne et/ou dans dautres documents fournis par Microsoft. Tout code logiciel supplmentaire qui vous serait fourni dans le cadre des Services dAssistance doit tre considr comme un lment du produit logiciel et est soumis aux termes du prsent CLUF. Ce transfert doit comprendre la totalit du PRODUIT LOGICIEL, y compris tous ses composants, les supports et la documentation imprime, toute mise niveau, le prsent CLUF et, sil existe, le Certificat dAuthenticit. Ce transfert ne doit pas tre effectu par le biais dun envoi ou de tout autre transfert indirect. Le bnficiaire de cet unique transfert doit accepter de se conformer aux termes du prsent CLUF, notamment en ce qui concerne lobligation de ne pas retransfrer le prsent CLUF et le produit logiciel. Si le Produit Logiciel est prsent comme une mise niveau, vous devez, pour lutiliser, tre titulaire dune licence approprie vous permettant dutiliser un produit identifi par Microsoft comme pouvant faire lobjet de cette mise niveau. Un PRODUIT LOGICIEL prsent comme une mise niveau remplace et/ou complte (et peut dsactiver) le produit qui a fond votre droit la mise niveau. Vous ne pouvez utiliser le produit mis niveau qui en rsulte quen conformit avec les termes du prsent CLUF. Si le produit logiciel est une mise niveau de lun des composants dun ensemble de logiciels que vous avez obtenus sous licence en tant que produit unique, il ne peut tre utilis et transfr quen tant que partie de cet ensemble de

logiciels et ne peut pas tre dissoci pour tre utilis sur plus dun ORDINATEUR. 5. DROIT DAUTEUR. Tous les droits de proprit et droits dauteur relatifs au produit logiciel (y compris, de manire non limitative, ceux affrents aux images, photographies, animations, lments vido ou sonores, musiques, textes et applets intgrs au PRODUIT LOGICIEL), la documentation imprime qui laccompagne et toute copie du produit logiciel, sont dtenus par Microsoft ou ses fournisseurs. Il prodotto (Prodotto SOFTWARE) include il software per computer e pu includere i supporti di memorizzazione a esso associati, il materiale stampato e la documentazione online o elettronica. Il PRODOTTO SOFTWARE contiene inoltre gli eventuali aggiornamenti e

componenti integrativi al PRODOTTO SOFTWARE originale fornito da Microsoft. Qualsivoglia software fornito con il PRODOTTO SOFTWARE e associato a un Contratto di Licenza con lUtente Finale distinto viene concesso in licenza allutente in conformit alle condizioni del suddetto Contratto. In caso di accesso a o altro utilizzo del PRODOTTO SOFTWARE, l'utente accetta di essere vincolato dalle condizioni del presente Contratto. Qualora lutente non accetti le condizioni del presente Contratto, dovr restituire prontamente al Rivenditore il Contratto stesso e il prodotto con i relativi documenti e materiali. LICENZA PER IL PRODOTTO SOFTWARE Il PRODOTTO SOFTWARE protetto dalle leggi e dai trattati internazionali sul copyright, oltre che da altre leggi e trattati sulla propriet intellettuale. Il PRODOTTO SOFTWARE non viene venduto, ma concesso in licenza. 1. CONCESSIONE DI LICENZA. Il presente Contratto concede allutente i seguenti diritti: Software Applicativo. L'utente pu installare, accedere ed eseguire ("ESEGUIRE") esclusivamente una (1) copia del PRODOTTO SOFTWARE, o una qualsiasi versione precedente dello stesso, per il medesimo sistema operativo, su di un unico computer ("COMPUTER") per utilizzo personale e non commerciale. Se non impedito dalla tecnologia di protezione delle copie, lutente principale del COMPUTER su cui installato il PRODOTTO SOFTWARE pu effettuare un'ulteriore copia ad utilizzo esclusivo personale e non commerciale dellutente su un computer portatile. Editor. Se il PRODOTTO SOFTWARE contiene un editor di software (Editor) o se da parte di Microsoft viene fornito un Editor da utilizzare con il PRODOTTO SOFTWARE, lutente sar autorizzato a utilizzare lEditor solo unitamente al contenuto specificatamente identificato nella documentazione come correlato allutilizzo con lEditor. Se non identificato alcun file di contenuto, lutente non potr utilizzare file di contenuto o altri file derivanti dal PRODOTTO SOFTWARE con lEditor. Lutente pu riprodurre e condividere file o script creati con lEditor con amici e/o familiari esclusivamente per fini non commerciali. Microsoft non concede allutente alcun diritto di vendita o distribuzione a scopo di lucro dei file dal PRODOTTO SOFTWARE. Memorizzazione/Utilizzo in Rete. Se non impedito dalla tecnologia di

