ENGAGEMENT CONTRACT
It is hereto agreed that the PURCHASER herby engages ARTIST and ARTIST hereby agrees to perform said engagement, and to be bound by all terms and conditions set forth herein. 1. 4a. Admission: Purchaser option

5. Time: Play between the hours of 7:00pm-9:30pm 6. Wage: Minimum $400 (FOUR HUNDRED DOLLARS) (a) All payments shall be paid in Cash/Check: (Check to be made payable to John Tomassones Brass From The Past) 7. Sound provided by: Artist 8. (a)Brass From The Past will split the gigmasters booking fee of 5% with the Purchaser and can be deducted from final payment

(b)Brass From The Past will supply I-Pod Music to be played during Cocktail Hour, Dinner Hour, and Breaks 11. ARTIST/LEADER: The person herein above as ARTIST shall at all times exercise complete supervision, direction, and control over the services of all personnel on this engagement and expressly reserves the right to control the manner, means and details of the performance of services to fulfill the entertainment requirement. ARTIST shall use all efforts to confirm to rules and policies of this establishment, and may be liable for penalties from above wages for flagrant abuse of said rules. (a) ARTISTS obligation hereunder are subject to prevention by sickness, accident, acts of God, labor disputes, or any other cause beyond control of ARTIST. If a performer is unavailable to perform, Leader shall arrange for a replacement. (b) Recording, reproduction, or transmission of ARTISTS performance is prohibited absent written consent by same. (c) ARTIST is not an employee of PURCHASER, and executes this contract as an independent contractor. 13. All rider(s) attached are herein made part of this contract. This agreement may not be changed or altered except by an instrument in writing by both parties. 14. Commencement of engagement is deemed to be an acceptance of all terms stated herein by PURCHASER and ARTIST. In the event of an unsigned party to this agreement herein, such party will comply with all terms thereof. PURCHASER and/or ARTIST shall not have the right to transfer or assign this agreement to any third party.
