Under the Skilled Worker Visa category, depending on the circumstances, CIC decision process currently takes between 6 69 months. As the decision to migrate is one of the most important choices you will make in your life, it is important to ensure that you do everything necessary in order to maximize your chances of success. When you subscribe to the Premium Migration Service, you can rely on the extensive experience of a Certified Canadian Immigration Consultant. Your application will be professionally handled on your behalf, thereby making the application process as stress-free as possible. This is done by approaching the application process in stages and we are then able to avoid incurring unnecessary expenses, such as submission fees, until we are confident that your application has the best possible chance of success. Please refer to the attached contract for a complete description of the Premium Migration Service, including details on your rights and responsibilities, a breakdown of the various stages in the immigration process and an overview of the fees and charges associated with the process. 2 Premium Terms of Engagement


2.1 Introduction
Upon payment of the Premium Migration Service fee OR return of the signed Acceptance Form (provided at the last page of this document), it will be deemed that you have engaged the services of the Migration Consultant solely for the purpose of fully preparing and submitting your Canadian migration application (Application) within your nominated Visa Category to the appropriate immigration authorities including the Department of Citizenship & Immigration Canada (CIC), the Quebec Immigration Service (QIS) or provincial immigration authorities.

2.2 Visa Category


Visa Category: Skilled Worker The above Visa Category has been selected based on the answers you provided in our Eligibility Assessment and Interview. Therefore, the advice provided by your Migration Consultant will be relevant to the visa category and/or

option that you have selected. Upon reviewing your profile, the Migration Consultant may suggest alternative visa categories which could also suit your profile. However, the final decision as to which category to proceed under will remain with you.

2.3 Assigned Migration Consultant


Once your Premium Migration Service Fee is processed, Safira Sheikh is your assigned an initial Certified Canadian Immigration Consultant(CICC). Your assigned Migration Consultant will manage your visa application process and will act in accordance with the responsibilities set out in the Responsibilities Section below. Safira Sheikh CSIC M074200 is a Certified Canadian Immigration Consultants(CICC) registered with the Canadian Society of Immigration Consultants (CSIC) which is the regulatory body that authorises Migration Consultants to provide immigration advice for Canada. 2.4 Responsibilities of the Migration Consultant


Detailed Assessment - the Skilled Worker Visa has specific legal requirements that need to be fulfilled before a valid application can be made. We will assess your personal circumstances and advise you of any factors which may increase the likelihood of your application being successful. We will examine all the information which you provide us with and guide you on further steps. Pre-Application Stage - we will work in consultation with you to prepare your Skilled Worker visa application, monitor your progress and keep you informed as well as ensure that you obtain adequate documentary evidence to satisfy all the legal requirements. We will also assist you with completing the required application forms. Submission - we will draft representations and submit your application to the relevant immigration authorities, Citizenship and Immigration Canada (CIC) and/or the Canadian Visa Post, and/or Quebec immigration authorities, once we are satisfied that we have received and reviewed all the necessary documentation. Processing Period - during this time, your application will go through several stages such as acknowledgement of receipt, allocation of a reference number, possible interview and request of additional evidence. At each stage of the process we will guide you with efficient and accurate advice. This will ensure that your application is handled correctly and as swiftly as possible. The Decision - we will closely monitor your Skilled Worker Visa application until a decision on your case is taken by the immigration authorities. We will keep you updated and contact you as soon as we receive a decision. In addition, we will provide you with guidance and advice on the next steps.

2.5 Responsibilities of the Client


2.5.1 The Client must:

do all things reasonably requested by the Migration Consultant and/or Migration Expert(on behalf of the Migration Consultant) to assist the Migration Consultant to provide Services; provide accurate and authentic Information throughout the engagement period; inform the Migration Consultant if any of the information provided becomes inaccurate or incorrect; notify the Migration Consultant within 7 days of any change in contact details including email, telephone or address details; keep the terms of this letter confidential; pay for the Services and for any expenses including Harmonized Services Tax, (HST) as and when such payment is due; pay any fees (along with any bank fees and HST) associated with any assessment that are payable to the assessing bodies prior to the submission of the Application, when instructed to do so, as required.

