5.0 1.0 SCOPE

This Specification defines the requirements of the Vendor supplying equipment to Esso Australia Ltd. insofar as the following: a. the provision of documentation to be submitted with a quotation for the supply of equipment; the provision of documentation to be submitted with equipment as part of the requirements of a formal purchase order; and the provision of a warranty associated with equipment supplied as part of the requirements of a formal purchase order.

GENERAL This Specification outlines the minimum requirements of a Vendor for the provision of documentation and equipment warranty associated with the supply of equipment either in part or as a whole. This specification relates to the technical and performance criteria of the supplied equipment and does not release the Vendor's obligations in adherence to any other purchase requirements provided either in writing or verbally by Esso Australia Ltd. The vendor shall be responsible for the supply of documentation provided by the Vendor's subsuppliers and shall ensure the compliance of such documentation with this specification.

DOCUMENTATION TO BE SUBMITTED WITH QUOTATIONS The information listed below details the minimum documentation to be supplied with each copy of a quotation. A quotation shall not be considered complete for evaluation purposes if these provisions are not complied with. a. b. Catalogue of technical brochures of all components. General description of all equipment, its operation and duties.

Price breakup, among major system components, of the quotation value. Should a discount be applied, a proportion of the total quoted value shall be allocated to each major component and the one off price of each major component shall also be included. Dimensions and weights of all major system and components. Complete listing including price of consumable items required for normal operation of the equipment for one (1) year. Complete listing including price of recommended spare parts required for one years operation. Personnel training requirements including the cost of training on a per person basis.

DOCUMENTATION TO BE SUBMITTED AFTER RECEIPT OF PURCHASE ORDER The information listed below details the minimum documentation to be supplied within four (4) weeks of receipt of a purchase order. Four copies (unless otherwise requested) of each item are required. The provision of goods in accordance with the purchase order requirements will not be considered complete for payment if these provisions are not complied with.

Installation, Operation and Maintenance manuals. It is preferred that these manuals be supplied in a hard covered 3 ring water proof binder of A4 size. Drawings larger than A4 size shall be folded to A4 size and enclosed in a plastic pocket of A4 size within the 3 ring binder. The contents of these manuals shall be fully indexed and shall contain in addition to normal industry accepted information, the following data. 1. 2. 3. 4. 5. 6. 7. 8. 9. 10. A complete list of parts. A complete spare parts list. A list of recommended spare parts for one year's operation. A list of consumable items required for normal operation of the equipment for one (1) year. Details of specialised tools required for installation. Caution if any required during installation to prevent damage to the equipment. Precommissioning requirements. Details of specialised tools required for routine maintenance. Complete calibration requirements. Details of routine maintenance requirements including the maintenance frequency.

Drawings In addition to the drawing supplied in accordance with Section 4.1 above one transparency of each of the following shall be provided. 1. General arrangement drawing.

Hazardous Area Certificates Where applicable to the application four (4) copies of the hazardous area certificates for each applicable item, attesting to its suitability in the hazardous area defined in the purchase specification, shall be provided.

4.4

Scheduling Where the supply of equipment calls for the Vendor to provide equipment or assembled systems that differ from the Vendor's normal listed product and requires Vendor design, manufacture or assembly, the Vendor shall provide a schedule that details the entire design, supply, manufacture, testing and delivery phases of the equipment.

5.0

WARRANTY Unless otherwise agreed in writing by Esso Australia Ltd the goods shall be guaranteed by the Vendor for a period of twelve months from the date they are put into service by Esso or the Vendor's representative, or for a period of eighteen months from the date of delivery of the goods, whichever is the lesser. Goods shall be guaranteed against any defect, performance deficiency or malfunction caused by or due to faulty or defective materials, workmanship or design, or any other act or omission by the Vendor or its sub-contractors or suppliers. Goods shall conform in all respects with the terms of the purchase order. Esso Australia Ltd shall notify the Vendor immediately of any such defect as aforesaid and the Vendor shall with all possible speed and at Esso Australia Ltd's options, either replace or repair the defective goods or part of the item specified by Esso Australia Ltd, free of all costs and expenses to Esso Australia Ltd. In the event of any replacement or repair aforesaid, the Vendor's guarantee hereunder shall extend to such replaced or repaired goods or part of the item for a further period of twelve months from the date the replacement materials are put into service. If the Vendor does not comply with the above guarantee requirements within a time reasonable in the circumstances, Esso Australia Ltd shall have the right to remedy the said defect at the Vendor's cost and expense but without prejudice to any rights which Esso Australia Ltd may have against the Vendor in respect of any breach of this order and special conditions. If any replacement or repair is of such a character as may effect the efficiency of the goods or any part thereof, Esso Australia Ltd may within one month of such replacement or repair give to the Vendor notice in writing, requiring that tests be made in accordance with the requirements of the order, such tests to be carried out at the earliest possible date.
