Issue1:AlthoughtheNYCDOEhasmadeprogress,thereremainasignificantnumberof studentswhowerenottimelyadministeredtheLABR. ActionPlan:TheDOEhastakenanumberofstepstoensurethatschoolscarryouttheir obligationtoadministertheLABRinatimelymanner.InSeptember2009,theDOEbegan requiringschoolstorecord(onthestudentsanswerdocument)thedatetheLABRwas administered.ThisinformationisrecordedintheDOEsAutomateTheSchools(ATS) database.LABRtestresultsandtestingdatesaresenttotheOfficeofComplianceServices (OCS).WhenOCSstaffmembersshareLABRresultswithschoolsbimonthly,theyalsoshare whetherschoolsaretimelyinadministeringtheLABR.Thisdataisusedasameasureinthe PrincipalPerformanceReview(PPR)usedbydistrictsuperintendentstoassessprincipals performanceandisacomponentoftheDataScoreCardthatalertsschoolsiftheyareout ofcompliancewithitemsontheDOEComplianceChecklist. AnadditionalwarningsystemhasbeencreatedtoalertschoolsofpotentialELLswhoneed tobeadministeredtheLABRinatimelymanner.TheOfficeofEnglishLanguageLearners (OELL)hascollaboratedwiththeDivisionofAcademics,PerformanceandSupport(DAPS) andATStocreateaweeklyschoolreportwhichliststhestudents: whosefirsttimeentryintotheNewYorkCitypublicschoolswaswithintheprevious fiveschooldaysaswellastheprevioustendays,and whosehomelanguageisnotEnglish,and whodonothaveaLABRscore.
The State has informed the DOE of a redesigned home language identification survey (HLIS) and the accompanying guidance document on the interview, which will enable the DOE to better identify English Language Learners.

Issue2:AnumberofLEP/ELLsarenotreceivingtherequiredbilingualand/orESLservices becauseofshortagesofcertifiedbilingualandESLteachers. ActionPlan:TheDOEwillcanvassthestaffingneeds(e.g.,languageandlevels)ofschools whosetrendsindicatethatbilingualprogramsmaybeneeded,drawingfromthedatainthe schoolsLanguageAllocationPolicies(LAPs).Thisanalysiswillbeperformedannually,in conjunctionwiththeschoolsrespectivenetworksandclusters.TheHRdirectorsatthe networkswillworkwiththeseschoolsandtheAbsentTeacherReserve(ATR)teacherswho havetheappropriatebilingual/ESLlicenses.Theschoolswillhavetheopportunitytohire theseATRteachersonapermanentbasis.ATRteacherswithbilingual/ESLlicensesnothired inthiswaywillbeassignedtoschoolsthatstillhaveaneedforacertifiedbilingualorESL teacher.ThisprocesswillberepeatedmidyearbasedonupdatedBilingualEducation StudentInformationSurvey(BESIS)data.BeyondtheATRpool,theDOEwillactivelymatch theschoolsthathavebilingualandESLstaffingneedswithpotentialcandidatesinthehiring pool.TheDOEwillaggressivelyrecruitbilingualteachersincontentareasinhighschooland bilingualteachersinelementaryandmiddleschoolsinordertogrowthesizeofthehiring pool. InlightoftheneedformoreESLandbilingualcertifiedteacherstoensurethatallELLs receiveservicesfromanappropriatelycertifiedteacher,andtosupporttheexpansionof bilingualprogramsdiscussedunderIssue3,theDOEwillliftrestrictionsonhiringinESLand bilingualareasinthe201112hiringseason.Liftingtheserestrictionswillallownewand existingstafftobereadilyavailableforschoolsthatneedtoopennewbilingualprogramsat thestartoftheschoolyear.Toensurethatnetworksareawareofthischange,aswellasthe budgetary,staffing,andprogrammingflexibilitythatwillenablethemtostaffabilingual programeffectively,OELLwillconductaseriesofprofessionaldevelopmentsessions targetingbudgetandHRdirectorstoensurethatschoolscanplanforthenewschoolyear. Perourdiscussions,acertifiedbilingualcommonbranchteachermayteachthefullbilingual program,includingtheentirelanguageartsinstructionalcomponent(includingESL),ofsuch bilingualprogram,withouttheneedforadditionalESLcertification.However,theDOEwill encourageschoolstoconsiderhiringduallycertifiedbilingualcommonbranchteachers.We willdothisbyhighlightingcandidateswiththisdualcertificationinouronlineteacher applicationsystem.Wewillalsoprovideaprofessionaldevelopmentprogramtosupport elementarybilingualteachersinteachingtheESLcomponent.