2.5.2 The Client agrees:

to respond to all requests for further information and/or documents as indicated below and within any other time frame specified by the consultant from time to time: s within two weeks of receiving written instructions requesting documentation; s at least one week before the deadline provided by CIC/QIS or other relevant government or assessing authority; that all services fees are deemed earned once paid and subject to the terms of termination outlined in this agreement; that Migration Expert and the Migration Consultant shall not be responsible for any loss arising from the Clients failure to respond to any requests for information and/or documents or any failure to provide information and/or documents which may affect the Clients application; that if any requests for additional information or documentation are not answered over a period of two (2) months, it will be considered that the client has defaulted under the terms of this agreement and the Migration Consultant is entitled to suspend the Clients file and no refund is payable for failure to continue with the application after this period.

2.6 Code of Conduct


Safira Sheikh employed with Migration Expert is licensed to provide Canadian immigration advice. He/she is therefore licensed to practice and is subject to the rules governing professional conduct. In accordance with the CSIC rules, the Migration Consultant will act on the Client's behalf in fulfilling all of its contractual and legal obligations to the best of its ability. However, the client acknowledges and agrees that and the Migration Consultant and Migration Expert cannot guarantee the success of any application.

2.7 Internal Complaint Procedure


We are committed to providing our clients with the highest standard of service. We treat all feedback on our performance as an opportunity to learn more about our clients' needs and to improve our service. We are committed to resolving all client complaints quickly and effectively. To ensure that we have an accurate account of your concerns, such complaints must be submitted in writing to any of our offices using the Client Feedback Form, which can be requested from any Migration Expert representative. We will acknowledge receipt of your Client Feedback Form within 1 business day of receiving it. In many instances, we have found that your assigned consultant will be able to help resolve your concerns. Upon receipt of the complaint, your assigned Migration Consultant will contact with you in the next 3 business days to acknowledge receipt and a review will be conducted and a response provided to the client within 10 15 days. Our commitment to our client is genuine. Should you be dissatisfied with the handling of your complaint, you are entitled to request your complaint be escalated to the next level within Migration Expert. Members failing to meet these obligations are subject to CSICs Complaints and Disciplinary provisions.

2.8 Fees associated with the Full Submission process


FEES PAYABLE TO MIGRATION EXPERT Premium Migration Service Fee The Service fee is payable in full upon acceptance of the terms outlined in this letter and deemed earned in full upon receipt. CANADIAN GOVERNMENT FEES* CIC Visa Application Skilled Worker CAD$150 for each dependant applicant under the age of 22 and is not a spouse or common-law partner. Right of Permanent Residence Fee The CIC fee for attaining permanent residency in Canada. CAD$490 for principal applicant, and accompanying spouse/partner applicant. The Application fee which is payable to CIC by you, upon submission of the Application. CAD$550 for principal applicant, and each applicant who is 22 years of age or older, or is under 22 years of age and is a spouse or common-law partner. US$3999

* The Client acknowledges that if the Application is submitted through the Quebec Immigration Service, additional government charges will apply.
*These fees are not required upfront. We will notify the Client when it is necessary to submit fees to the relevant government or assessing body. There are additional costs associated with your Application such as your medical examination, criminal clearance, and IELTS test (if applicable). These costs will be paid directly by you to the relevant individual or authority, as required. The Client acknowledges that the Migration Consultant will not be obliged to submit any application until the correct submission fees are provided. The Migration Consultant will confirm the cost of any application fees charged by CIC or the relevant assessment bodies prior to submission.

