A Message from the Board Chair and Executive Director

Protecting and expanding access and opportunities for women and girls: this is the work of Equal Rights Advocates. Whether ensuring a woman is paid the same sport, or fighting on behalf of millions of retail workers nationwide, Equal Rights Advocates staff responds on a daily basis to womens most acute legal needs. This year, we celebrated our 37th Anniversary with milestones such as representing our clients at the Supreme Court of the United States, awarding the first round of grants to female athletes from the University of California, Davis as part of the Women in our Advice and Counseling (A&C) hotline, and being named among the first cohorts of the Pioneers in Justice initiative by the Levi Strauss Foundation. These remarkable events shape the vision for our work. Equal Rights Advocates works to meet the legal needs of women and girls discriminated against simply due to their sex in an effort to achieve equality. Inequality diminishes both women and men. We believe it is time to recognize that discrimination against women has consequences of a magnitude similar to human rights violations. The meaningful availability of legal counselwhether in the form of advice or representationto assist women experiencing unequal treatment is the difference in achieving equal justice under law. We hope you will join us in our effort to make equal rights a reality.

Equality for Women at School


In October 2010, Equal Rights Advocates hosted a reception to honor the University of California, Davis (UC Davis) sports teams awarded grants from the Women in Sports Equity (WISE) Fund. The WISE Fund is administered by the Womens Foundation of California. The Fund originated from the successful settlement of Brust v. Regents of the University of California, a case brought by Equal Rights Advocates, Equity Legal, and the Sturdevant Law Firm. The Women in Sports Equity (WISE) Fund is dedicated to supporting and developing women athletes at UC Davis. The purpose of the Fund is to support the development of female athletes at the club sport level by providing grants to selected female club teams and co-ed club teams for team-related expenses, such as coaching, training, equipment, uniforms or travel.

Case Update: Mansourian v. Regents of the University of California


Managing Attorney Noreen Farrell and her team represented plaintiffs over the past year in the continued litigation of this significant lawsuit. With co-counsel Equity Legal, The Sturdevant Law Firm, and Duckworth Peters Lebowitz Olivier LLP, Equal Rights Advocates represented plaintiffs who were female former wrestlers at UC Davis. Our clients allege unlawful discrimination for the elimination of the womens wrestling program at a time when UC Davis did not otherwise provide women with an equal opportunity to play sports. By eliminating the program, UC Davis did not comply with Title IX, the Federal law prohibiting sex discrimination at educational institutions that receive Federal funding.

To remain on the team, the women were told, they would have to win a place on ita move our attorneys described as unprecedented and unfair. The women would have to face Division I male wrestlers with superior strength and skill. Athletic endeavors empower young women and girls and provide opportunities that enable their continued success, both in school and in the workforce. Equal Right Advocates extends a special thanks to co-counsel and the American Association of University Women (AAUW) Legal Advocacy Fund for their financial support of our litigation efforts. The case proceeded to trial in U.S. District Court beginning May 2011.

Domestic Workers Demand Bill of Rights


Led by Staff Attorney Jora Trang, Equal Rights Advocates is an active member of the California Domestic Workers Rights Coalition. The Coalition consists of grassroots organizations that provide direct services to domestic workers and other marginalized workers. The Coalition drafted AB 889, the California Domestic Workers Bill of Rights (CDWBR) bill. The bill was introduced in the California legislature in February 2011. The bill raises awareness and recognition under California law of the needs and rights of domestic workers including workers compensation and other protections.

EQUAL PAY DAY


Each year, Equal Rights Advocates recognizes this event to illustrate the gap between mens and womens wages. In April, we hosted a panel discussion about pay inequity. Equal Rights Advocates joined the Equal Employment Opportunities Commission (EEOC) in a panel discussion at San Jose State University on the wage gap and how it impacts individuals, families, and communities.

INTERNATIONAL WOMENS DAY


Equal Rights Advocates celebrated the 100th Anniversary of International Womens Day by hosting an event featuring University of California, Santa Cruz Professor RosaLinda Fregoso. With Cynthia Bejarano, Professor Fregoso edited Terrorizing Women: Feminicide in the Americas, a book of essays by feminist and human rights activists, attorneys, and scholars from Latin America and the United States.

