Where Did All The Law
Libraries Go?
In 1992 I was sentenced to life in the
Arkansas DOC. Upon arrival I immediately
realized this is not the life I wanted to lead.
After several months in prison I noticed the law
library was always a flurry of activity. Mostly it
was always the same 10-12 prisoners reading,
researching, writing, typing and debating. At the
time my unit had a population of around 900
people. For the sake of argument I would say
that the ratio of writ writers (inmate lawyers) was
in the neighborhood of 1:100 in the Arkansas
Department f Correction. I noticed that some
design by were better at procedure where as others were

May 07 team up on one or more individual cases.
There was constant discussion on legal
practice, social norms, and politics. I soon
learned not only were these men intelligent
and educated in law and legal procedure,
these men knew ADC policy. If you
received a disciplinary and needed to appeal,
if you had a grievance against the
Department or staff for violating their own
policy, that needed to be addressed, these
were the men to call on. It might cost you
$10 to $20 in cigarettes on commissary. For
that amount they would take your issues to
the state or federal courts in AR which cost
$120.00. There was no need for a large law
library. Year after year I have witnessed a
steady decline in men educated in law and
ADC policy. Fast forward to 2007.
There is no longer a law library call. It is
now done by request only. You can request
3 cases per week. There is no help at all.
The writ writers are all gone. No more
lawsuits, disciplinary appeals, or grievances.
They are mostly all lost. As a 17 year old
boy in 1992. I could not have learned what I
did without these men. I remember a time
when I could read through 15 to 20 cases a
day and file my own writs without the help
of an attorney that I can’t afford. A whole
generation of writ writers and educators have
been lost.
At my Rule 37 hearing I was 19 years
old. I made a procedural error. The Judge
told me that ignorance to the law is no
excuse. My question is, what about lack of
access to the law? Is that an excuse?

“Civil Justice For California”
This is a new column that will be
featured in the Broken Bridge Brigade
newsletter. The writer of this article is
California’s own Civil Liberties Liaison,
Mickey Leinweber
The column will address issues of Civil
Rights in prison, as well as updates on all
new State and Federal law which will
affect those incarcerated in California
State Prisons, and other states.
My job as California’s Civil Liberties
Liaison is to help Californian prisoners
protect themselves before and after Civil
Injury, and in cases of the latter, how to
address the injury through the legal
system.
However I will now address these two
issues in general, and give you, the
readers, the best avenues to take to
receive relief from these civil injuries.
Adequate Medical Care“,right now this is
the biggest issue within CDCR, because
of the Plata v. Schwarzenegger case.
CDCR is under a $200 million
”Receivership“, the biggest receivership
in U.S. history. Even with the Receiver
in place, adequate medical care is
basically nonexistent in prison.

Letters From The Brigade
I am an inmate within the California State
Prison system, serving life. I spend
everyday within our system fighting for
Civil Liberties for myself, and each one of
you. With that said, what I've spent years
acquiring in the way of legal knowledge, I
want to use to help others. My fellow
California State prisoners.
In the next newsletter I would like to start
answering some of the more common
questions asked by California prisoners in
regards to their civil rights while
incarcerated. However to determine if
these questions are in regards to adequate
medical care, which I have found is
almost impossible to receive in CDCR
(California Dept. of Corrections and
Rehabilitation),or the use of excessive
force, which I have found is a daily
occurrence in CDCR,I need to hear from
you, the readers of the Broken Bridge
Brigade!!
So, I guess the questions are, when is
medical care is so inadequate the 8th
amendment is violated ,and you are being
subjected to cruel and unusual
punishment, and what can be done to help
you receive the treatment you need? As to
the first of these questions, when prison
officials and medical staff show”
deliberate indifference to your serious
medical needs“,the United States Supreme
Court ruled that they have violated your
8th amendment right to NOT be subject to
cruel and unusual punishment. This ruling
was handed down in the Seminal case cite
Estelle v. Gamble,429
U.S.97(1976).When prison officials
show” deliberate indifference to your
serious medical needs”,it is my
recommendation that you file a grievance
form, a CDC 602,and regardless of staffs
responses on the lower level of the 602
appeal, exhaust it through the third level.
Failure to do this forfeits all your right to
any legal action in court! However,
anyone who has accessed the appeals
process offered by CDCR, knows this is a
timely and stressful process, with little
hope of receiving what you seek from the
CDCR.

