THE ALIANZA REGIONAL POR LA LIBRE EXPRESIN E INFORMACIN PRESENTS SABER MS III IN THE RIGHT TO KNOW DAY

THE

REPORT

The Alianza Regional por la Libre Expresin e Informacin presents its regional report called SABER MAS III, Acceso a la Informacin y Proteccin de Datos Personales". In the third year of its publication, the report explains the relationship and coexistence of access to public information and ensuring the protection of personal data. The relationship between both rights experience permanent tension, when invoking the principle of maximum disclosure of public events over the right to privacy of private events. This tension should not exist, if it was provided a clear line between public and private. However, this does not often happen, because the boundaries are blurred in both the promotion and the implementation and, with greater emphasis, on the defense of the right of access to public information. This report details cases in several countries that exemplify these concepts. Fourteen countries participate of this report, represented by member organizations of the Alianza, this time adding the organization Article XIX - Brazil with a detailed report of the current Brazilian situation on access to information. Access - Info from Spain also participated showing the balance of these rights in Europe; and the Cyrus Vance Center with a technical-legal report on the relationship between access to information and personal data protection in the United States. SABER MS III contains a diversity of views from members of the Alianza Regional and the other authors, based on their experiences in the exercise of the promotion, implementation and defense of access to public information. Progress and setbacks in terms of transparency and access to information in Latin America over the last decade allow us to assess access to information as a democratic tool to meet the State's public activity. Also, it requires us to deepen the analysis to balance the exercise of rights. Thus, individuals are strengthened by the protection and guarantees provided by the state and the full exercise of fundamental rights. The "Right to Know Day" - September 28, allows us to realize the collective need to make it a practice to ask the state for information regarding its public activities.
