AFFIDAVIT OF CRIMINAL COMPLAINT

Criminal Complaint Against Memphis Police Department and Memphis Police Director Larry Godwin, Memphis Police Union Station Commander Colonel Lori Bullard, Memphis Police Mount Moriah Station Commander Colonel Sharonda Hampton, Memphis Police Airways Station Commander Colonel Gerald Perry, and Memphis Police Raines Station Commander Colonel Mary Overton-Jackson; Through signed powers of authority, I hereby give notice that I, :joreal-devante:, manage the legal interests of the following autochthon tribal organization and individuals in matters pertaining to assaults and actions committed by Memphis Police Department against the following: 1. Chakchiuma Sektchi Washitaw Clan of Empire Washitaw De Dugdahmoundyah, Memphis-Post-Office-North-Third-Street-Post Box-124-Memphis east from the Mississippi river; 2. Members of Chakchiuma Sektchi Washitaw Clan, Anthony Decarlo Hayes, Joreal DeVante, Allison Hammond, Harry Poole El Bey, Terry Benson, Lisa Merritt, Seymond Raggs, Kerwin Lockett, Carlos Eason, and Yirmiyah Halewi PLAINTIFF Joreal DeVante submits the following facts of criminal complaint affidavit against Memphis Police Department and Memphis Police Director, Larry Godwin, Memphis Police Union Station Commander Colonel Lori Bullard, Memphis Police Mount Moriah Station Commander Colonel Sharonda Hampton, Memphis Police Airways Station Commander Colonel Gerald Perry, and Memphis Police Raines Station Commander Colonel Mary Overton-Jackson, the accused. The following statements are herein made as true and factual against the herein accused parties known by name, and those unnamed associated with crimes described in the following text, which include: 1. 2. 3. 4. 5. Conspiracy to commit Human Rights Violations. Conspiracy to commit aggravated kidnapping. Conspiracy to commit aggravated robbery. Conspiracy to restrict United States of America constitutionally protected rights. Conspiracy to violated United States District Court 1978 Order, Judgment and Decree / No. C76-449. 6. Conspiracy to cause malicious mayhem and murder.

7. Conspiracy to commit Official Oppression. A public servant acting under color of office or employment (acting or purporting to act in an official capacity or taking advantage of actual or purported capacity) who intentionally subjects another to mistreatment, or to arrest, detention, stop, frisk, halt, seizure, dispossession, assessment, or lien that the servant knows is unlawful, or intentionally denies or impedes another in the exercise of enjoyment of any right, privilege, power, or immunity, when the servant knows the conduct is unlawful, commits the Class E felony of official oppression (T.C.A. 39-16-403). 8. Conspiracy to violate the International Convention on the Elimination of All Forms of Racial Discrimination Adopted and ratification by General Assembly resolution 2106 (XX) of 21 December 1965, entry into force 4 January 1969, in accordance with Article 19 9. Conspiracy to violate United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, Adopted and opened for signature, ratification and accession by General Assembly resolution 39/46 of 10 December 1984, entry into force 26 June 1987, in accordance with article 27 (1) 10. Conspiracy to violate United Nations Declaration on the Granting of Independence to Colonial Countries and Peoples was adopted by the United Nations General Assembly on 14 December 1960 11. Conspiracy to violate AMERICAN CONVENTION ON HUMAN RIGHTS 12. Conspiracy to commit Criminal Attempt. Conspiracy to commit genocide in violation of UN International Criminal Court: Genocide is defined [within the ICC] as a list of prohibited acts, such as killing or causing serious harm, committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group. As set out in the Statute, crimes against humanity include crimes such as the extermination of civilians, enslavement, torture, rape, forced pregnancy, persecution on political, racial, national, ethnic, cultural, religious or gender grounds, and enforced disappearances - but only when they are part of a widespread or systematic attack directed against a civilian population.

POINTS AND FACTS STARTING POINT 1. In October of 2009, members of the Chakchiuma Sektchi Clan began traveling the roadways and highways of Memphis, Tennessee and connecting cities, utilizing a tribal designed tag and Photo identification, which were notarized and filed with the Tennessee Governors office to assure proper record of each member of the tribe within the State. This sent notification was considered sufficient notice to ensure safety of tribal members because we are not registered with the Bureau of Indian Affairs. 2. As a peaceful spiritual clan we became fairly knowledgeable of United States of America law and how the Constitution affected the culture of our people, and we decided to seek truth about our indigenous rights to protect our ancient history, culture, and selfgovernance.

3. After traveling around Memphis for about nine months, a member of our tribe was assaulted, kidnapped, and detained by Memphis Police officers while sitting in a private driveway; the officers said they wanted to know about his tribal tag. Complaints were filed against the officers and no action was taken by the Memphis Police Department. 4. This process of unconstitutional stops, harassment, arrest, and detention was committed repeatedly against tribal members, who respectfully appeared in court, and on most occasions, charges were dismissed by the courts. 5. After more than nine incidents of police harassment and intimidation, members of the tribe began filing District Court Actions for un-constitutional actions against them by Memphis Police. 6. On Thursday evening, tribal member Anthony Decarlo Hayes was stopped without cause and given a citation, and on the morning of February 23, 2011, tribal member Lisa Merritt traveled to the Union Station Precinct to secure a police report after her truck was damaged by a hit and run driver while it was parked near her place of business. 7. After Lisa Merritt gave an officer her information, the officer came outside to view the truck and inquired as to the tribal tag on Ms Merritts truck, and after a moment of questioning about the tag, other officers came outside the precinct and one officer removed the tag from the truck and refused to return the private property. 8. While inside the Memphis Police Union Station waiting for a citation to be written for improper registration, Lisa Merritt overheard officers discussing particulars pertaining to Memphis Police Department special in-service training designed to intimidate and assault members of the tribe in order to gain the compliance desired by the Memphis Police Department. 9. Another tribal member, whose family member is a Memphis Police Department employee, was told that the new in-service training was for special officers who were now being trained to beat and force the indigenous people back into regular citizens like everyone else. 10. Another member of the tribe, Anthony Hayes, was informed by an intimate friend (a Memphis Police Department female officer) that special in-service training was being developed to assault people making international indigenous claims with indigenous tags. 11. A member, who is fearful, also spoke with police friends who expressed, The Memphis Police Department is waiting for response from Washington, D.C. Homeland Security, which will give the Memphis Police Department legal clearance to pursue indigenous people as terrorists like the West Memphis Sovereigns who killed the police. Due to these collected facts and information, we are requesting an FBI investigation into legal and illegal practices and unconstitutional policies being implemented by Memphis Police Department

under the direction of Memphis Police Director Larry Godwin to control the indigenous people of Memphis, Tennessee. WE ARE NOT SOVEREIGNS; WE ARE AMERICAN INDIGENOUS PEOPLE as defined by the United Nations Declaration of Rights for Indigenous People. We seek only to restore, protect, and preserve our ancient Mound-builder culture, spiritual freedoms, and rights. RESPECTFULLY, we are requesting investigation into the abovementioned claims, policies and practices implemented for in-service training, specifically, where it pertains to Memphis Police Departments investigating, surveillance, and arresting indigenous people without lawful cause, specifically members of Chakchiuma Sektchi Clan. We have reason to believe our lives are in danger, and it appears as if the Memphis Police Departments in-service training concerning Chakchiuma tribal tags is designed to violate our human rights and rights protected by the United States of America Constitution.
