I, MARK LINDQUIST, Prosecuting Attorney for Pierce County, in the name and by the authority of the State of Washington, do accuse DEVENNICE ANTOINE GAINES of the crime of MURDER IN THE SECOND DEGREE, committed as follows: That DEVENNICE ANTOINE GAINES, in the State of Washington, on or about the 15th day of April, 20 12, did unlawfilly and feloniously, with intent to cause the death of another person, cause the death of Bruce Price, a human being, on or about the 15th day of April, 2012, contrary to RCW 9A.32.050(l)(a), and in the commission thereof the defendant, or an accomplice, was armed with a firearm, to-wit: a handgun, that being a firearm as defined in RCW 9.41.010, and invoking the provisions of RCW 9.94A.530, and adding additional time to the presumptive sentence as provided in RCW 9.94A.533, and against the peace and dignity of the State of Washington. That DEVENNICE ANTOINE GAINES, in the State of Washington, on or about the 15th day of April, 2012, did unlawfully and feloniously, while committing or attempting to commit the crime of Assault in the Second Degree, and in the course of and in furtherance of said crime or in immediate flight

therefrom, caused the death of Bruce Price, a human being, not a participant in said crime, on or about the 15th day of Aoril, 2012, contrary to RCW 9A.32.050(l)(b), and in the commission thereof the defendant, 9.41 010, and invoking the provisions of RCW 9.94A.530, and adding additional time to the presumptive

DECLARATION FOR DETERMINATION OF PROBABLE CAUSE

Defendant. S.M. PENNER, declares under penalty of perjury: That I am a deputy prosecuting attorney for Pierce County and I am familiar with the police report andlor investigation conducted by the TACOMA POLICE DEPARTMENT, incident number 121060219; That the police report and/or investigation provided me the following information; That in Pierce County, Washington, on or about the 15th day of April, 20 12, the defendant, DEVENNICE ANTOINE GAINES, did commit the crimes of MLrRDER IN THE SECOND DEGREE and UNLAWFUL POSSESSION OF A FIREARM IN THE FIRST DEGREE. On April 15,20 12, at approximately 0430 hours, Tacoma Police officers were dispatched to a report of a shooting at 2302 Fawcett Avenue. When they arrived they found the victim, Bruce Price, laying in an alley, suffering from an obvious gunshot wound. Price suffered shots to his arms and chest. He was transported to St. Joseph's Hospital where he was pronounced dead from the gunshots. One of the shots had struck his heart. Witnesses were interviewed and provided officers with the following information: The victim, the defendant, and several other people were attending an "after-hours" party at the location. The defendant, later identified as DEVENNICE ANTOINE GAINES, got into an argument with another man, Tate, who was in a wheelchair. The argument led to blows. Shortly afterward, the group throwing the party either declared the party over and instructed everyone to leave, or at a minimum instructed GAINES to leave. As GAINES and others were walking toward the cars, Price and GAINES got into a verbal altercation. Price was criticizing GAINES for getting into a fight with a man in a wheelchair. GAINES was walking backward, facing Price. The two men were approximately five feet apart. GAINES then extracted a handgun from his waistband and fired several shots directly at Price. Price collapsed to the ground and GAINES fled the scene. Several witnesses were able to identify GAINES as the shooter, including one witness who selected GAINES from a photomontage. Additional witnesses identified GAINES as the man who got into the fight with the man in the wheelchair, who was then identified by several others as the shooter. GAINES is reportedly affiliated with a Blood street gang set from Seattle. Price and Tate were reportedly affiliated with a rival gang set, namely the Hilltop Crips.

GAINES has prior convictions for Manslaughter in the Second Degree, Assault in the Second Degree, and Attempted Robbery in the First Degree, all of which are "serious offenses" for the purposes of the Unlawful Possession of a Firearm statute. Rased on GAINES' criminal history, a conviction for count I and/or I1 in this case would result in GAINES being a "persistent offender" under RCW 9.94A.030(36) and facing a mandatory sentence of life in prison without the possibility of parole.