protezione delle copie, lutente pu anche memorizzare o installare una copia del PRODOTTO SOFTWARE in un dispositivo di memorizzazione, quale un server di rete, utilizzato unicamente per ESEGUIRE il PRODOTTO SOFTWARE in altri COMPUTER in una rete interna; tuttavia, lutente tenuto ad acquistare e dedicare una licenza per ciascun singolo COMPUTER nel quale il PRODOTTO SOFTWARE viene ESEGUITO dal dispositivo di memorizzazione. Una stessa licenza per il PRODOTTO SOFTWARE non pu essere condivisa o utilizzata in concomitanza in COMPUTER diversi. Riserva di Diritti. Microsoft si riserva tutti i diritti non espressamente concessi nel presente Contratto. 2. MODALIT MULTIPLAYER. Questo PRODOTTO SOFTWARE pu contenere funzionalit che consentono di utilizzare il PRODOTTO SOFTWARE con altri giocatori in rete o su Internet (Modalit Multiplayer). Utilizzando tali funzionalit o altrimenti avviando il gioco in Modalit Multiplayer, lutente prende atto del fatto che Microsoft o i relativi agenti possano generare, memorizzare e trasmettere determinate informazioni per identificare il COMPUTER dellutente e distinguerlo dagli altri ai fini del gioco in Modalit Multiplayer. Inoltre, lutente prende atto del fatto che il PRODOTTO SOFTWARE possa continuare a generare, memorizzare e trasmettere tali informazioni di gioco ogniqualvolta risulti necessario durante il gioco in Modalit Multiplayer. Lutente acconsente al fatto che il gioco in Modalit Multiplayer non sia sottoposto alla supervisione o a qualsivoglia controllo da parte di Microsoft o dei relativi agenti. Lutente prende atto e acconsente al fatto che Microsoft e i relativi agenti non detengano alcun controllo n siano da ritenersi responsabili per il gioco in Modalit Multiplayer n per qualsiasi contenuto, dato o altra informazione che si pu creare o ricevere o in cui ci si pu imbattere, anche mediante chat, durante il gioco in Modalit Multiplayer. Lutente prende atto e acconsente al fatto che il gioco in Modalit Multiplayer non risulti sempre disponibile e perfettamente funzionante e che Microsoft o i relativi agenti abbiano la facolt di interrompere questa modalit di gioco senza preavviso. 3. DESCRIZIONE DI ALTRI DIRITTI E RESTRIZIONI. Software Etichettato Campione dimostrativo. Vietata la vendita. Qualora il PRODOTTO SOFTWARE rechi letichetta Campione dimostrativo. Vietata la vendita. o NFR (Not For Resale), lutilizzo del PRODOTTO SOFTWARE, nonostante quanto stabilito in altri articoli del presente Contratto, sar limitato esclusivamente allutilizzo ai fini di dimostrazione, prova o valutazione e lutente non sar autorizzato a rivendere, o altrimenti trasferire a titolo oneroso, il PRODOTTO SOFTWARE. Restrizioni sulla Decodificazione, sulla Decompilazione e sul

Disassemblaggio. Lutente non potr decodificare, decompilare o disassemblare il PRODOTTO SOFTWARE, con leccezione e solamente per quanto espressamente consentito, nonostante questa limitazione, dalla legge applicabile. Separazione di Componenti. Il PRODOTTO SOFTWARE concesso in licenza quale prodotto singolo. Le sue singole parti componenti non possono essere separate per l'utilizzo in pi di un COMPUTER. Marchi. Il presente Contratto non concede allutente alcun diritto relativo ai marchi registrati o marchi di servizio di Microsoft. Locazione. Lutente non pu concedere in locazione, in leasing o in prestito il PRODOTTO SOFTWARE. Servizio Supporto Tecnico Clienti. Microsoft in alcuni casi fornisce allutente un Servizio di Supporto Tecnico relativo al PRODOTTO SOFTWARE (Servizio Supporto Tecnico Clienti). Lutilizzo del Servizio Supporto Tecnico Clienti disciplinato dai piani e dai programmi Microsoft descritti nel manuale dellutente, nella