Sir,
In continuation of my letter dated 08.05.2003 in reply
to your letter No. 32265/D.C.M. Electric Inspector dated 29.04.03, I
have to offer my special thanks as I am highly obliged to you for
being kind enough for providing me an opportunity to convey again
the reasons for leaving WAPDA panel. No doubt, it was my desire
and keen interest to serve WAPDA as a lawyer with sincere passion
and true devotion, but I was compelled to depart, among others, due
to following reasons: -
i) The X.E.N. (Operation) MEPCO, Mumtazabad
Division, Multan had assigned to me 4 or 5 court case
by issuing P.O.A. through your office. I came to know
very soon that there are different lobbies who are
involved in malpractices and felt that concerned staff
did not provide proper information and documents
required to contest the case in a proper way. I had to
collect requisite documents or information by personal
efforts. However, it was practically possible during the
tenure of Mr. Shahbaz Ahmad Khan X.E.N., Mumtaz
Abad and Mr. Abdullah Shah Kazmi R.O. Mumtaz
Abad. After that the situation changed which is evident
from the perusal of annexes A, B & C. This is just one
example to support my above version.
ii) The relevant statement may be seen to consider why
one panel advocate was entrusted more than 100 cases
while the other had non?
iii) I was further discouraged when Mr. A.D. Chohan
D.C.M. (on his arrival in Multan Circle) introduced (as
he used to call it) a new sheme of 2 + 1 cases. I
informed your office in writing that I had decided to
withdraw my name from WAPDA panel as Mr. A.D.
Chohan’s scheme was not acceptable to me. It may be
noticed that I had requested, at the same time, to the
Secretary Law Division, Govt. of Pakistan, Islamabad,
to suspend my name from WAPDA panel temporarily
till the conditions imposed by A.D. Chohan are
removed/discontinued (Annex “D”).
iv) On special advice conveyed to me vide your memo No.
3915-17 dated 15.02.2003, I accepted to conduct the
civil suit titled Sh. Abdus Sattar Vs. WAPDA
(MEPCO) etc. and thereafter neither any case was
assigned to me nor I was on WAPDA panel any more.
Since then, like any other advocate, I had been
appearing against MEPCO in so many cases before the
Hon’ble High Court, Multan/Bahawalpur Benches,
civil courts Electric Inspector, Multan and Advisory
Board, Lahore in different cases of other circles also
and the case of M/s Decent Paper Mills, Khanewal, is
one of such cases. It is on record that I had informed all
concerned quarters in this respect at proper time. You
will definitely agree to my principle stand against the
A.D. Chohan’s unlawful scheme (inconsistent with the
policy of WAPDA), so leaving WAPDA panel to
exercise open parties is absolutely in accordance with
all moral and legal ethics.
The point raised in your above referred letter
stands clear and clarified. However, as I had earlier
stated in my letter dated 24.01.2001, I am still ready to
serve MEPCO/WAPDA to conduct all court cases
before any court, tribunal or forum if assigned to me
according to the standing instructions of WAPDA
issued by Law Division, WAPDA, Lahore.
