Julia, While it might be something to curtain the press because we may at times not agree with it, on the other hand I view there FREEDOM OF THE PRESS is already far too much undermined so that certain media reports available outside the Commonwealth of Australia such as what was really going in regard of the war in Iraq, etc, was concealed from readers. . What we therefore already have is a political interference into the media for political reasons and the last thing we need to have is further political interference. . We need a robust media that dares to expose matters and this we are I view lacking. . For sure at times those seeking to make a scope to earn a lot of monies will be overstepping the boundaries of common decency, etc, but then libel laws and other laws should be sufficient to deal with this rather then to undermine the FREEDOM OF THE PRESS and the FREEDOM OF SPEECH that I view as a CONSTITUTIONALIST was embedded as legal principles in our constitution for the federation. . You will find it contains numerous quotations of the Framers of the Constitution and so that the liberty contained within our constitution by far exceeded that of the US, even so it specifically had its Amendments for this also . It also contains a reference to judicial determination that FREEDOM OF THE PRESS must be construed to a FREEDOM OF THE INDIVIDUAL as all citizens using modern technology are now or could be deemed to be part of the press where they after all now provide often the pictures and other details the media relies upon. . Hence, to contemplate a restriction of the FREEDOM OF THE PRESS, besides it being unconstitutional, would also signify a restriction on the INDIVIDUAL and that would undermine the constitutional rights of every INDIVIDUAL of FREEDOM OF SPEECH also. . Again, I have no issue with criminal sanctions to be provided otherwise to prohibit the unauthorized access to telephone conversations, etc, as that is not an issue of FREEDOM OF THE PRESS but rather maintenance of CIVIL RIGHTS any person is entitled upon. . We do have also embedded in the constitution POLITICAL LIBERTY and while the High Court of

Australia held since about 1990 that POLITICAL LIBERTY is implied in the constitution the truth is that it is embedded as a legal principle in the constitution as the document also indicates. As such it is not a mere implied right but a legal principle that exist all along since federation. . it should be understood that FREEDOM OF THE PRESS and/or FREEDOM OF SPEECH and/or POLITICAL LIBERTY never can and neither must be perceived to be that one can disregard the RULE OF LAW and violate criminal law provisions. . As Author and published of books in the INSPECTOR-RIKATI series on certain constitutional and other legal rights I always consider that material provided to me for publication may not be appropriate for publication not because of any fear by me but because I hold I have to act responsible in publications. As such material that may likely cause undue harm may not be published where I hold that the material could be published if structured differently without causing undue harm. On the other hand I have had government lawyers pursuing me for CONTEMPT OF COURT for publishing material but they failed completely because the publications albeit exposing the judicial officers wrongdoing was permitted by legal provisions but just not realized by the particular lawyers involved. Courts are not a cloister where they can conceal their inappropriate conduct and I have always ventured out to expose this as I do about politicians. I do however viewdeliberate malicious publications is not any form of FREEDOM OF THE PRESS or FREEDOM OF SPEECH but rather a deliberate misuse of it. As such, the issue is not to seek to interfere with the FREEDOM OF THE PRESS and/or FREEDOM OF SPEECH and/or POLITICAL LIBERTY but to rather have appropriate criminal sanction against any undue harm being inflicted. For example a person can spread a rumor during an election against a certain candidate that may virtually destroy the ability of the candidate to be elected and yet after the election the allegations may be proven to have been fabricated for no other purpose but to undermine the candidates election. Likewise as I discovered in elections a political opponent (as a councilor of council) had my political posters/banners removed but not that of any other candidate because of seeking to minimize the effect my posters/banners otherwise may have upon the election outcome. As such, the issue is not to just blame the press about everything that goes wrong because from personal experiences I view the press far too often do not publish stories that could result in a certain government then withdrawing advertisements for it. As such, we rather have a problem of too little of the truth being published and then news stories that may have been wrongly obtained are getting more attention. . We have members of the Parliament (State/Federal) making statements in the Parliament that can severely damage the standing of a person in society and yet no proposal exist to stop this. We have a Parliament that is entitled to have its own rules, as was foreseen and intended by the Framers of the Constitution and any abuse of the rules is for the Parliament to address and no matter how regrettable it might be at times curtailing Parliamentarian privileges because of the misuse by some members of parliament hardly justifies to undermine the intentions of the Framers of the constitution. Likewise to undermine the FREEDOM OF THE PRESS and/or the FREEDOM OF SPEECH and/or POLITICAL LIBERTY isnt going to resolve it a bit and neither is in my view constitutionally permissible. What must be done is to ensure that offenders of criminal law provisions will be held accountable and if the criminal law doesnt provide for any offence having been committed then like it or not the blame lies by the legislators having omitted to provide for it. . WikiLeaks may not be a favourite amongst Members of Parliament but if Members of Parliament in the first place acted honourable then websites such as WikiLeaks would have no cause of

publications and therefore blame those who are acting inappropriately in that regard and not the bearer of the bad news. . . when during the election you claimed there be no CARBON TAX you didnt mind this to be published in the media and so where then do you hold that something is true or untrue? Is it whatever might be eventually be deemed to be truthful by the speaker (uttering the statement) even so untruthful by the general public that it is the truth? Then someone else may publish a statement about you that you may deem false but the speaker who made the statement may regard it as being the truth! You see, if we have to evaluate matters as to once political aspirations and views then we only have to look how opposing politicians are using the same data from polls and ABS, etc, and each have their own interpretation to how the same figures apply but they are poles apart in that regard. So that what is the truth or not is lost in the political way matters are expressed. . As such to you NO CARBON TAX of the real Julia or not the not so real Julia or whatever you may attribute to yourself is not really relevant as to it being CRAP or not being published by the media but rather how it is perceived by each reader or viewer who upon his/her own considerations will arrive at a certain perception if something is or isnt CRAP. No media outlet, being newspapers, television, radio, etc, could possibly publish material pending how a reader eventually may perceive the material being published. Therefore, what is needed is to ensure that appropriate criminal sanctions are in place for those who disregard the rights of others but not as to interfere with the FREEDOM OF THE PRESS and/or the FREEDOM OF SPEECH and/or POLITICAL LIBBERTY because the last thing we need is a government sponsored terrorism that only what the Government of the Day may sanction can be published. .