documentazione online e/o in altro materiale fornito da Microsoft. Qualsiasi codice software supplementare fornito allutente nellambito del Servizio Supporto Tecnico Clienti sar considerato come facente parte del PRODOTTO SOFTWARE e soggetto alle condizioni del presente Contratto. Per quanto riguarda le informazioni tecniche fornite dallutente a Microsoft nellambito del Servizio Supporto Tecnico Clienti, Microsoft si riserva la possibilit di utilizzare tali informazioni per la propria attivit, compreso il supporto tecnico e lo sviluppo del prodotto. Lutilizzo da parte di Microsoft di tali informazioni avverr in modo tale da non consentire lindividuazione della persona dellutente. Trasferimento del Software. Il licenziatario iniziale del PRODOTTO SOFTWARE pu trasferire definitivamente e direttamente a propria discrezione il presente Contratto e il PRODOTTO SOFTWARE solo a un utente finale. Qualsiasi trasferimento deve comprendere tutto il PRODOTTO SOFTWARE (compresi tutti i componenti, i supporti di memorizzazione e il materiale stampato, qualsiasi aggiornamento, il presente Contratto e, se applicabile, il Certificato di Autenticit). Leventuale trasferimento non deve inoltre essere effettuato sotto forma di invio o spedizione, ovvero di altro trasferimento indiretto. Lutente finale al quale viene trasferito il PRODOTTO SOFTWARE deve acconsentire ad attenersi alle condizioni del presente Contratto, incluso lobbligo di non trasferire ulteriormente il presente Contratto e il PRODOTTO SOFTWARE. Risoluzione. Qualora lutente non si attenga alle condizioni del presente Contratto, Microsoft pu risolvere il Contratto stesso, senza per questo pregiudicare altri suoi diritti. In tal caso, lutente tenuto a distruggere tutte le copie del PRODOTTO SOFTWARE e tutte le sue parti componenti.

4. AGGIORNAMENTI. Se il PRODOTTO SOFTWARE riporta letichetta di aggiornamento (Upgrade), lutente, per poter utilizzare il PRODOTTO SOFTWARE, deve essere in possesso di una regolare licenza duso di un prodotto qualificato da Microsoft come idoneo a essere integrato da un aggiornamento. Un PRODOTTO SOFTWARE etichettato come aggiornamento sostituisce e/o integra (e pu disattivare) il prodotto che costituisce la base suscettibile di essere integrata mediante aggiornamento. Il prodotto finale aggiornato risultante dallintegrazione pu essere utilizzato solo in conformit alle condizioni del presente Contratto. Se il PRODOTTO SOFTWARE un aggiornamento di un componente di un pacchetto di programmi software concessi in licenza allutente come prodotto singolo, il PRODOTTO SOFTWARE pu essere utilizzato e trasferito solo come parte del pacchetto considerato prodotto singolo e non potr venire separato da questo per essere utilizzato su pi di un COMPUTER. 5. COPYRIGHT. I diritti e i copyright relativi al PRODOTTO SOFTWARE (ivi inclusi, in via esemplificativa, immagini, fotografie, animazioni, video, audio, musica, testo e "applet" integrati al PRODOTTO SOFTWARE), il materiale stampato accluso e qualsiasi copia del PRODOTTO SOFTWARE, sono di propriet di Microsoft o dei suoi fornitori. Il copyright e i diritti sulla propriet intellettuale relativi a contenuti cui lutente pu accedere mediante lutilizzo del PRODOTTO SOFTWARE sono di propriet dei rispettivi titolari e possono essere tutelati dal copyright o da altre leggi e trattati sulla propriet intellettuale. Dal presente Contratto non scaturisce alcun diritto a utilizzare tale contenuto. Se il PRODOTTO SOFTWARE contiene documentazione fornita esclusivamente in forma elettronica, lutente autorizzato a stampare una copia della suddetta documentazione elettronica. Lutente non potr riprodurre il materiale stampato accluso al PRODOTTO SOFTWARE. 6. SOFTWARE A DOPPIO SUPPORTO. Lutente potr ricevere il PRODOTTO SOFTWARE su pi di un supporto. Indipendentemente dal tipo o dal formato del supporto ricevuto, lutente autorizzato a utilizzare soltanto il supporto idoneo per il proprio singolo COMPUTER. Lutente non pu ESEGUIRE laltro supporto di memorizzazione in un altro COMPUTER e non pu prestare, concedere in locazione, in leasing o altrimenti trasferire laltro supporto di memorizzazione ad altro utente, se non come parte di un trasferimento definitivo (come sopra stabilito) del PRODOTTO SOFTWARE. 7. PROTEZIONE DELLE COPIE. Il PRODOTTO SOFTWARE pu richiedere il supporto originale e/o utilizzare una tecnologia di protezione delle copie per impedire la copia non autorizzata del PRODOTTO SOFTWARE. illegale effettuare copie non autorizzate del PRODOTTO SOFTWARE oppure eludere le tecnologie di protezione delle copie utilizzate nel PRODOTTO SOFTWARE. 8. RESTRIZIONI ALLESPORTAZIONE. Lutente prende atto del fatto che il

