The agreement was that Mrembo would not overdraw beyond 1 million on each cheque. Both were crossed not negotiable. On the first cheque, she indicated an amount of 6 million which she presented to the bank and was paid. On the second one, she indicate 3 million, but as she slept, it was stolen by Mwerevu her sister, who forged her signature, endorsed it to herself and cashed the cheque. He paid a deposit of Sh. 30,000 and the balance was payable by monthly instalments of Sh. 5,000. After paying instalments for seven months, he defaulted. Malipo Rahisi ltd.