Therefore, it is also my recommendation that
in addition to filing a CDC 602 form and
exhausting the 3rd level, you should write a
letter detailing your medical needs and the
lack of medical care and send it to: Ms.

ensure more adequate medical care in a
timely fashion.
“When is the force excessive?” The U.S.
Supreme Court Standard was set in the
Seminal cite as Hudson v. McMillan,503
U.S. 1 (1992),and the determination is
whether the force was applied ”maliciously
and sadistically to cause harm, or in good
faith to maintain order?
Next I want to end this column on the use
of excessive force by prison officials. We, as
California State Prisoners, are subject to the
use of force, and/or witness the use of force
daily ,by prison officials and other staff).
The question becomes
”Now anyone who had ever dealt with
CDCR knows that they will cover up their
staffs” mistakes“,if at all possible. That is
why I recommend if you are or have been
subject to the use of excessive force, please
contact the U.S. Department Of Justice, CRT-
Criminal Section, Washington,D.C.
20530.Their duty is to investigate all acts of
police or prison officials use of excessive
force, per the Civil rights Act of 1964,and
again, always file a CDC 602 too.

Does the Death Penalty Deter
Crime?
The answer is the evidence, facts and logic-
speaks like an alarm... It Does Not Work!!!
The evidence is consistent. States with a
Death Penalty do not have a lower crime rate.
Houston, TX is proof positive of that. After
superceding any other state in the union;
Harris County, Houston, TX has sent more
souls to their execution second only to Texas.
Interestingly, homicide and crime has not risen
in states that abandon the death penalty. A
person committing a crime of passion does not
pause to calculate the consequences (and if they
did, likely they'd consider life in prison an
adequate deterrent) Include life without parole in
there too! Our system only admits pro-death-
death qualified jurors into a trial to decide a
person's fate “life or death”. This is not a fair
nor accurate representation of a jury of one's
peers as the law dictates. It's clear that beliefs do
guide perceptions. and that in our post
modernists society we need to think smarter,
restrain of biased stereotypes the media feeds us
on TV the dehumanization Hollywood portrays-
one person perceives as reality. Our logic as an
advanced culture should compel us to put our
testable beliefs to the test. You can see the
dilemma and complexed difficulty in trying to
persuade people, or even to educate them on
such highly diverse issues such as the Death
Penalty. People adopt a position and then
they accept any argument that favors it, they
reject or ignore any contrary information or
argument. Those few people who are against
the retribution and the sentence of death- never
see the inside of a courtroom. They're excluded
100% of the time by our public prosecutor.
Much is at stake here- the advancing growth of
our society and culture... Education brings
change. Abolition respects society.