Inregardtostatewideshortagesofcertifiedteachersinbilingualcontentareas,theDOEhas startedworkingwiththeSEDonanumberofproposedsolutions,including: Thedevelopmentandadministrationofastatelanguagetesttolicensedcontent areateacherswhoarebilingualandwhohaveindicatedproficiencyinalanguage otherthanEnglish.Thetestwilladequatelyassesstheteachersknowledgeof academiclanguageandcanservetoincreasethenumberofbilingualcontentarea teachersinamoreexpeditiousmannerthanthecurrentrequirementsforabilingual extensioncertificate. Requiringthatteacherswhoaregrantedcertificationinthisfashiontakeanumberof collegecredithours(tobedetermined)onbilingualeducationtheory.These professionaldevelopmenthourswillbeprovidedbyhighlyqualifiedexpertsin variouscontentareasaswellasbilingualeducation. TheDOEwillcontinuetoworkwiththeSEDtorevisitrequirementsinregardtothebilingual extension,andwillexploredifferentavenuesandincentivestohelpteachersobtaina bilingualextension/certification.Subjecttofundingavailability,DOEwillpromote,develop, andimplementincentivestoencourageteacherstoenrollincoursesandprogramsleading tobilingualcertification,includingoneormoreofthefollowing: TeachersofTomorrow(TOT)financialincentives(loanforgivenessortuition reimbursement)toteacherswhoalreadyhaveanESLorbilingualcertificationbut whoarenotworkinginthoseareastotransfertoahighneed(TOTeligible)school whichhasavacancyinESLorbilingualeducation. TheconversionprogramwhichpartnerswiththeITTprogramstogivefinancial supporttoteacherstogetanadditionalcertificateinESLorbilingualextension; particularlyfocusoutreachtocontentareateachersproficientinanotherlanguageto obtainabilingualextension. Workwithuniversitiestodevelopandimplementonlineprogramstofacilitate attainmentofbilingualcertification. Implementinganyoftheseincentivesintheshorttermmaybeseverelylimitedbycurrent budgetaryrestraintsandregulations,andthefailureoftheinstitutionsofhighereducation tograduatesufficientstudentscredentialedintheareasofhighneed. Inadditiontothestepsoutlinedabove,theDOEhashaddiscussionsandwillcontinue discussionswiththeSEDaboutchangesinrulesandregulationsandvariousothersteps requiringactionbytheSEDwhichwouldhelpaddresstheshortageofcertifiedESLand bilingualteachers. Goals: ByOctober2014,thepercentageofstudentswhoareidentifiedasLEP/ELLsandnot beingservedinabilingualand/orESLprogramtaughtbyanappropriatelycertified teacher,includingallLEP/ELLsubgroups(LongTerm,SIFE,etc.)willbereducedby 90%ormoremeasuredagainstthebaselineinformationforthe20102011school year.DOEwillreducebytheindicatedpercentagestheLEP/ELLsnotservedateach targetdate,aslistedbelow.StudentscurrentlyXcodedareexcludedfromthisgoal astheXcodedissueisbeingaddressedinseparatediscussionswiththeSED. BeginninginOctober2014,theDOEwillemploysufficientnumbersofappropriately certifiedbilingualandESLteacherstosupportthegoaldescribedabove.TheDOEwill alsoemploysufficientcertifiedbilingualandESLteacherstosupporteachofthe interimtargetslistedbelow.