PRODOTTO SOFTWARE concesso in licenza soggetto alle limitazioni allesportazione vigenti negli Stati Uniti dAmerica. Lutente accetta di attenersi a tutte le leggi e le norme locali, nazionali e internazionali applicabili al PRODOTTO SOFTWARE, ivi incluso quanto enunciato nelle Export Administration Regulations degli Stati Uniti, come anche alle limitazioni applicabili al paese di destinazione, allutente finale e allutilizzo finale imposte dagli Stati Uniti e da altre autorit di controllo delle esportazioni. Garanzia di Microsoft. La presente garanzia non pregiudica i diritti riconosciuti dalla legge. La garanzia di seguito indicata non ha limitazioni territoriali e non pregiudizievole per i diritti riconosciuti dalla legge allutente nei confronti del rivenditore o di Microsoft qualora lutente abbia acquistato il Software direttamente da Microsoft. La garanzia Il Software progettato e offerto quale prodotto a scopo generale, e non progettato o offerto per scopi particolari dellutente. Lutente accetta che nessun prodotto software esente da errori e riconosce di essere stato specificamente avvisato della necessit di effettuare periodicamente il back up dei suoi file. A condizione che lutente abbia una licenza valida, Microsoft garantisce che a) il Software funzioner in sostanziale conformit con i materiali scritti ad esso acclusi per un periodo di 90 giorni dalla data in cui lutente riceve la licenza per utilizzare il Software o per il periodo minimo consentito dalla legge applicabile; e b) qualsiasi servizio di supporto fornito da Microsoft corrisponder sostanzialmente a quanto descritto negli applicabili materiali scritti forniti allutente da Microsoft e il personale tecnico di Microsoft porr in essere ragionevoli sforzi, ed user diligenza e professionalit per risolvere i problemi. Nel caso in cui il Software non sia conforme alla presente garanzia, Microsoft potr (a) riparare o sostituire il Software o (b) restituire il prezzo pagato dallutente. La presente garanzia non valida qualora il mancato funzionamento del Software dipenda da incidente, oppure

da abusivo o errato utilizzo. Qualsiasi prodotto software dato in sostituzione sar garantito per il periodo pi lungo tra 30 giorni e il periodo rimanente della garanzia originale. Lutente accetta che la garanzia di cui sopra la sua unica garanzia in relazione al Software e ai servizi di supporto. Esclusione di Tutte le Altre Condizioni Nella misura massima consentita dalla legge applicabile, e subordinatamente alla garanzia sopra indicata, Microsoft non riconosce alcunaltra garanzia o condizione, esplicite o implicite (siano esse derivanti dalla legge, dagli usi, da altre fonti, ovvero siano garanzie accessorie) comprese, a titolo esemplificativo, garanzie implicite di qualit soddisfacente e di idoneit per un fine particolare, sia in relazione al Software che ai materiali scritti acclusi al Software. Le garanzie implicite che non possono essere escluse sono comunque limitate al periodo maggiore tra 90 giorni e il periodo minimo consentito dalla legge applicabile. Limitazione di Responsabilit Nella misura massima consentita dalla legge applicabile, e fatto salvo quanto indicato nella Garanzia di Microsoft, Microsoft e i suoi fornitori non saranno responsabili per danni di qualsiasi tipo (ivi inclusi, a titolo esemplificativo, danni per perdita o mancato guadagno, interruzione dellattivit, perdita di informazioni commerciali o altre perdite pecuniarie) derivanti o