Another Case of Justice Denied:
Case: Eric Perez #779850
My name is Eric Perez, from Corpus Christi, TX and I’m 28 years
old. On March 11, 1996 I was arrested at the age of 17 for murder & agg.
Assault - both stemming from the same incident. The D.A argued that I
was the front seat passenger of a car used in a drive-by on a house where
gang members had been in attendance and accused of being one of the
two trigger men in the crime. There is NO physical evidence or
otherwise placing me at the scene of the crime before, during or after.
The D.A’s case essentially relied on the testimony of four witnesses.
Two being the actual participants - one being a male, owner of both the
car & one of the guns used in the crime as well as being the driver,
agreed to testify against me in return for a plea bargain.
The other participant being a female, the girlfriend of the male
participant, the owner of the car, was a back seat passenger in the car
during the commission of the crime, received immunity in exchange for
her testimony. During cross examination, the male participant admitted
that he would lie if he thought it would benefit him. And of course, the
female participant had obvious reasons to lie about my involvement.
The other two non participants , both being makes and only connection
to the crime was being present at the male participants house along with
his girlfriend the day after the crime was committed during talks of how
to dispose of the guns. Under police threats, coercion, manufactured
statements were produced. The first non participant basically stated that
I had bragged to him about doing a shooting. However, while on the
witness stand at my trial, he testified that he was coerced by the police
into lying and that they were going to arrest him if he didn’t make the
incriminating statement against me.
The other non participant did testify against me during the trial,
stating that he heard me bragging about shooting a gun. However, after
his testimony on the witness stand and before the closing of my trial, he
withdrew his testimony via an affidavit. In which he stated to having
lied on the stand due to police coercion and threats of being jailed.
The jury never heard this new statement of his because he was not
able to be located. After an exhaustive search, both by my attorney’s
staff and the prosecution teams staff, he was nowhere to be found.
Under the pressure from the trial Judge to continue with the trial
proceedings, my trial continued and the jury never learned of his newly
recanted statement which was a factor in my being convicted.
After my conviction, my trial attorney filed a Motion For New Trial
at which point, the prosecution team handed over evidence tending to
establish my innocence. This evidence was intentionally withheld,
preventing its production at trial. At least two months prior to my trial,
the prosecution team had information that another individual was
responsible for the shooting & wanted to confess his involvement in the
matter.
The prosecution team intentionally withheld this information &
possible confession despite my attorney’s pre-trial requests for all
evidence to be handed over. During my hearing of Motion For A New
Trial, a private attorney testified to having a client claiming
responsibility for the crime. Of course the jury in my trial never learned
of these facts due to the prosecution team intentionally withholding this
evidence during the course of my trial and only revealing this evidence
after my conviction.
Needless to say, my Motion For A New Trial was denied.
Emotions played a big role in how the Judge & Prosecutor
went about their individual duties & thus compromising the
integrity of justice by letting their emotions take lead.
When I was arrested I was taken into custody from home
without an arrest warrant, yet the arresting officer stated to
having one. An arrest warrant wasn’t signed & ordered until
the following day of my arrest. This fact was never contended
by my attorney.
To further understand my situation, my trial attorney had
zero criminal trial experience. He specialized in civil law.
Which made him unable to handle every detail that comes
along with a criminal trial & essentially being ineffective in
carrying out a defense strategy that would bring about justice.
I was sentenced to 45 years for this crime I did not commit.
My family is financially unable to obtain an appeals
attorney for my case. I am hopeful & pray that I may be able
to find help & support with my situation. Thank you to all
readers of this for your attention & any help or support
possible.

Foundational Truths
According to the Constitution of the United States, we hold
these truths to be self-evident. That all men are created equal,
given certain inalienable rights. That the population of our
country is allowed to seek their own. Their happiness, their
true identity, their passions and purpose in life.
Prisons, Incarceration and Correctional Organizations are a
necessary and crucial ingredient to maintaining societal
control, punishment of the offender and protection of our
communities. They are not, however to be used as weapons
against our own human race and we will not be tolerant of
abuse in our Correctional Organizations.
Incarceration and Supervision of those individuals who
have broken the laws of society CAN be accomplished
through comprehensive counseling, self and assisted
rehabilitation, and the use of alternative monitoring.
Family, Friends, and Faith are inherent to the rehabilitation
and success of the offender. Without a strong support
network, our prisons will continue to recycle, repopulate, and
recidivate.
Every man, woman, boy and girl is endowed with skills,
talents, callings and gifts that are part of a larger plan for our
communities. It is the responsibility of our leaders and those
placed in authority over us, whether in prison, at work, or in
our churches and places of worship, to seek out, facilitate and

Services Offered
The Carter Foundation has a variety of services and expertise at you
disposal. We want to assist in whatever areas you find yourself in need of
support with, and even those ideas and services you may not realize you
need. Dealing with an incarcerated loved one is difficult, even at the best
of circumstances. Whether you or your loved one is serving short (less
than a year) or are a lifer, the daily business of “doing time” can be
confusing, frustrating, and disturbing. We, in the free world, often take
for granted even the smallest of things. Medical treatment,
communications, telephone access, internet, photos of loved ones,
spending time with our children, the list goes on... but what if you are
restricted by SOP's, (Standard Operating Procedures), Correctional
Officers, red tape, inter-prison mail, diverse personalities, and the often
inconsistent behavior of those around you. Where do you turn if you live
behind the fence? You often turn to your loved ones outside the fence.
That is where The Carter Foundation comes in, to assist. In our own
experiences, we've discovered that only through trial and error, and
actually having to face the many issues within the corrections experience,
there are ways to do things, and then there are methods which are not
quite so successful.

