Of the 2011-2012 term of the Boulder County District Court in the year 2012, the 20112012 Grand Jurors chosen, selected and sworn in the name, and by the authority of the People of the State of Colorado, upon their oaths, present the following described acts, all done contrary to the form of statutes in such case made and provided, and against the peace and dignity of the People of the State of Colorado, as stated in the counts attached hereto:

COUNT ONE That on or about September 30, 2011 to October 23, 2011, in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLiNE, a customer of Fast Cash, a pawnbroker, pawned tangible personal property, namely: gold, and unlawfully, feloniously, and knowingly gave false information regarding his ownership; in violation of sections 12-56-103(1) and 12-56104(5), C.R.S.

COUNT TWO That on or about September 30, 2011 to October 23, 2011, in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLINE, a customer of Fast Cash, a pawnbroker, pawned tangible personal property, namely: gold, and unlawfully, feloniously, and knowingly gave false information regarding his address; in violation of sections 12-56-103(1) and 12-56104(5),C.R.S.

COUNT THREE That on or about August 18, 2011 to September 16, 2011, in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLiNE, a customer of EZ Pawn, a pawnbroker, pawned tangible personal property, namely: gold, and unlawfully, feloniously, and knowingly gave false information regarding his ownership; in violation of sections 12-56-103(1) and 12-56104(5), C.R.S. COUNT FOUR That on or about August 18, 2011 to September 16, 2011, in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLINE, a customer of EZ Pawn, a pawnbroker, pawned tangible personal property, namely: gold, and unlawfully, feloniously, and knowingly gave false information regarding his address; in violation of sections 12-56-103(1) and 12-56104(5), C.R.S. COUNT FIVE That on or about May 11, 2011 to July 6, 2011, in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLINE, a customer of Mister Money, a pawnbroker, pawned tangible personal property, namely: gold, and unlawfully, feloniously, and knowingly gave false information regarding his ownership; in violation of sections 12-56-103(1) and 12-56104(5), C.R.S. COUNT SIX That on or about May 11, 2011 to July 6, 2011, in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLINE, a customer of Mister Money, a pawnbroker, pawned tangible personal property, namely: gold, and unlawfully, feloniously, and knowingly gave false information regarding his address; in violation of sections 12-56-103(1) and 12-56104(5), C.R.S. COUNT SEVEN That on or about June 28, 2011, in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLINE, a customer of Cash in a Flash, a pawnbroker, pawned tangible personal property, namely: gold, and unlawfully, feloniously, and knowingly gave false information regarding his ownership; in violation of sections 12-56-103(1) and 12-56-104(5), C.R.S. COUNT EIGHT That on or about June 28, 2011, in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLINE, a customer of Cash in a Flash, a pawnbroker, pawned tangible personal property, namely: gold, and unlawfully, feloniously, and knowingly gave false 3

information regarding his address, in violation of sections 12-56-103(1) and 12-56-104(5), C.R.S. COUNT NINE That on or about July 14, 2011 in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLiNE, a person who traded with a secondhand dealer unlawfully provided false information regarding his or her ownership of the secondhand property; in violation of section 18-13-114(6)(b), C.R.S. COUNT TEN That on or about July 1, 2011 in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLINE, a person who traded with a secondhand dealer unlawfully provided false information regarding his or her ownership of the secondhand property; in violation of section 18-13-114(6)(b), C.R.S. COUNT ELEVEN That on or about October 1, 2001 to October 23, 2011 in, or triable in, the County of Boulder, State of Colorado ADRIAN DAVID KLiNE unlawfully, feloniously, and knowingly obtained or exercised control over a thing of value, namely dental gold of unidentified deceased persons and Aspen Mortuaries, with the value of one thousand dollars or more but less than twenty thousand dollars, without authorization, or by threat or deception, and intended to deprive permanently of its use or benefit; in violation of section 18-4-401(1)(a),(2)(c), C.R.S.

The offenses charged in the indictment were committed in the following manner 1 Adrian David Kline, during the relevant time, lived at 198 Paloma Avenue in Brighton Colorado During the relevant time he was employed on a contract basis with Aspen Mortuaries located at 1350 Simms Street in Lakewood, Colorado. He worked as an embalmer. 2. On September 19, 2011, staff at EZ Pawn, a pawnshop in Longmont, Colorado called the Longmont Police Department to report that Adrian, David Kline was making suspicious pawns involving gold teeth Based on that report officers at the Longmont Police Department began investigating Adrian Klines pawn history. 3 By law pawnshops are required to report pawn activity/information to local law enforcement That information is collected in databases and is accessible to law enforcement personnel This is also true of secondhand dealers 4 When someone pawns an item of personal property at a pawnshop or secondhand dealer they are required to fill out a form verifying their name, address, ownership of the item,

