Richard ODwyer is in the 3rd year of his B.Sc. (Hons) Interactive Media with Animation course. He has been a Sheffield Hallam Student for the last 5 years having completed his Foundation Degree and 1 year of a Games Design Degree before changing to his current course which is more suited to his future ambitions. You may have seen in the media that the US Government is seeking Richards extradition on charges of copyright infringement relating to a website he made as a hobby which held links (like Google) to enable its users to view films documentaries and TV shows hosted elsewhere on the internet. The website itself held no infringing material. Extradition is itself an extra punishment meted out even before any opportunity for a trial. In Richards case extradition is totally disproportionate to the alleged offence. If Richard were to be found guilty in the UK, the maximum penalty would be 2 years in prison as opposed to 5 years in the US (per count). Richard has no previous criminal record and so in fact would be unlikely to receive a custodial sentence in the UK. Richard has not been charged with any offence in the UK. However his supporters are asking for a UK prosecution for Richard so that he can properly defend himself against charges and where, if proven guilty, he would be tried in accordance with the laws in this country where he lives and studies. The current extradition treaty between the UK and the US has been shown to be unbalanced in a number of ways but mainly due to the fact that US defendants get to challenge evidence in a US court before a decision on their extradition is made whereas UK defendants do not. In practice this means that the US can allege any number of misdemeanours however inaccurate, but a UK defendant has no opportunity to challenge them in a UK court before their extradition is ordered. This cannot be right. Perhaps worse, no UK court can give consideration to the appropriate place (forum) for a prosecution. So if the accused was in the UK at the time of the alleged crime, which was said to be committed in the UK, his extradition cannot be challenged on the basis that the appropriate trial forum is the UK and not the US. 2
