Terms and Conditions

1. The MamyPoko Pants Click, Share & Win initiative is brought to you by Unicharm (Organizers) and the Initiative ends on 10th January, 2012 (Period) 2. Participation is optional and purely voluntary. 3. Initiative is open to all Indian residents across all age groups except employees and the family members of Organizers, its associate companies, its Advertising and Promotional Agencies and its Auditors. 4. In order to participate in the Initiative the participant will have to log on to Organizers official presence on social media platforms like Facebook, Twitter or YouTube. 5. The participant will have to Like the Facebook page of the organizers [www.facebook.com/mamypokopantsindia] to proceed with the Initiative. 6. One Participant can participate in any number of competitions during the Period but in each competition he/she is allowed to make only one entry. In the event that a Participant makes multiple entries, the Organizers shall be at the liberty to choose any one for judging the Participant. 7. All entries received between the Period will be judged by an independent panel of judges as constituted and deemed fit by the Organizers. 8. The judging will be done on the following parameters: (i) Funny (ii) New/fresh (iii) Affection for the baby and ability to express it in a lucid yet creative manner. 9. The name of the winner(s) will be announced on the official social media identities of the Initiative as deemed fit by the Organizers. 10. The winners will be contacted at the contact information provided by them on the given e-mail id. Maximum of three attempts will be made to contact the winners at the contact details and in the event the winners are not contacted, the Organizers reserve the right to withdraw the same or pass it on to the next winner as may be deemed fit from time to time. 11. The Participant agrees to only send across Text/Image/Video that you have taken yourself or that you have all rights to transmit and license and which do not violate trademark, copyright, privacy or any other rights of any other person. The Organizers will not be liable for any damages/ infringement clause/ any other indemnity arising out of irreverent upload(s) done by the Participant whatsoever.

12. It is strictly prohibited to dispatch any kind that contain expressions of hate, abuse, offensive images or conduct, racism, communal, caste, creed, obscenity, pornography, sexually explicit or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions, the Advertising Code in the Cable and Regulation Rules 1995. The Organizers will not be liable in any such event whatsoever. 13. The Participant agrees that the Participant will not share any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or this Website or the social media platforms. Such attempt/ act will clearly attract prosecution proceedings by appropriate authorities and the Organizers will not bear any responsibility of the same. 14. By sending across any media like a photo or video, (a) the Participant grants to the Organizer a perpetual, non-exclusive, worldwide, royalty-free license to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in the media; and (b) the Participant certifies that the baby/mother pictured in the submitted media (in case of baby, his/her parent/legal guardian) authorizes the Organizers to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in such media; and (c) the Participant agrees to indemnify the Organizers and its affiliates, directors, officers and employees and hold them harmless from any and all claims and expenses, including attorneys' fees, arising from the media and/or your failure to comply with these the terms described in this document. 15. All Participants participating in this Initiative agree to provide such information as the Organizers may require from time to time. 16. Organizers reserves the right to cancel, modify, extend or withdraw the Initiative at its sole and absolute discretion as and when it may deem fit. 17. Decision of Organizers will be final and binding with regard to Initiative and prizes and no correspondence will be entertained in this regard whatsoever. 18. Prizes are not transferable. 19. The Organizers do not take any responsibility of the proper functionality and condition of the prizes on offer under this Initiative and the Participant fully agrees to this. The Organizers will entertain no correspondence in this regard. 20. The prizes of offer under this Initiative bear the trademarks and ownership of the respective manufacturers and the Organizers will entertain no communication in this regard. 21. Organizers shall be at liberty to use the photographs, voice, motion pictures of the winner for media coverage, advertisement or publicity in any form which is existing today or will be known anytime in the future without any further consideration to the winner.

22. Winners will have to bear incidental costs, if any, that may arise for redemption of the prize. 23. Organizers shall not be responsible for any loss, injury or any other liability arising out of the Initiative. 24. Organizers shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss. 25. Organizers shall not be liable for any loss of prize due to incorrect address or any other information provided by the winner and no communication shall be entertained in this regard. 26. Incomplete entries (name/address/telephone) will not be considered for the prize. 27. All taxes/levies and charges on prizes will be the responsibility of the winner. Taxes or any other form of commercial implication (if any) as applicable will be deducted at the source for all prizes or will be accrued on the Participant as may be deemed fit by the Organizers on a case to case basis. 28. By participating in this Initiative the Participant is automatically agreeing in absolute sense to one and all of the mentioned terms and conditions. 29. All disputes are subject to the jurisdiction of the city of New Delhi, Country India.
