ASSIGNMENT 1

Answer all questions and name the relevant regulations for each question.

1. Describe and compare the Factory and Machinery Act (FMA) 1967 and the Occupational Safety and Health Act (OSHA) 1994. FMA 1967 DESCRIPTION FMA 1967 was legislated to overcome the weaknesses in the Machinery Ordinance 1953. This act declares that if the workers are working in a workplace that does not use machinery, the workers are not protected. This is the limitation of this act. OSHA 1994 OSHA 1994 was legislated to overcome the weaknesses in the FMA 1967. The purpose of this act is to promote and encourage occupational safety and health awareness among the workers. This act is also proposed to create organization along with effective safety and health measures. OBJECTIVES - Factories operations are controlled with respect to health, safety and welfare of the persons. -To secure the safety, health and welfare of person at work. - To protect persons at a workplace

- Machinery registration and inspection. instead of the workers. - To promote occupational environment adapted by the persons. SCOPE Only covers in the manufacturing, mining, quarrying and construction industries. Covers various sectors include manufacturing, mining, quarrying, construction, agriculture, forestry and fishing, utilities, transport, storage and communication, wholesale and retail trades, hotel and restaurants, finance, insurance, real estate and business services, public services and statutory authorities.

2. List all the regulations under the OSHA 1994 and their effective dates.

Occupational Safety and Health (Employers Safety and Health General Policy Statements) (Exception) Regulations 1995. (24th March 1995) Occupational Safety and Health (Control of Industrial Major Accident Hazards) Regulations 1996. (1st February 1996) Occupational Safety and Health (Safety & Health Committee) Regulations. 1996. (1st January 1996) Occupational Safety and Health (Classification, Packaging and labeling of Hazardous Chemicals) Regulations 1997. (15th April 1997) Occupational Safety and Health (Safety and Health Officer) Regulations 1997. (22nd August 1997) Occupational Safety and Health (Use & Standards of Exposure of Chemicals Hazardous to Health) Regulations 2000. (4th April 2000) Occupational Safety and Health (Notification of Accident, Dangerous Occurrence, Occupational Poisoning and Occupational Disease) Regulations 2004. (23rd April 2004)

3. State the objectives of two of the above regulations.

OSH (Safety & Health Committee) Regulations. 1996.

The objectives are: To assist in development of safety and health rules To carry out studies on trends of accidents To review the effectiveness of safety and health programmes

OSH (Safety and Health Officer) Regulations 1997.

The objectives are: To state the duties of the safety and health officer. To give explanation to employer of which industries need to employ a safety and health officer.

4. Describe the duties of manufacturers of chemicals to ensure safe use of their chemicals.

To carry out the research to eliminate and minimize the risk on the use of the chemicals. To ensure that the chemicals is safe when properly used. To provide information and document that contains related information of chemicals. To provide the MSDS of chemicals. To perform hazard determinations on all elements.

5. Describe the duties of employers to ensure safe use of chemicals at their premises and explain the preventive measures that can be taken by these employers.

Duties of employers i. To provide information for their employees about the hazardous chemicals to which they are exposed. ii. iii. iv. To control the exposure of hazardous chemicals to health. To ensure the safety, health and welfare at workplace. To formulate the policy of safety and health.

Explanations i. The information that need to be provided are the labels of chemicals, the form of warning, MSDS, instructions and procedures on safety and health to those who may be affected by his activities. ii. The maintenance of workplace and the arrangements for safety must be done by the employer to ensure safety and health of the employees.

6. Name the forms that employers must fill in when reporting accident, diseases and poisoning to the Department of Occupational Safety and Health. The form is Form JKKP 8. This form is required by Regulation 10 of the OSH- Notification of Accident, Dangerous Occurrence, Occupational Poisoning and Disease 2004. This form must be kept for 5 years.

7. Describe the differences between major hazard installations and non-major hazard installations.

MAJOR HAZARD INSTALLATIONS 1. Quantity of hazardous substances exceeds threshold. 2. Manufacturers are required to prepare safety report called CIMAH Report by a competent person. 3. Manufacturers are required to prepare Emergency Response Plan that covers both on-site and off-site emergency services.

NON-MAJOR HAZARD INSTALLATIONS 1. Quantity of hazardous substances is 10% to 100 % of threshold quantity. 2. Manufacturers are required to produce documentation to demonstrate that the activity is safe. 4. Manufacturers need to prepare an onsite Emergency Response Plan.

8. Describe how safety and health committee can play an important role in ensuring safety and health at the workplace.

Safety and health committee need to advise employers on the measures that need to be taken in ensuring safety and health.

They also need to inspect workplace to identify any hazards that can cause harm. Investigate any accident or anything that is related to the accident. To collect and analyse the statistics on any accident. To do the employers instructions in matters related to safety and health.

9. Explain how you as an employee can contribute towards ensuring safety and health at your workplace.

Employees need to take care of their own safety and health at the workplace. They need to give full cooperation with the employer to comply all of the regulations. They need to use the suitable PPE at the workplace. Obey all of the instructions and regulations on the safety and health. Let the employer know if there is any potential hazard occurred.

10. Describe one equivalent legislation or regulation that is being implemented by other country in the world to ensure safety and health at the workplace.

Korea Occupational Safety and Health Agency (KOSHA) KOSHA was established in December 1987. This agency was concentrated on prevent the accidents at the workplace, improve working environment and prevent occupational diseases. The objective is to build a safe and health working environment. This agency also strives to promote workers safety and health and encourage other parties to launch accident prevention activities. KOSHA was enacted in May 30, 1987 and this agency was renamed the Korea Occupational Safety and Health Agency in January 2009.