“Florida DOC Reform”
As a man who was wrongly convicted and imprisoned in the State of
New York where I was personally subjected to countless fabricated
misbehavior reports, many months of unwarranted solitary
confinement, numerous assaults at the hands of rogue corrections
officers, and myriad other injustices by prison officials, I hereby
express my sincere gratitude to the following people for having played
such an important part in my ability to fight for meaningful prison
reform today as a law-abiding concerned citizen:
New York State Correction Officer Pierre Brisson. Through his
having stood up for me time and again against his superiors when I
was falsely accused of some phantom disciplinary violation, it was he
who first impressed upon me that there are indeed good corrections
officials concerned with the mistreatment of inmates, good corrections
officials who refuse to be corrupted by morally bankrupt co-workers
bent on making sport of inmate abuse.
Former Florida State Prison Warden Ron McAndrew. By his having
bravely cut squarely across the grain of the Good Ole Boy system in
Florida’s prisons, and by having commendably reported to authorities
the illegal activities of his co-workers, he reinforced in me my long-
held belief that with enough perseverance, one person can make a
difference. And beyond that, knowing of my personal past, his
willingness to communicate freely with me his acceptance of me he
encourages me to become proof positive that ex-offenders can indeed
successfully reintegrate back into society without bearing the shame of

Florida DOC Secretary James McDonough. By his having fired so
many corrupt corrections officials, by his having promoted the ones
demonstrating professionalism, by his having implemented an
employee code of conduct, and by his having done during his short
tenure so many other commendable things intended to bring credibility
to the DOC, he has shown to me remarkable leadership qualities
seemingly heretofore so very foreign to the Florida prison system.
Moreover, that today he testified with such candor as to the state in
which he found the DOC when first appointed Interim Secretary,
shows he truly is a man of integrity in which we can all trust to make
the DOC operate as it should.
Governor Charlie Crist. By his having reappointed Secretary
McDonough to the helm of the DOC, he has demonstrated
commitment to long-overdue meaningful prison reform I Florida. And
by having recently pushed through legislation restoring the civil rights
of ex-offenders, he has further shown a commitment to helping ease
the insurmountable burdens faced by former Florida prisoners.
And finally, I express my sincere thanks to all the many other public
officials and private citizens who have in any way supported my
efforts aimed at meaningful prison reform in the State of Florida.
With his sentencing to prison, the story of Crosby Corrupts
Corrections is now over. But yet remaining are the aftereffects of his
evil regime; both inmates and staff too yet suffer, we still have a long
way to go. I therefore urge you one and all to continue forward in your
missions to improve the system for everyone involved, and that you
each throw your support behind Secretary McDonough.

The receipt of my execution date, for August
30th 2007, on May 4th 2007 at approximately
6.50am, was preceded by a dream of that
fact....
For a long time now I have been aware of the
power of dreams; the way they act as a
visionary tool for the soul. It's a powerful tool
of sight that allows one - if they tap into it - to
comprehend things of the past present and
future. Since being a child I have dreamed - I
reflect on them and take them very seriously.
Before I woke on May 4th I dreamed that i was
being taken to the execution chamber. In my
10 years on death row I have rarely dreamed
of such a thing - maybe 3 times - and to me
that is actually surprising as one can't help but
to think about this process as it's constantly
paraded in front of you daily.
There i was in the chamber and I was freely
walking around. Preperations were being made
to carry this sadistic process out. As i was
looking around I spotted the room from where
the poison flowed and to my shock there was
no fancy devices issuing the poison, rather, it
was a big boiling pot of solution. the pot was
big and black similar to the ones you might
see in a cartoon when they're boiling
something. And all that came out of it was a
tube and IV. Shortly after this I woke.