comunque correlati allutilizzo o allincapacit di utilizzare il Software, anche nel caso in cui Microsoft sia stata avvisata della possibilit del verificarsi di tali danni. In ogni caso, la responsabilit complessiva di Microsoft in base alle disposizioni del presente Contratto non potr comunque eccedere limporto effettivamente pagato dallutente per il Software. Le presenti limitazioni non si applicano alle responsabilit che non possono essere escluse o limitate in base alle leggi applicabili. Legge regolatrice Il presente Contratto disciplinato dalle leggi dello Stato di Washington, USA. Qualora lutente abbia acquistato il Software nel territorio dellUnione Europea, in Islanda, in Norvegia o in Svizzera, troveranno applicazione le leggi dello Stato nel quale lutente ha acquistato il Software. CONTRATO DE LICENCIA PARA EL USUARIO FINAL DE HALO IMPORTANTE. LEA DETENIDAMENTE: este Contrato de Licencia para el Usuario Final (CLUF) de Microsoft constituye un acuerdo legal entre usted (sea persona fsica o persona jurdica) y Microsoft Corporation con respecto al producto software Microsoft indicado arriba, que incluye software de equipo y puede contener medios asociados, materiales impresos y documentacin en pantalla o electrnica (PRODUCTO SOFTWARE). El PRODUCTO SOFTWARE incluye tambin todas las actualizaciones y suplementos del PRODUCTO SOFTWARE original que Microsoft le proporcione. Todo software proporcionado junto con el PRODUCTO SOFTWARE que est asociado con un contrato de licencia para el usuario final independiente se le concede en licencia bajo los trminos de ese contrato de licencia. Al tener acceso o de otra manera utilizar el PRODUCTO SOFTWARE, usted queda obligado por los trminos de este CLUF. Si no acepta los trminos y condiciones del presente CLUF, no use el PRODUCTO SOFTWARE; sin embargo, puede devolverlo al lugar donde lo adquiri para obtener un reembolso total del importe pagado. LICENCIA DEL PRODUCTO SOFTWARE El PRODUCTO SOFTWARE est protegido por leyes y por tratados internacionales en materia de derechos de autor, as como por otras leyes y tratados sobre propiedad intelectual. El PRODUCTO SOFTWARE se otorga bajo licencia y no es objeto de venta. 1. OTORGAMIENTO DE LICENCIA. El presente CLUF le otorga los siguientes derechos: Software de aplicaciones. nicamente puede instalar, tener acceso y ejecutar (EJECUTAR) una copia del PRODUCTO SOFTWARE o cualquier versin anterior del PRODUCTO SOFTWARE para el mismo sistema operativo, en un nico equipo (EQUIPO) para su uso personal y no comercial. Salvo que lo impida la tecnologa de proteccin contra copia, el usuario principal del EQUIPO en que est instalado el PRODUCTO SOFTWARE podr hacer una segunda copia para su uso exclusivo y personal, no comercial, en un equipo o PC porttil. Editores. Si el PRODUCTO SOFTWARE contiene un Editor de software, o Microsoft le proporciona uno para que lo utilice con el PRODUCTO SOFTWARE, slo podr usar el Editor junto con el contenido identificado especficamente en la documentacin para su uso

con el Editor. Si no se identifican archivos de contenido, no puede utilizar los archivos de contenido ni de otro tipo del PRODUCTO SOFTWARE con el Editor. Puede reproducir y compartir archivos o secuencias de comandos creados con el Editor con sus amigos y familiares nicamente de forma no comercial. Microsoft no le concede el derecho de vender o distribuir de otra manera archivos del PRODUCTO SOFTWARE de forma onerosa. Almacenamiento y uso en red. Salvo que lo impida la tecnologa de proteccin contra copia, podr tambin almacenar o instalar una copia del PRODUCTO SOFTWARE en un dispositivo de almacenamiento, tal como un servidor de red, que se use slo para EJECUTAR el PRODUCTO SOFTWARE en sus otros EQUIPOS dentro de una red interna; sin embargo, usted deber adquirir y dedicar una licencia para cada EQUIPO distinto en el que se EJECUTE el PRODUCTO SOFTWARE desde el dispositivo de almacenamiento. No podr compartir ni usar simultneamente en diferentes EQUIPOS una licencia para el PRODUCTO SOFTWARE. Reserva de derechos. Microsoft se reserva todos los derechos que no se conceden expresamente. 