2.9 Expenses
InIn undertaking this assignment it may be necessary for you to incur expenses for items such as a translation service, language assessments, courier, and other expenses. These expenses, which are in addition to the specific fees mentioned above. At no time will we incur any out-of-pocket expenses on your behalf. The Migration Consultant may ask you to pay the provider directly for some of these out-of-pocket expenses as required for your visa application.

2.10 Harmonised Sales Tax (HST)


HST refers to any goods and services tax or similar tax imposed by the Government of Canada, under the federal taxation regime pursuant to Part IV of the Excise Tax Act. All amounts payable by the Client under this letter are expressed exclusive of HST. Accordingly, all amounts payable by the Client shall be at the rate stipulated in this letter plus any amount of HST payable. The current rate of HST is 13%. If you are currently residing outside Canada, you will not be required to pay the HST on the purchase price of the Premium Migration Service.

2.11 Reliance on Information, Release and Indemnity


The Client will provide the Migration Consultant and/or Migration Expert(on behalf of the Migration Consultant) with such information and documentation as advised is appropriate for this engagement. The Client recognises and confirms that the Migration Consultant will use and rely on information provided by them in the performance of the services contemplated by this letter, without having independently verified or assumed responsibility for the accuracy or completeness of such information. The Client warrants that all information and documentation provided to date is accurate and not false or misleading.

To the greatest extent possible by law, Migration Expert and the Migration Consultant shall not be liable for any loss, damage, cost, expense or other liability (Liabilities) suffered or incurred by the Client or their family arising in connection (either directly or indirectly) with the provision of the Services. To the extent that liability cannot be excluded, the liability of the Migration Consultant, Migration Expert, including its directors, officers, employees, and consultants is limited to the cost of the services provided to the Client. The Client shall make no claim and shall ensure that no member of their family shall make any claim against the Migration Consultant, Migration Expert, any of its related companies, or any of their directors, officers, employees or consultants (Indemnified Persons) to recover any liability which the Client may suffer or incur by reason of or arising out of anything done or omitted in relation to the provision of the Services (Claim). The Client undertakes with the Migration Consultant, Migration Expert (for itself and as trustee for each of the other Indemnified Persons) to indemnify and hold harmless the Indemnified Persons against all liabilities and Claims (including legal costs on a full indemnity basis) incurred by the Indemnified person in connection (either directly or indirectly) with the provision of the Services except the liability which arises from the negligence or default of any of the Indemnified Persons.

2.12 Client Communications


The Client acknowledges that from the date of engagement and throughout the entire agreement, the primary source of communication with and the Migration Consultant and Migration Expert will be through the Client Area of http://www.migrationexpert.com. The Client consents to receiving communications from the Migration Consultant and Migration Expert electronically and agrees that all agreements, notices, disclosures and other communications provided to the Client electronically satisfy any legal requirement that such communications be in writing.

2.13 Privacy and Release of Information


Migration Expert and the assigned Migration Consultant are bound by the relevant privacy legislation. Accordingly, we take reasonable steps to protect personal information (as defined under the Privacy Act) collected by Migration Expert from misuse and loss and from unauthorised access, modification or disclosure. We may use and disclose the Client's (and if applicable, their family's) personal information for the primary purpose for which it is collected, for reasonably expected secondary purposes which are related to the primary purpose and in other circumstances authorised by the Privacy Act. In general, we will disclose the Client's personal information for the following purposes:

to conduct their business, including billing and account management; to provide and market their Services; to communicate with the Client; to comply with their legal obligations; and to help them manage and improve their Services.

We may disclose the Client's personal or sensitive information (as defined in the Privacy Act):

to assessment bodies on a confidential basis; to regulatory authorities (such as the CIC); where the law requires them to do so; and where the Client consents for them to do so.

Subject to the exceptions set out in the Privacy Act, the Client may gain access to the personal information which Migration Expert holds about them by contacting their Privacy Officer on privacy@migrationexpert.com. You may also request that information about you be corrected if you think it is not accurate. A fee may be charged for providing access and Migration Expert will advise the Client of the likely cost in advance.

