Dear Ms. Weismann: This letter is in response to your Freedom of Information Act (FOIA) request on behalf of the Citizens for Responsibility and Ethics in Washington (CREW), which was received by the Commission on July 15, 2011 and revised on July 21, 2011.1 You request communications to the Commission from parties outside of the agency, including those from elected public officials, relating to the holdings of News Corporation and its subsidiaries, from January 1, 2006 to July 15, 2011 2 You specifically exclude from your request (1) complaints and/or communications filed with the Commission by consumers, (2) internal Commission communications and documents, and (3) publicly available records. Your FOIA request also 3 included a request for a waiver of FOTA fees, which the Commission granted on July 21, 2011. Commission staff has searched agency records and located 233 pages of records responsive to your request. The records consist of 176 pages of e-mail communications between parties outside of the agency and Commission personnel and 57 pages of Congressional 5 correspondence. The records have been enclosed herewith, with redactions made as described below.

Only records within the Commissions possession and control as of the date of receipt of the original request shall be considered within the scope of the Commissions search. See 47 C.RR. 0.461(0(6). See, E-,nailfrom Anne Weismann to Michael Perko (July 21, 2011). This date initiated the twenty-business day period for agency response to your FOIA request. See 47 C.F.R. 0.461 (e)(2)(B)(1). Some enclosed responses issued by former Chairman Martin are not dated but appear to be within the time frame of your request.

Under the FOIA and Commission rules, the agency is required to disclose reasonably described records requested by any person, unless the records contain information that falls within one or more of several exemptions from disclosure. Exemption 6 of the FOIA permits 6 the Commission, in its discretion, to withhold information in order to protect individuals personal privacy. Pursuant to this exemption, the Media Bureau has redacted individual e-mail 7 addresses and telephone numbers from the enclosed e-mail correspondence.