2. JUEGO PARA VARIOS JUGADORES. Este PRODUCTO SOFTWARE puede contener funciones que le permitan jugar al PRODUCTO SOFTWARE con otros jugadores a travs de una red o de Internet (Juego para varios jugadores). Al utilizar dichas funciones o participar en Juego para varios jugadores, acepta que Microsoft o sus agentes puedan generar, almacenar y transmitir determinada informacin que identifique a su EQUIPO ante otros equipos para facilitar el Juego para varios jugadores. Asimismo acepta que el PRODUCTO SOFTWARE puede continuar generando, almacenando y transmitiendo la informacin de juego que sea necesaria mientras participa en el Juego para varios jugadores. Acepta que el Juego para varios jugadores no es supervisado ni controlado de ninguna manera por Microsoft ni por sus agentes. Reconoce y acepta que Microsoft y sus agentes no tienen control ni responsabilidad de sus actividades mientras participa en el Juego para varios jugadores, ni de ningn contenido u otra informacin o datos que pueda usted crear, encontrar o recibir, incluida cualquier conversacin, mientras participa en el Juego para varios jugadores. Reconoce y acepta que el Juego para varios jugadores no puede estar disponible ni funcionar coherentemente sin errores, y que Microsoft o sus agentes pueden dejar de prestar el Juego para varios jugadores en cualquier momento sin notificrselo previamente. 3. DESCRIPCIN DE OTROS DERECHOS Y LIMITACIONES. Software no para reventa. Si el PRODUCTO SOFTWARE lleva una etiqueta

que indica: No Para Reventa o NPR, no obstante otras secciones de este CLUF, la utilizacin del PRODUCTO SOFTWARE est limitada a su uso con fines de demostracin, prueba o evaluacin y usted no podr revender o de otra manera ceder por contraprestacin el PRODUCTO SOFTWARE. Limitaciones en materia de ingeniera inversa, descompilacin y desensamblaje. Usted no podr utilizar tcnicas de ingeniera inversa, descompilar ni desensamblar el PRODUCTO SOFTWARE, excepto y nicamente en la medida en que dicha actividad est expresamente permitida por la legislacin aplicable, a pesar de la presente limitacin. Separacin de componentes. El PRODUCTO SOFTWARE se otorga bajo licencia como producto nico. Sus partes componentes no pueden separarse para su utilizacin en ms de un EQUIPO. Marcas comerciales. Este CLUF no le concede ningn derecho en conexin con ninguna marca comercial o marca de servicio de Microsoft. Alquiler. Usted no puede alquilar, arrendar ni prestar el PRODUCTO SOFTWARE. Servicios de soporte tcnico. Microsoft podr prestar servicios de soporte tcnico para el PRODUCTO SOFTWARE (Servicios de soporte tcnico). El uso de los Servicios de soporte tcnico se rige por las normas y programas de Microsoft que se describen en el manual del usuario, en la documentacin en pantalla y/o en otros materiales proporcionados por Microsoft. Todo cdigo de software complementario que le sea proporcionado como parte de los Servicios de Soporte tcnico ser considerado parte del PRODUCTO SOFTWARE y estar sujeto a los trminos y condiciones del presente CLUF. La informacin tcnica que usted proporcione a Microsoft como parte de los Servicios de soporte tcnico podr ser utilizada por Microsoft con fines comerciales, incluso para soporte y desarrollo de productos. Microsoft no utilizar esa informacin tcnica de manera que lo identifique a usted personalmente. Cesin del software. El licenciatario inicial del PRODUCTO SOFTWARE puede hacer una sola vez una cesin de forma permanente de este CLUF y PRODUCTO SOFTWARE slo directamente a un usuario final. Esta cesin debe incluir todo el PRODUCTO SOFTWARE, incluidas todas las partes componentes, los medios y los materiales impresos, cualquier actualizacin, este CLUF y, en su caso, el Certificado de autenticidad (Certificate of Authenticity). Dicha cesin no puede realizarse mediante consignacin ni ninguna otra cesin indirecta. El receptor de esa nica cesin debe aceptar cumplir los trminos del presente CLUF, incluida la obligacin de no volver a ceder este CLUF y PRODUCTO SOFTWARE. Resolucin del CLUF. Sin perjuicio de cualquier otro derecho, Microsoft puede terminar el presente CLUF en caso de incumplimiento por su parte de los trminos y