length of ownership, and whether they found the property. A notice on the forms states that falsifying any of this information is a crime. 5. During the period of May 2011 through November 2011, it was determined that Adrian Kline sold dental gold to either pawnshops or secondhand dealers 17 times. 6. The pawn transactions involving dental gold are as follows: Fast Cash 1515 E. Bridge St., #2 Brighton, Colorado a. On September 30, 2011, Adrian Kline pawned 14k and 10k dental gold with a weight of 30.9 grams. He received $720.00 in this transaction. On the pawn slip he listed his address of 1006 2 nd Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for one year. b. On October 2, 2011, Adrian Kline pawned 10k dental gold and scrap gold with a weight of 11.7 grams. He received $200.00 in this transaction. On the pawn slip he listed his address of 1006 2 d Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for years. c. On October 7, 2011, Adrian Kline pawned 14k and 10k dental gold with a weight of 17.5 grams. He received $385.00 in this transaction. On the pawn slip he listed his address of 1006 2 nd Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for six years. d. On October 9, 2011, Adrian Kline pawned 14k dental gold with a weight of 17.3 grams. He received $385.00 in this transaction. On the pawn slip he listed his address of 1006 2 n Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for six years. e. On October 10, 2011, Adrian Kline pawned 10k dental gold with a weight of 3.5 grams. He received $60.00 in this transaction. On the pawn slip he listed his address of 1006 2nd Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for six years. f. On October 16, 2011, Adrian Kline pawned 14k dental gold with a weight of 22.4 grams. He received $535.00 in this transaction. On the pawn slip he listed his address of 1006 2 nd Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for three months. g. On October 23, 2011, Adrian Kline pawned 14k dental gold with a weight of 2.6 grams. He received $60.00 in this transaction. On the pawn slip he listed his address of 1006 2nd Ave Longmont, Colorado. a. On August 18, 2011, Adrian Kline pawned 14k dental gold (along with other miscellaneous jewelry items) with a weight of 12.3 grams. He received $185.00 in this transaction. On the pawn slip he listed his address of 1006 2 Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for years.. b. On September 16, 2011, Adrian Kline pawned 14k dental gold (along with other miscellaneous jewelry items) with a weight of 26.2 grams. He received $285.00 in this transaction. On the pawn slip he listed his address of 1006 2 Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for two months. Classic Gold 383 Main St. Longmont, Colorado (secondhand dealer a. On July 14, 2011, Adrian Kline pawned 14k and 10k dental gold. He received $809.00 in this transaction. On the ticket he listed his address of 1006 2u1( Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for 20 years. Chamberlain Coins 381 Main Street Longmont, Colorado (secondhand dealer) a. On July 1, 2011, Adrian Kline pawned dental gold (along with other miscellaneous jewelry items). He received $115.00 in this transaction. On the ticket he listed his address of 1006 2 nd Ave Longmont, Colorado, He indicated he did not find the dental gold and had owned it. Mister Money 333 East Bridge Street Brighton. Colorado a. On May 11, 2011, Adrian Kline pawned five pieces of dental gold with a weight of 20.65 grams. He received $235.00 in this transaction. On the pawn 2nd Ave Longmont, Colorado. He indicated slip he listed his address of 1006 he did not find the dental gold and had owned it for 20 plus years. b. On May 17, 201 1, Adrian Kline pawned 10k dental gold with a weight of 6.2 grams. He received $100.00 in this transaction. On the pawn slip he listed his address of 1006 2 d Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for one year. c. On May 26, 2011, Adrian Kline pawned 10k dental gold with a weight of 3.42 grams. He received $40.00 in this transaction. On the pawn slip he listed his address of 1006 2 Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for 20 plus years. d. On June 29, 2011, Adrian Kline pawned dental gold with a weight of 1.49 grams. He received $20.00 in this transaction. On the pawn slip he listed his

address of 1006 2 Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for two weeks. e. On July 6, 2011, Adrian Kline pawned dental gold with a weight of 8.27 grams. He received $115.00 in this transaction. On the pawn slip he listed his address of 1006 2 d Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for one month. Cash in a Flash 11520 W. Colfax Ave. Lakewood, Colorado b. On June 28, 2011, Adrian Kline pawned 14 k dental gold with a weight of 2.5 grams. He received $45.00 in this transaction. On the ticket he listed his address of 1006 2 Ave Longmont, Colorado. He indicated he did not find the dental gold and had owned it for 30 years. 7. Adrian Kline admitting to pawning the dental gold. In his first and second interview Adrian Kline told law enforcement that he retrieved this dental gold out of the trash at Aspen Mortuaries. The trash consisted of metal items recovered from cremated remains. He said that trash was placed in a dumpster outside of the business and had been thrown out along with other miscellaneous metal that was discarded by the business. He said some of the dental gold came from his step-father who was a dentist. Further, he stated he used his old address in Longmont so that Aspen Mortuaries would not find out he was selling the dental gold because he was embarrassed by his actions and wanted to protect Aspen Mortuaries. 9. In his third interview Adrian Kline told law enforcement that the dental gold did not go through the cremation process, but did come from Aspen Mortuaries. He declined to elaborate but did state the gold did not come from someones mouth. 10. Employee/owners of Aspen Mortuaries say that any dental gold that was left from the cremation process would have been put into a recycle bin. Items in that recycle bin are recycled and the money used to fund pro bono work on behalf of Aspen Mortuary. 11. When Adrian Kline would be called in for work at Aspen Mortuaries he would have been working alone. He would have had access to the crematorium and the room where the deceased are housed. 12. As part of the embalming process the mouths of the deceased are sewn shut. If any teeth had been removed from the bodies it would not be detectable to anyone after the embalming process. 13. Adrian Kline did not have permission or authority to take any items from the cremation recycle bin at Aspen Mortuaries.

14. Adrian Kline did not have permission or authority to remove any items from the bodies of the deceased persons at Aspen Mortuaries. 15. Dr. Lorenz, a forensic dentist, was shown the dental gold that was recovered from the pawnshops. In his opinion some of the dental gold recovered from the pawn shops could have gone through the cremation process. That gold appears to be melted down and the original shape changed. In his opinion most of the dental gold did not go through the cremation process. This opinion is based on the fact that the dental gold still had its original shape and he could see remnants of dental cement and porcelain attached to the dental gold. Some of the items appeared to have tool markings from a pair of needle nose pliers where the gold casing was removed from the porcelain. 16. During a search of Adrian Klin&s home a box was found under the kitchen sink. In that box was a pair of two pairs of pliers, a sanding block, tweezers, sandpaper, vise grips, gloves, and 10 pieces of possible dental gold.
