SOFTWARE END USER LICENCE AGREEMENT FOR DISPLAYLINK MIRROR DRIVER and DISPLAYLINK GRAPHICS ADAPTER SOFTWARE (THE

"PROGRAM") This is a legal agreement between you, the end user, ("You") and DisplayLink (UK) Limited ("DisplayLink"). BY INSTALLING THIS SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. Some versions of this software, once installed, will check for updated system software at least once and then again at regular intervals unless you specifically disabled this feature when given this option. No personal information or information about your PC or the software installed on your PC is sent to our update servers during this process. Accepting the EndUser License Agreement means that you accept this product feature. 1. Licence DisplayLink grants You a personal, non-exclusive, non-transferable licence to use one copy of the Program as acquired with this licence in accordance with any user documentation supplied with the Program and in accordance with the terms of this agreement. You may make one back-up copy of the Program, provided that such copy shall be subject to the terms of this agreement. 2. Use You are entitled to install and use the Program on a computer that is attached to the product that contains DisplayLinks proprietary technology (the Device) and the Program may be used to enable only the Device to be used by Your computer. 3. Copyright and other intellectual property rights All intellectual property rights in the Program and user documentation are owned by DisplayLink and are protected by copyright and other intellectual property laws, international treaty provisions and applicable national laws. 4. Further restrictions You may not loan, rent, lease or license the Program or any copy. You may not use the Program for or on behalf of anyone else (which includes operating any form of facility on behalf of anyone else or operating a software bureau service). You must not reverse engineer or decompile the Program save to the extent permitted by applicable law despite any contractual prohibition. If You wish to obtain interface information relating to the Program, to achieve interoperability, a request should be made in writing to DisplayLink. 5. No other warranties NO CONDITIONS, WARRANTIES OR REPRESENTATIONS SHALL BE DEEMED TO HAVE BEEN GIVEN BY DISPLAYLINK IN RESPECT OF THE PROGRAM OR YOUR DOCUMENTATION (INCLUDING ANY SUCH TERMS RELATING TO QUALITY, PERFORMANCE, SUITABILITY OR FITNESS FOR PURPOSE). DISPLAYLINK DOES NOT WARRANT OR ENTER INTO ANY TERM TO THE EFFECT THAT THE PROGRAM WILL BE ENTIRELY FREE FROM DEFECTS OR THAT ITS OPERATION WILL BE ENTIRELY ERROR-FREE. IF YOU HAVE ANY PROBLEM WITH THE PROGRAM, YOU SHOULD CONTACT THE COMPANY THAT SUPPLIED THE PROGRAM TO YOU. 6. Termination Your licence to use the Program automatically terminates if You fail to comply with any provision of this agreement. 7. Sub-license and Assignment You may not sub-license the Program. You may assign all of Your rights to use the Program to another person or entity provided that: (a) You transfer this agreement, the physical

medium in which the Program is made available, user documentation and all copies of the Program and user documentation together with the Device; (b) You retain no copies of the Device or Program, including copies stored on any medium; and (c) You remain liable under this agreement for any breach of its terms by the assignee. 8. Statutory rights If You purchased the copy of the Program covered by this agreement as a consumer, the exclusions and limitations contained in this agreement do not affect any statutory rights to which You are entitled and which may not by law be excluded or limited. 9. Title You own only any media on which the Program is supplied and may retain this media on termination of this agreement provided that the Program is erased. DisplayLink shall at all times retain ownership of the Program. 10. Third Party Rights No term of this agreement is enforceable by a person who is not a party to this agreement. 11. Entire agreement, applicable law and jurisdiction This agreement sets out all of the terms between us in relation to the subjects covered by it. Subject to clause 5, no other representations or terms shall apply to form part of this agreement. This agreement is governed by English law and both parties submit to the exclusive jurisdiction of the English Court in relation to any dispute concerning this agreement, but DisplayLink is also entitled to apply to any court worldwide for injunctive and other remedies in order to protect or enforce its intellectual property rights. DisplayLink (UK) Limited is a subsidiary of DisplayLink Corp., a US registered corporation.