condiciones del mismo. En dicho caso, usted deber destruir todas las copias del PRODUCTO SOFTWARE y todas sus partes componentes. 4. ACTUALIZACIONES. Si el PRODUCTO SOFTWARE est marcado como actualizacin, deber tener la licencia del producto identificado por Microsoft como apto para la actualizacin con el fin de poder usar el PRODUCTO SOFTWARE. Un PRODUCTO SOFTWARE marcado como actualizacin sustituye y/o complementa (y puede deshabilitar) al producto base de la actualizacin. Usted podr utilizar el producto actualizado resultante slo de conformidad con los trminos y condiciones del presente CLUF. Si el PRODUCTO SOFTWARE es actualizacin de un componente de un paquete de programas de software adquirido por usted en licencia como producto nico, el PRODUCTO SOFTWARE slo podr usarse y cederse como parte de dicho paquete de producto nico y no podr separarse para ser utilizado en ms de un EQUIPO. 5. DERECHOS DE AUTOR. Son propiedad de Microsoft o de sus proveedores la titularidad y derechos de autor con respecto al PRODUCTO SOFTWARE (incluyendo, pero sin limitarse a ello, imgenes, fotografas, animaciones, vdeo, audio, msica, texto y applets o subprogramas incorporados al PRODUCTO SOFTWARE), los materiales impresos que lo acompaan y toda copia del PRODUCTO SOFTWARE. La titularidad y los derechos de propiedad intelectual correspondientes al contenido al que se puede tener acceso mediante la utilizacin del PRODUCTO SOFTWARE son propiedad del respectivo propietario del contenido, y pueden estar protegidos por las leyes y tratados aplicables en materia de derechos de autor y propiedad intelectual. Este CLUF no le concede ningn derecho a utilizar dicho contenido. Si este PRODUCTO SOFTWARE contiene documentacin que se proporciona slo en forma electrnica, puede imprimir una copia de dicha documentacin electrnica. Usted no podr copiar los materiales impresos que acompaan al PRODUCTO SOFTWARE. 6. SOFTWARE EN MEDIO DUAL. Puede recibir el PRODUCTO SOFTWARE en ms de un medio. Independientemente del tipo o tamao del medio que reciba, usted slo podr usar el medio que sea apropiado para su EQUIPO nico. No podr EJECUTAR el otro medio en otro EQUIPO. No podr prestar, alquilar, arrendar ni de otra manera ceder el otro medio a otro usuario, excepto como parte de la cesin permanente (anteriormente prevista) del PRODUCTO SOFTWARE. 7. PROTECCIN CONTRA COPIA. El PRODUCTO SOFTWARE puede necesitar los medios originales para el uso del PRODUCTO SOFTWARE en el EQUIPO y/o emplear tecnologa de proteccin contra copia para impedir la copia no autorizada del PRODUCTO SOFTWARE. Es ilegal realizar copias no autorizadas del PRODUCTO SOFTWARE o circunvenir la tecnologa de proteccin contra copia empleada en el PRODUCTO SOFTWARE. 8. RESTRICCIONES EN MATERIA DE EXPORTACIN. Usted reconoce que

el PRODUCTO SOFTWARE est sujeto a la jurisdiccin de EE.UU en materia de exportacin. Acepta cumplir todas las leyes internacionales y nacionales aplicables al PRODUCTO SOFTWARE, incluidas las Normas de la Administracin de exportaciones de EE.UU., as como las restricciones de usuario final, uso final y destino emitidas por las autoridades de exportacin de EE.UU. y otros gobiernos. ESTIPULACIONES VARIAS Si este PRODUCTO SOFTWARE ha sido adquirido en Estados Unidos, este CLUF se regir por las leyes del Estado de Washington. Si este PRODUCTO SOFTWARE se ha adquirido fuera de los Estados Unidos, la legislacin local podr ser aplicable. Si tuviera alguna duda con respecto a este CLUF o si por cualquier motivo deseara ponerse en contacto con Microsoft, escriba a la subsidiaria que atiende a su pas o escriba en ingls a: Microsoft Sales Information Center/One Microsoft Way/Redmond, WA 98052-6399, EE.UU. Garanta de Microsoft. Salvaguarda de derechos legales. La siguiente garanta no se restringe a ningn territorio y no afecta a los derechos legales de que Vd. pueda ser titular frente a su revendedor, o frente a Microsoft si Vd. adquiri