Issue3:Parentchoiceisanissuewhichmustbeaddressed.NYCDOEhastakenimportant stepstoaddressthisissue,includingcreatingnewTransitionalBilingualEducation Programs(TBE),awardingannualTBEandDualLanguage(DL)planninggrants,and planninganinternal,crossfunctionalteamtoprioritizeparentchoice. ActionPlan:TheDOEwillexpandthenumberofbilingualprogramsofferedbyNewYorkCity schools,prioritizingthosegeographicareasofthecitywithbothhighconcentrationsofELLs andsignificantparentdemandforbilingualprogramstoensuresufficientprogramchoices withinacommunity.Byfocusingonneighborhoodswiththesetwocharacteristics,theDOE willmosteffectivelymeettheprogramneedsofELLsandtheirfamilies.TheDOEwillalso takestrategicmeasurestoensurethattheexistingandnewlycreatedprogramsreceivethe supportneededtobesuccessful.Recognizingthebudgetaryrestrictionsofthecurrent economicclimate,theobjectiveisacarefullypacedbutaggressivemultiyearplanofopening newbilingualprogramsandexpandingcurrentbilingualprogramstoadditionalgradesand classes.Theexpansionofbilingualprogramsoverthetermofthisplanwillbebasedona carefulanalysisofthedata. AnumberofthenewbilingualprogramswillresultfromOELLscollaborationwithotherDOE officesintheselectionprocessforallnewschools.TheDivisionofPortfolioPlanning(DPP) workswithnewschoolapplicantteamstodevelopbilingualprogramsandensurethatall approvedapplicantteamsarepreparedtoservealllevelsofELLs.OELLhasworkedwithDPP tosupportnewschoolsopeningbilingualprograms.Furthermore,newschoolsselectedby theDPPwillberequiredtoincludeintheirproposalssufficientprogrammingtomeetthe needsofallELLswhomayenrollattheschool. InallcaseswheretheDOEhasoptedtophaseoutaschoolduetopoorperformanceand thatschoolhasabilingualprogram,OELLwillworkwithDPPtoensurethatthelevelof bilingualservicesismaintainedorincreasedifthereisdemonstrateddemand.Inmost cases,thisgoalwillbemetbyestablishingabilingualprograminoneormoreofthenew schoolscreatedtoreplacethephaseoutschool.Inothercases,thetwoDOEofficesmay determinetoestablishanewbilingualprogramorincreasethelevelofservicesatanexisting bilingualprogramatanearbyschool.Inanycase,therewillbenoreductioninthetotal numberofbilingualprogramsofferedwhenaschoolisphasedout.Incaseswherenew schoolsaredevelopingbilingualprograms,OELLwillworkwiththeschoolandDPPinthe planningstagesaroundcurriculumdevelopment,studentidentification,parentoutreach, andotheressentialsnecessaryforsuccess. Inaddition,OELLandDPPwillreviewhighschoolcampuseswherenoschoolonthecampus currentlyoffersabilingualprogramtoidentifywhereoneshouldbeoffered(ifthereis sufficientdemandtosupportstartingaprograminthelocation).DAPS,andmore specificallynetworkteams,togetherwithOELL,willthenworkwiththeseidentifiedschools toensurethattheyaredevelopinghighlyeffectivebilingualprograms. CreateMeaningfulSupportsforSchoolstoEstablishBilingualPrograms:OELLadministers grantsandfundingtoschools: TBE/DualLanguagePlanningGrants:OELLprovidesplanninggrantsforschools developingbilingualprograms,bothTBEandDualLanguage.