2.14 Governing Law and Jurisdiction

The agreement is created upon receipt of the signed attached Acceptance Form OR payment of the service fee, and shall be governed by, and interpreted and construed in accordance with, the laws of Ontario. The Courts of Ontario shall have exclusive jurisdiction to settle any and all disputes (including claims of set-off and counterclaims) in connection with this Agreement.

2.15 Period of Engagement


It is difficult to predict the time taken to complete the Services as this will be largely dependent on the time taken for the CIC to make their decision on the Client's application to migrate. Migration Consultant takes no responsibility for any delay in CIC's processing of the application. The period of engagement is from the date that Migration Expert receives the signed attached Acceptance Form OR payment of the Services fee, on behalf of the Migration Consultant whichever occurs first. The engagement ceases upon the completion of the Services, unless the agreement is terminated earlier pursuant to the terms set out in this agreement.

2.16 Engagement Terms


Upon receiving payment or your signed Acceptance Form, the assigned Migration Consultant will agree to act on your behalf only where it is believed that your visa application to Canada has a favourable chance of success, as based on responses in both the Migration Expert Eligibility Assessment and Migration Interview (found at http://www.migrationexpert.com).

2.17 Termination
The Client may terminate this agreement by giving notice at any time. The Migration Consultant may terminate this agreement by giving at least 14 days notice in writing or immediately if the Client is in default of the terms of this letter. No refund is provided in instances where the Client is in default of the terms set out in section 2.5.2. The Client agrees that the service fees are earned in full upon receipt. However, if terminated, the following portion of fees shall be retained according to the completed stage:
Upon engagement (payment) - non refundable retainer Upon completion of Stage 1 - Detailed Assessment Upon completion of Stage 2 Pre-Application 20% 60% 85%

Upon completion of Stage 3 - Application Submission to Immigration Authorities 100%

In circumstances where it is apparent to the Migration Consultant, upon reviewing the Information at the commencement of the agreement, that the Client's prospects of success are not favourable, the Migration Consultant will advise the Client immediately and ask the Client if they wish to proceed. If the Client does not wish to proceed or if this agreement is otherwise terminated prior to the completion of the relevant stage, the Client's refund will take into account for the time and expenses incurred up until and including the agreed date of termination at the rate of US$250.00 per hour of work. Please note that any refunds (in accordance with the amounts set out above) will have a US$29 processing fee deducted. All work performed for the Client by the Migration Consultant, Migration Expert and its directors, officers, employees and consultants will be in accordance with this letter of engagement or any subsequent written variation made available to the client.

2.18 The Agreement


The terms of the letter of engagement sets out the entire agreement between the Client, the Migration Consultant and Migration Expert in connection with the engagement.

The Client acknowledges that they have read and understood the terms of this letter and that they have had the opportunity to seek and obtain independent legal advice. No person has been authorised to give any representations on behalf of the Migration Consultant and Migration Expert in regard to the subject matter or the terms of the letter of engagement, and such any representations which have been or may be given shall not be relied upon, and thus are void. The Migration Consultant and Migration Expert may vary any of these terms at any time and any other information relating to the Service, at any time and your subsequent use of the Services will be governed by the varied Terms. In the event that any of the terms of provisions of the letter of engagement are or shall become invalid, illegal or unenforceable, the remainder shall survive unaffected.

2.19 Acceptance of Terms


If you have read, understood and are in agreement with the arrangements detailed in this engagement letter, please return, the attached Acceptance Form signed by you and family members over 18 years of age. The Client is deemed to have signed on behalf of any dependants for whom the Client wishes the Migration Consultant to provide Services. Upon receipt of the Acceptance Form, the Migration Consultant will counter-sign the Acceptance Form. Please return the signed Acceptance Form to Migration Expert on behalf of the Migration Consultant within 14 days of the date of this agreement (after which time this offer may lapse).