el Producto directamente de Microsoft. Garanta El Producto est diseado y se ofrece como producto con finalidad genrica, y no para la finalidad particular de ningn usuario. Vd. acepta que ningn Producto est libre de errores, y le recomendamos vivamente que haga copias de seguridad de sus archivos con regularidad. Siempre que Vd. tenga una licencia vlida, Microsoft le garantiza que a) durante el periodo de 90 das siguientes a la fecha en que Vd. reciba el Producto o durante el periodo mnimo exigido por la ley aplicable, el Producto funcionar sustancialmente de conformidad con los materiales escritos que lo acompaan; y b) cualquier servicio de soporte prestado por Microsoft ser prestado sustancialmente como se describa en los correspondientes materiales escritos que le facilite Microsoft, y los ingenieros de soporte de Microsoft emplearn su esfuerzo y diligencia razonables para solucionar cualquier problema. En el caso de que el Producto no cumpla con esta garanta, Microsoft se compromete a (i) reparar o sustituir el Producto gratuitamente, o bien (ii) devolverle el precio que Vd. pag. Esta garanta ser ineficaz si el fallo del Producto es resultado de un accidente, abuso o utilizacin incorrecta por parte de Vd. Cualquier Producto entregado en sustitucin de otro estar garantizado

durante el tiempo restante del periodo de garanta del Producto sustituido o, al menos, durante un periodo de 30 das. Exclusin de cualesquiera otras garantas Sin perjuicio de la garanta anterior, as como de cualesquiera garantas impuestas por normas imperativas establecidas en la ley aplicable, Microsoft excluye todas las garantas, condiciones y otros trminos, ya sean expresos, tcitos o implcitos (por normas dispositivas o la jurisprudencia, por analoga o de cualquier otro modo), tanto verbales como escritos, incluyendo entre otras las garantas implcitas de calidad satisfactoria e idoneidad para una finalidad particular, respecto del Producto y los materiales escritos que acompaan al Producto. Aquellas garantas implcitas que no puedan ser excluidas, tendr la duracin mnima exigida por la ley aplicable o, al menos, una duracin de 90 das. Limitacin de responsabilidad Sin perjuicio de lo previsto en la Garanta de Microsoft, as como de los supuestos en que la ley aplicable prohbe la exclusin de responsabilidad por daos, Microsoft y sus proveedores no sern responsables por los daos de cualquier naturaleza, salvo por dolo o negligencia grave, (incluyendo, entre otros, los daos por lucro comercial cesante, interrupcin de negocio, prdida de informacin comercial u otra prdida econmica) que se deriven del uso o imposibilidad de uso del Producto. En cualquier caso, la responsabilidad total de Microsoft derivada de cualquier disposicin del presente Contrato se limitar al importe que Vd. haya pagado efectivamente por el Producto. Estas limitaciones no sern de aplicacin a las responsabilidades que no puedan ser excluidas ni limitadas como consecuencia de la ley aplicable. Derecho aplicable. El presente Contrato se regir por las leyes del Estado de Washington (Estados Unidos de Amrica), salvo que Vd. haya adquirido este Producto Software en la Unin Europea, Islandia, Noruega o Suiza, en cuyo caso se aplicarn las leyes del pas en que Vd. haya adquirido el Producto Software. Si Vd. tiene cualquier duda en relacin con este CLUF o desea ponerse en contacto con Microsoft por cualquier otra razn, por favor, utilice la informacin sobre direcciones que se adjunta con este producto para ponerse en contacto con la filial de Microsoft que atiende a su pas o visite a Microsoft en la World Wide Web en http://www.microsoft.com. Si Vd. tiene cualquier reclamacin comprendida en el objeto de la presente garanta, por favor, enve a Microsoft una notificacin escrita a One Microsoft Way, Redmond WA 98052-6399 (EE.UU.), indicando la informacin

relevante para identificar este CLUF, la fecha de recepcin del Producto y el objeto de su reclamacin. Microsoft se pondr en contacto con usted en el plazo de siete (7) das hbiles siguientes a la recepcin de su notificacin escrita.
