COMPLAINT
COMES NOW the plaintiff ANNA K. MARTIN, by and through her undersigned
counsel of record, and files this, her complaint for damages against the defendants and
respectfully shows the Court as follows:
RENEWAL ACTION
1.
This Complaint is a renewal action against these Defendants. The allegations are
essentially the same as those contained in a prior action in this same Court that was assigned
Civil Action File No. 2:11-cv-00063RWS. That action was voluntarily dismissed without
prejudice by stipulation of the parties. The former action was not void and was not dismissed on
its merits. This complaint is a valid action that may be renewed under O.C.G.A. 9-2-61. The
dismissal of the prior action was entered on the court's records on October 5, 2011. All costs
have been paid and this action is being renewed within six months.

PARTIES AND JURISDICTION
2.
Plaintiff Anna K. Martin (hereinafter "plaintiff') is a resident of Johnson County, Indiana
and is subject to the jurisdiction and venue of this Court.

Defendant Gainey Transportation Services, Inc. (hereinafter "defendant Gainey") is a for
profit corporation maintaining its principal place of business in Grand Rapids, Michigan.
Defendant Gainey is an interstate motor common and/or contract carrier doing business
throughout the state of Georgia, generally, and the northern district of Georgia, specifically and
is subject to the jurisdiction and venue of this Court pursuant to 28 U.S.C. 1332 and 1391.
Defendant Gainey may be served with a copy of the complaint and summons through its
president and chief executive officer, Harvey N. Gainey at 6000 Clay Avenue, S.W., Grand
Rapids, Michigan 49548.

Defendant Ace American Insurance Company (hereinafter "defendant Ace") is a
Delaware corporation, maintaining its principal place of business in Philadelphia, Pennsylvania,
which, at all times relevant to this action, conducted business within the state of Georgia and
provided public liability insurance on the tractor trailer unit owned and operated by Defendant
Gainey when the motor vehicle collision out of which this cause of action arises occurred, and it
is subject to the jurisdiction and venue of this Court pursuant to 28 U.S.C. 1332 and 1391.
Defendant Ace may be served with a copy of the complaint and summons through its registered
agent, Mark G. Irwin, 500 Colonial Center Pkwy #200, Roswell, Georgia 30076.

Jurisdiction in this action is proper pursuant to 28 U.S.C. 1332.

Venue is proper in this action pursuant to 28 U.S.C. 1391(a) and (c).
BACKGROUND

On or about February 26,2009, plaintiffwas occupying a tractor trailer unit parked in the
lot of the Pilot Travel Center, located at 5888 Highway 83, in Braselton, Georgia.

On this date at the same time, Larry Brogan, an employee of defendant Gainey, was
operating a tractor-trailer unit, owned and/or operated by defendant Gainey and covered under a
policy of liability insurance issued by defendant Ace, through the parking lot of the Pilot Travel
Center, located at 5888 Highway 83, in Braselton, Georgia, when he negligently collided with
the tractor-trailer unit that plaintiff was occupying.

The motor vehicle collision was proximately caused by Larry Brogan's negligence, and
as a foreseeable result of said negligence, plaintiff suffered serious bodily injury.

IMPUTED LIABILITY

Plaintiff realleges and incorporates herein the allegations contained in paragraphs
1 through 9 above as if fully restated.

At the time of the motor vehicle collision which is the subject of this action, Larry
Brogan was acting within the scope of his employment as a driver employed by defendant
Gainey.
12.
At the time of the subject collision, Larry Brogan was under dispatch for defendant
Gainey.
13.
At the time of the subject collision, Larry Brogan was operating his tractor-trailer unit on
behalf of defendant Gainey.
14.
Defendant Gainey is an intrastate or interstate motor carrier, and pursuant to federal and
state laws, is responsible for the actions of Larry Brogan in regard to the collision described in
this complaint under the doctrine of respondeat superior, lease liability, agency or apparent
agency.
COUNT 2
NEGLIGENT HIRING, TRAINING & SUPERVISION
15.
Plaintiff realleges and incorporates herein the allegations contained in paragraphs 1
through 14 above as if fully restated.

Defendant Gainey was negligent in hiring Larry Brogan and entrusting him to drive a
tractor-trailer.

17.
Defendant Gainey was negligent in failing to properly train Larry Brogan.
18.
Defendant Gainey was negligent in failing to properly supervise Larry Brogan.
19.
Defendant Gainey's negligence in hiring Larry Brogan and entrusting him with driving a
commercial vehicle and failing to train and supervise him properly was the sole and proximate
cause of the collision, and plaintiff s resulting injuries.
COUNT 3
DIRECT ACTION
20.
Plaintiff realleges and incorporates herein the allegations contained in paragraphs 1
through 19 above as if fully restated.
21.
Defendant Ace is subject to a direct action as the insurer for defendant Gainey pursuant
to O.C.G.A. 40-2-140 or its predecessor O.C.G.A. 46-7-12.1.
22.
Defendant Ace was the insurer of defendant Gainey at the time of the subject incident
and issued a liability policy to comply with the filing requirements under Georgia law for
intrastate transportation.
23.
Defendant Ace and defendant Gainey are subject to the filing requirements outlined in
O.C.G.A. 40-2-140 or its predecessor O.C.G.A. 46-7-12.1.

Defendant Ace is responsible for any judgment rendered against defendant Gainey up to
its policy limits of coverage.
COUNT 4
DAMAGES
25.
Plaintiff realleges and incorporates herein the allegations contained in paragraphs 1
through 24 above as if fully restated.
26.
As a direct and proximate result of defendants' negligence and breach of duty,
plaintiffhas suffered permanent, disabling and excruciatingly painful bodily injuries and
damages for which she has incurred medical expenses in an amount to be shown at trial, but in
excess of$119,003.29.
27.
As a result of defendants' negligence, plaintiff has incurred past medical expenses and
will continue to incur future medical expenses.
28.
As a result of defendants' negligence, plaintiff has been unable to work and has a claim
for past and future lost wages.
29.
Defendants' negligence is the sole and proximate cause of plaintiff s injuries.

WHEREFORE, plaintiff prays that she have a trial by jury on all issues and that she have
judgment against defendants as follows:
a. That plaintiff recover the full value of past and future medical expenses and past
and future lost wages in an amount to be proven at trial;
b. That plaintiff recover for physical and mental pain and suffering in an amount to
be determined by the enlightened conscience of a jury;
c. That plaintiff recover such other and further relief as is just and proper.
