Status of Applicant: Mark Wardeiner is the president of soccer club and John Vanas is the property owner. Requested Action: Conditional Use Permit (CUP) Purpose: Existing Zoning: Parcel ID Number: Location: Size: To operate an indoor soccer training facility. M-1, Light Manufacturing 16-B-038-0-00-004-0 8340 Station Street The indoor soccer facility would occupy 11,126 of the 21,340 sq. ft. industrial building.

Existing Land Use: Vacant building and Powerline Engine truck repair facility. Surrounding Land Use and Zoning: The site and surrounding area are zoned M-1, Light Manufacturing North: CSX Railroad tracks East: Deekers Sidetracks Bar & Grill South: Norfolk and Southern Railroad tracks & Mentor Lumber West: Vacant Land Zoning History: The building was constructed in 1958 with a previous address of 7110 Center Street. The address of the building was changed to 8340 Station Street in June of 1985 due to the construction of the Center Street overpass. In March of 2011, the Commission approved a CUP for Powerline Engine to operate a truck repair facility at 8343 Station Street. Applicable Regulations: 1133 Conditional Use Permits

Public Utilities: Existing utility connections to the building include gas, water, electric and sanitary. Engineering Comments: 1. An application to re-occupy the existing space is required where no building alterations are intended or where no modifications are required for a change of use. 2. Changes in use may require modifications of the existing building to achieve compliance with the Ohio Building Code. This is to be determined upon review with the City's Chief Building Official and appropriate modifications included in plans submitted for permit. 3. Provide accessible parking, an accessible route from parking to an accessible entrance and a 30 inch opening at the accessible entrance. 4. Final site plan to conform to City standards (available upon request) as part of next submittal. 5. The applicant pursuant to 1133.05(f) or 1113.02(p) of the Mentor Code of Ordinances is required to provide a trip generation study. 6. Handicap parking with van accessibility and curb ramps shall be provided and be designed in accordance with the Ohio Accessibility Guidelines. Handicap signing and mounting heights shall be detailed on the plans. Signs shall be mounted at a 7 height to bottom of sign.

7. All traffic control devices shall be designed, installed and maintained in conformance with the Ohio Manual of Uniform Traffic Control Devices and shall be detailed on the plan. All sign sheeting material shall be Type H reflective sheeting. All signs shall be mounted at a 7 height to the bottom of the sign. 8. Provide dimensions for all parking stalls and aisles. Parking stalls shall be a minimum of 9 X 18. (Mentor Code of Ordinances 1173.02 and 1173.05(c)) 9. Recommend paving of parking lot. Applicant shall provide written confirmation and plan modifications with next submittal as to the disposition of each of the above comments. Fire Department Comments: 1. A manual fire alarm system is required in Group A occupancies having an occupant load of 300 or more. 2. Each door in a means of egress from a Group A occupancy having an occupant load of 50 or more shall have panic hardware. 3. Knox Box Entry required if fire alarm system is required for the use. If fire alarm is not required, the fire department is still requesting Knox Box. 4. Area around building needs to be cleaned up. 5. Verify proper separation between this occupancy and the building to the west. Police Department Comments: No Comment Analysis: The applicant proposes to operate an indoor training facility for the AC Premier Soccer Club from a vacant industrial building located at 8340 Station Street. The property is located at the west side of the Center Street overpass and consists of two industrial buildings zoned M-1, Light Manufacturing. Powerline Engine occupies the northern building at 8343 Station Street. The building in which the training facility would be located has been vacant for several years. The training facility will occupy the eastern portion (11,126 sq. ft.) of the 21, 340 sq. ft. industrial building. Per Chapter 1135.01 (a) Conditional Use Permits are required for commercial recreation facilities in the M-1, Light Manufacturing district. The floor plan of the existing building indicates a small 16 x 26 waiting area with restrooms providing access to the warehouse area. The warehouse has a concrete floor with concrete block walls supporting wood trusses and the roof. The height of the interior ceiling is 12-ft. and the height of exterior metal roofing is 20-ft. The applicant has indicated the indoor facility will provide an area for running training drills for the Soccer Clubs teams during inclement weather when outdoor fields are unavailable. The proposed hours of operation are from 5:30 P.M. to 8:30 P.M. on weekdays and from 9:00 A.M. to 9:00 P.M. on weekends. The facility will not be used for indoor leagues and is intended for training purposes only. According to the applicant the average size of the training classes will be approximately 11 players, one (1) or two (2) coaches and few parents may watch the training sessions. The applicant has indicated in cover letter that no more than more than 30 people will occupy the building at one time. The parking lot is paved with crushed stone and a recent inspection indicated pot holes in need of repair. There are 21 parking spaces available along the north side of the building not delineated with painted stripes. The applicant has indicated the existing parking spaces in front of the building will provide adequate parking for the training facility based on the small class size. The applicant is advised that an application to re-occupy the existing space is required where no building alterations are intended or where no modifications are required for a change of use. A change in use may require modifications of the existing building to achieve compliance with the Ohio Building Code which shall be reviewed the Chief Building Official. The Fire Department has commented that panic hardware will need to be installed on all egress doors of the facility should the occupant load exceed 50 persons.

The Administration notified Mike Bell the operator of Powerline Engine at 8343 Station Street and John Vanas the property owner regarding ongoing violations of the CUP permit issued to the truck repair facility. There are several unlicensed vehicles and out of use automobile parts stored within the parking lot and within a grass area at the west side of the site. It was stipulated that all of the unlicensed and out of use automobile parts were to be stored within a fenced in area or inside the building. As neither the applicant nor property owner have fulfilled the conditions (stipulations) of the permit, the Administration recommends revoking the CUP permit for the truck repair business. The Administration will place the CUP for Powerline Engine on the November 17, 2011 Commission meeting with the Commissions concurrance. Stipulations: 1. The applicant shall provide written confirmation as to the disposition of each of the City Engineer's and Fire Departments comments and shall be included as parts of any Re-Occupancy and/or interior building permit application. 2. The occupant load of the building shall not exceed 30 persons. 3. There shall be no indoor leagues or tournaments allowed at the facility. 4. The existing pot holes in the parking lot shall be repaired by November 17, 2011. 5. The parking spaces at the north side of the building shall be delineated with striping, curb stops and/or signage.

This permit is valid for the applicant Mark Wardeiner of AC Premier Soccer Club and the property owner of record John Vanas of VLR Investments, LLC and is not transferable without the approval of the Planning Commission

This permit shall be null and void if the use for which it is granted does not commence within twelve (12) months of the date of issuance or if said use is abandoned for a period of six (6) months or more following its establishment. 8. This permit may be revoked by the Administrator and/or Planning Commission for violation of any of the above conditions or any of the provisions of the zoning code. Appeals of the Administrator's decision to revoke the permit shall be made to the Planning Commission. Such appeals must be filed with the Department of Economic & Community Development within ten (10) days of receipt of the notice of revocation. Exhibits: Cover Letter, Floor Plan, Site Plan, GIS Map