Equality for Working Families


Equal Rights Advocates is a leader in undertaking impact litigation to address issues affecting pregnant workers and to ensure proper interpretation of the law. We advocate for family-oriented workplace policies and support fair and equal treatment for working parents, caregivers and pregnant workers. Equal Rights Advocates co-sponsored California Senate Bill 299 (S.B. 299). Senator Noreen Evans (D-Santa Rosa) introduced the bill in February 2011. Staff attorney with client The bill would ensure that employer-provided health insurance coverage is continued for women on pregnancy disability leave. Staff Attorney Monali Sheth testified on behalf of Equal Rights Advocates at a hearing before the California Commission on the Status of Women explaining the importance of this benefit. Equal Rights Advocates also testified before both the Senate Labor and Judiciary Committees in support of the bill. Both Committees voted in favor of the bill. Equal Rights Advocates participated in the National Dialogue on Workplace Flexibility, an event in Pasadena hosted by the US Department of Labor Womens Bureau. Participants included 400 advocates, researchers, union leaders and government workers who demonstrated their commitment to achieving fair and high quality work-life environments and promoting workplace flexibility for all working women. Equal Rights Advocates is a proud member of the California Work-Family Coalition.

Equality for Marginalized Women Workers


Ruth Chance Law Fellow Nicole Marquez and Staff Attorney Jamie Dolkas collaborated with Restaurant Opportunities Center (ROC) of Los Angeles for Behind the Kitchen Door: Inequality and Opportunity in Los Angeles, The Nations Largest Restaurant Industry, a report on inequality and discrimination in the restaurant industry released in February 2011. Equal Rights Advocates reviewed drafts and provided feedback including the policy recommendations featured in the report. In Los Angeles, they conducted Know Your Rights trainings to restaurant workers on sex discrimination, sexual harassment and Californias Paid Family Leave law. Through our Advice & Counseling hotline, they help restaurant workers and organizations to identify incidents of harassment by managers or co-workers. Equal Rights Advocates continues to promote women in the trades at both the national and local level. We work closely with other organizations to monitor designated construction mega-projects and to ensure that contractors are hiring sufficient numbers of women for these projects as required by federal regulations. Throughout this year, our staff attended meetings with the Office of Federal Contract Compliance Programs (OFCCP) supervisors to develop a thorough reporting process and discuss the best ways for women to access job openings. We review the hiring numbers at each stage in the construction process to ensure the required percentage of women are hired. We work with other tradeswomens organizations to develop a national strategy surrounding the OFCCP regulations in order to increase the numbers of women represented in the trades and remove barriers to entry. Jamie was among the contributors to Poor, Pregnant and Fired: Caregiver Discrimination Against Low Wage Workers, a report released by the Center for WorkLife Law. The report profiles 50 cases of low-wage workers who experienced discrimination at work while balancing family and work responsibilities.

Dukes v. Wal-Mart Stores, Inc.


Case Update
March 29, 2011 was a historic day for the plaintiffs in Dukes v. Wal-Mart Stores, Inc. Equal Rights Advocates and co-counsel represented Betty Dukes and class members before the Supreme Court of the United States. Following oral argument, Alliance for Justice and the AAUW organized a rally outside the Court in support of the class members. Our thanks to Katz, Marshall & Banks, LLP in Washington, DC for hosting a reception for these courageous women who continue to fight for equal pay and opportunity.

advice & counseling


Equal Rights Advocates provides direct legal services to women across the country through our Advice & Counseling (A&C) program.
Established in the early 1980s, the programs centerpiece is a toll-free hotline providing assistance to callers. Through the use of a translation service, our staff can assist callers in more than 150 languages, ensuring non-native English speakers receive the same level of assistance as English-speaking callers. In 2010, Equal Rights Advocates conducted more than 350 intakes and provided 150 referrals. In addition to the toll-free hotline, Equal Rights Advocates educates women through the Know Your Rights bilingual brochure series. The four topics include family & medical leave, sex discrimination, sexual harassment, and sexual harassment in schools. Each brochure contains information about legal rights under law, concrete examples of discrimination, and suggestions for redress, including other organizational resources. As part of our public outreach, ERA provides Know Your Rights trainings to community organizations or unions on these topics.

Law clerks staff the Advice & Counseling hotline, interviewing callers and providing legal information regarding sex discrimination, sexual harassment, Title IX enforcement, and family and medical leave. Law clerks also research case law, draft and present memos to the legal staff, attend hearings, and participate in advocacy efforts. Law clerks committed more than 500 hours during the past fiscal year. We extend a special thanks to the following law students who clerked at Equal Rights Advocates.