ELLReserveFund:OELLadministerstheELLReserveFundthatprovidessupplemental fundingforschoolsthatreceivesignificantandunanticipatedincreasesinthe numberofELLs(aboveacertainthreshold)aftertheOctober31dateuponwhichFair StudentFundingfortheschoolsisbased. Apartfromfunding,aBilingualProgramWorkGroupwillbeformed,composedof representativesoftheschoolsthatarescheduledtoopenbilingualprogramsinthe2011 2012schoolyear,andappropriatestafffromOELLandtheOfficeofSchoolSupport.This groupwillmeetregularlyovertheschoolyeartoaddresscommonchallenges,strategiesand sharesuccessesandbestpractices. EstablishMechanismstoMonitor,Track,andEnsurethatParentChoiceisHonored:Inorder toimproverecordkeepingaroundaparentschoiceofaninstructionalmodelforhis/herELL, OELLisworkingwiththeDivisionofInstructionalandInformationTechnology(DIIT)to createascreenintheDOEsinternalATSdatasystem,wherebytheschoolwillrecordthe instructionalmodelinitiallychosenbytheparentofanELL.Thiswillcreaterecordsofwhat parentshavechosenbyschoolandcanbeusedtotrackdemandandfulfillmentforvarious instructionalmodels.ItwillalsoprovidedatatoimproveoverallplanningforELLsupportand helpadministratorsprojectwhichschoolsshouldbepreparedtoopenbilingualprograms. Also,theOfficeofComplianceServices(OCS)willpartnerwithOELLtodevelopaquestion whichwilltrackandmonitorparentalchoice,andwhichwillbeaddedtothecompliance programforFiscalYear2012.OCSandOELLwilldeveloptherequiredmetricstobeapplied inthecalculationofschoolscompliancelevelspertainingtothisquestion.OCSwillprovide supporttoschoolsoncomplyingandwillalsoprovidecitywideandschoollevelanalysesto OELL.OELLwillworkwiththeOfficeofSchoolSupporttoimplementmeasureswhichwill improvethequalityandaccuracyofthedecentralizedprocessofcollectingparentchoice information.OELLwillconductmonitoringvisitstoschoolstoensurethatparentsare receivingacompleteorientationinwhichallprogramoptionsbasedonCRPart154 regulations(asmodifiedbytheASPIRAconsentdecree)arepresented.Monitoringvisitswill focusonschoolswhoseprogramoptionsdonotmatchparentchoicetrendsandschools withoutbilingualprograms.TheDOEwillworkwithSEDtoidentifyascheduleofschoolsto bevisitedjointly.WorkingwithourcontractedauditpartnerErnst&Young,theDOEsOffice ofAuditorGeneralwilldevelopandexecuteanauditplantoassesstheDepartment's implementationofELLParentChoice.Theauditwillincludeaparentsurveytowhichparents

willrespondanonymouslywithouttheschoolsknowingwhichparentshavebeensurveyed. TheauditwillbeconductedinaccordancewithGenerallyAcceptedGovernmentAuditing Standards(GAGAS).TheDOEwillshareadraftoftheauditplanwithSEDforreview, commentandapprovalpriortosampleselectionandfieldwork.Becauseoftheneedto adequatelyplanandprepareforthisaudit,thefirstauditreportwouldnotbeissueduntil springof2012.ThefindingswillbesharedwiththerespectiveDOEofficesforsupport and/ornecessarycorrectiveaction. Enrollment:InacollaborativeeffortamongOELL,theOfficeofStudentEnrollment(OSE), andtheOfficeofSchoolSupport(whichhousesclustersandnetworkssupportingschools), schoolenrollmentdatawillbeusedtoidentifyschoolswhichappeartobelikelycandidates forcreationorexpansionofbilingualprograms.Therewillbeacoordinatedeffortamong theseofficestoreachouttotheseschoolsbeforetheannualenrollmentprocessbegins. OELLwillcreateaonepagesummaryoftheparentchoiceprocessincludingdescriptionsof thethreeprogramoptionsforinclusioninallenrollmentpackets.OELLwilldevelopnew parentmaterialsorexpandcurrentparentmaterialstoprovideadditionalinformationon programoptionsandwheretheyareavailable. WithregardtotheParentChoiceprocess,theindividualschoolsratherthantheenrollment centersareresponsibleforprovidingparentsofELLswiththerequiredorientationandthe programoptioninformation.EachschoolaspartofitsLanguageAllocationPolicy(LAP)must statehowtheyshowtheparentchoiceorientationvideoandthetitleandnameofthe pedagogueintheschoolwhoisresponsibleforshowingittoparents.Theschoolinformsthe parentsthatiftheychooseabilingualprogramfortheirchildandnoneexistsattheschool, theirchildhasanoptiontotransfertoaschoolthatoffersabilingualprogram.Suchtransfer requestsareprocessedbythecentralDOEoffices.AlistofschoolsintheNewYorkCity systemwithTransitionalBilingualEducationandDualLanguageprogramsisavailableonthe DOEwebsite.
