CIRCULAR ON CADRE RESTRUCTURING


Date: 2-10-2011 Dear Comrades, Sub: Cadre restructuring implications for Hyderabad zone in particular And Andhra Pradesh in general Reg. As you all are aware CBEC vide its letter issued from F.No.8/B/69/HRD(HRM)/201, dt. 29-8-2011 has asked all the CCs/DGs to prepare for implementation of the proposal for cadre restructuring and reorganization of the field formations and the same has been published in our website www.hydexcust.org on 1-92011. The Board has directed that a report on this should be sent to it by 17-10-2011. It is understood that the CR file is still in DoPT after the Board has clarified the doubts and sent it back to DoPT. It is ascertained that the Board is seriously mulling to implement the revised ratio of 15:2:1 for promotions to Asst.Commissioner cadre without linking it to Supreme Courts recent judgement on ratio issue and that all the vacancies in A.C. rank numbering around 3400 in this CR will be filled through internal promotions without reserving any posts for Direct Recruitment. CBEC is stated to have told that action on Supreme Court judgement will be taken separately without linking it to the ongoing CR but CR will be implemented on the basis of upgraded ratio of 15:2:1 prospectively. So the long awaited Cadre Restructuring may be reality by December,2011 if everything goes well as planned. What are the implications for Hyderabad Zone in particular and Andhra Pradesh in particular? Well, the implications for us are neither optimistic nor beneficial as we have been expecting. Please go through the following. The following is going to be the structure of CBEC in Andhra Pradesh after the ongoing C.R. is implemented. I. Total Central Excise Zones in Andhra Pradesh: Total -3

II. Total Central Excise/Service Tax/Audit Commissionerates: Total Hyderabad - 11 - 4 C.Ex. 2 Audit 1 Service Tax - 3 C.Ex ( one of the two Vizag Commtes will be abolished) 1 Audit.

III. Superintendents sanctioned strength present and after CR Each commissionerate in C.Ex/Audit/Service Tax will have a sanctioning strength of 80 Supdts instead of the present 100 posts per Commissionerate. Total Sanctioned posts for 11 Commmissionerates @ 80 Present sanctioned strength - 880

Actual benefit will have to be worked out after considering for Reservation. So the net benefit without Reservations may be around 80 Superintendent posts. In addition to these extra 80 Superintendent Posts, consequential vacancies on account of promotions to A.C. cadre will have to be worked out, which may be around 50 to 60 posts. This is in addition to sanctioning posts of one Superintendent for Commisisoner-Appeals and CCs office. So total additional posts in this CR will be around 130 to 150, and if this is true, Inspectors of 1994 batch and to some extent 1995 batch also may be cleared. IV. Distribution of Superintendent Posts between Hyderabad Zones and Vizag Zone: Present: Hyderabad : Vizag : 420 358

Hyderabad: 7 Commissionerates @ 80 posts Per Commte : 560 Vizag 4 Commtes : 320

Hyderabad will have excess Supdt posts of 240, which may be sufficient for brining all the Superintendents who have gone to Vizag from Hyderabad numbering around 100 to Hyderabad and to accommodate all the newly promoted Superintendents in this CR in Hyderabad itself after retaining all the newly promoted Vizag Superintendents in Vizag Zone itself. So at-least during this CR, allotment to Vizag Zone can be avoided notwithstanding the future exigencies. V. Hyderabad Formations:

(1) Two Zones One Zone with three C.Ex Commissionerates and one Audit Comm - Second Zone with one C.Ex.Commte, one S.T.Commte and one Audit Commte. (2) DGCEI - It will be upgraded to Zone Unit to be headed by Commissioner.

VI. Customs: A new Customs Zone is being created in Vizag with three Customs Commissionerates One in Vizag City, One in Kakinada (Preventive) and another in Hyderabad city. All these three Customs Commissionerates will be tagged to Vizag Customs Zone and this Customs Zone will be tagged to Chennai Customs Cadre Controlling authority. So our worst fears have come true in the sense that we may not be having any chance to work in Customs formations in A.P. as all the posts in Gr.B will be pooled from Customs i.e. Appaisers/Superintendent Customs controlled by Chennai Customs CCA. Substantial damage by way of reduction in Superintendent(Cen.Exc) posts will be done if this Customs scheme is implemented. And of course, Hyderabad C.Ex Zones will not have customs formations like Airport/ACC/ICD. So no more customs postings in future in the present scheme of things.

Based on these proposals, rejigging and reorganizing of the present Hyderabad Zone will have to be carried out. All service tax formations in Hyderabad Zone will be put in the proposed service tax commissionerate. New Central Excise Commissionerates will be bereft of any audit work as the Audit Section in each Zone will be transferred to the proposed new Audit Commissionerates. So let us brace ourselves for long awaited promotions and reorganization of Hyderabad Zone.
